Abstract

This research deeply explores the interpretation of fiqh verses in the book 'Sabilal Muhtadin' authored by Sheikh Muhammad Arsyad al-Banjari and its connection to the Banjar community. The book, an extensive exploration of the Syafii school of thought, intricately weaves together fiqh, hadith, and Qur'anic interpretation. Analyzing over 184 traditions across two volumes, al-Banjari not only references renowned scholars but also introduces independent perspectives on Islamic law. His method of interpreting legal verses, incorporating vocabulary analysis and Prophet Traditions, showcases a comprehensive understanding deeply rooted in scholarly tradition. Moreover, this research highlights the fusion of various interpretative styles within Sabilal Muhtadin, positioning it as an amalgamation of textual evidence and reasoned analysis—a unique contribution to the realm of Islamic jurisprudence. The category of tafsir is characterized by fiqhi and the method is divided into three; tafsir with history, tafsir with ra'yu (linguistic analysis, kias and logical reasoning), and combined tafsir (idzdiwaji).

Abstract

Latar belakang: Salah satu masalah kesehatan ibu dan anak di Indonesia adalah pemberian ASI Eksklusif. Rendahnya pemberian ASI Eksklusif disebabkan oleh perilaku ibu itu sendiri. Tujuan: Penelitian ini bertujuan untuk menganalisis determinan ibu bekerja yang tidak memberikan ASI Eksklusif di wilayah kerja Puskesmas Sitinjak Kabupaten Tapanuli Selatan Tahun 2023. Metode: Penelitian ini bersifat kuantitatif degan pendekatan cross sectional study di wilayah kerja Puskesmas Sitinjak mulai November 2022 sampai Januari 2023. Populasi dan sampel adalah seluruh ibu bekerja yang ada di Wilayah Kerja Puskemas Sitinjak dengan tekhnik pengambilan sampel secara total sampel (exhaustive sampling) sebanyak 80 ibu. Pengumpulan data menggunakan kuesioner serta pengolahan dan analisis data mengunakan program SPSS dengan uji Chi-Square dan regresi logistik. Hasil: Hasil penelitian ini menunjukkan bahwa sikap ibu (p=0.000), dukungan suami (p=0.001) berhubungan secara signifikan dengan ibu bekerja yang tidak memberikan ASI Eksklusif. Pengetahuan ibu ( p=0.17) tidak berhubungan secara signifikan dengan ibu bekerja yang tidak memberikan ASI Eksklusif serta variabel yang paling berhubungan adalah dukungan suami dengan nilai Exp (B)=0.206,CI 95%=0.067-0.633. Kesimpulan: Temuan penelitian ini bahwa ibu bekerja tidak memberikan ASI eksklusif dipengaruhi oleh faktor sikap dan dukungan suami sehingga diperlukan upaya untuk menanggulangi pemberian ASI Eksklusif dengan cara memberikan pendidikan kesehatan kepada semua ibu hamil dan menyusui.

Abstract

Transactions in restaurants with the All You Can Eat system have attracted public attention because it gives customers freedom to take portions of food with a predetermined time limit and price. This study aims to analyse the element of gharar in the All You Can Eat system and provide insight into the legal issues and solutions related to this system. The research uses a qualitative method. The result is that there is an aspect of gharar in the All You Can Eat transaction system, and it reduces the validity of the transaction from the perspective of sharia economic law. To overcome this problem, the solutions that can be taken are improving the transparency aspect of menu presentation, determining reasonable consumption limits, implementing clear rules and regulations, and educating customers about the All You Can Eat concept and the responsibilities of using the system. In addition, restaurants can also consider a pre-set menu or meal plan system. This can reduce ambiguity in transactions and provide a more structured dining experience. Abstract

Abstract This paper aims to describe the local wisdom of the sale and purchase contract of the Banjar people according to sharia economic law based on Shafi’iyah fiqh’s perspective, which interacts with customs in the local wisdom. The research method was normative legal research with a conceptual approach. The local wisdom of the sale and purchase contract of the Banjar people, which was deeply rooted in society, was the words tukar-jual and barelaan. The words tukar-jual, according to sharia economic law, were categorized as shighat (ijab and qabul) in the contract, and the expression barelaan was an expression of asking for willingness, which represented one of the principles of sharia contract law that must be implemented, namely the principle of ‘an taradhin (mutual consent). These words of tukar-jual and barelaan showed the interaction between custom and Shafi’i jurisprudence because, in the Shafi’i school of thought, a strong opinion stated that sales and purchases were considered valid when committing through verbal ijab and qabul; under circumstances when valid sales and purchase could be applied with mutual consent. Furthermore, consent is something that cannot be seen physically. In the Shafi’i school of thought, consent is defined through verbal statements, indicating pleasure’s fulfillment from both parties. The expression of barelaan in Banjar people, apart from entering into a contract through tukar-jual, is also a way to express approval.  Keywords: Contract; Banjar People; Local Wisdom; Sale and Purchase
