Abstract

Abstract

The purpose of this article is to explore the importance of pluralist theology for the serenity of urban society in the study of anapanasati meditation in the Karangdjati monastery. The subjects of the study were non-Buddhist meditation participants, meditators and administrators of Karangdjati Vihara. Anapanasati meditation (breathing meditation) at Karangdjati Vihara is increasingly practiced by people who adhere to different religions or have different ways of worship, especially non-Buddhist participants. The results of this study show that there are several Reactualizations of pluralist theology, namely that meditation not only serves as a spiritual practice that allows individuals to focus on themselves and understand the universal values embraced by various religions and cultures, but also as a process that facilitates understanding and appreciation of other religious and cultural differences. Therefore, meditation in the context of pluralist theology helps individuals gain a deeper awareness and understanding of the universal values upheld by different religions and cultures, while also helping to reduce conflict and encourage interfaith and intercultural dialogue.

Abstract

The phenomenon of transmigration in Indonesia has brought about various social and cultural changes for relocated communities, including Balinese transmigrants in Lampung. As a group with strong traditions and cultural identity, Balinese transmigrants face challenges in preserving their cultural heritage amidst interactions with diverse local communities. This article aims to explore the efforts made by the Balinese transmigrant community in Lampung to maintain their cultural identity. The study employs a qualitative approach with an ethnographic design, involving in-depth interviews, participatory observation, and document analysis. The findings reveal that Balinese transmigrants have successfully preserved their cultural identity through the continuation of traditional rituals, language, and support from customary institutions and religious organizations. However, the adaptation process also involves adjustments to local culture, creating complex dynamics of acculturation. The implications of this research highlight the importance of social institutions in supporting the continuity of migrant communities’ cultural identity, as well as the relevance of transmigration policies that consider cultural dimensions. These findings contribute to the understanding of how migrant groups can maintain their identity while adapting to new environments, providing insights for further studies on migration and cultural identity in Indonesia.

Abstract

This research examines Hasan Hanafi's thoughts on the deconstruction of ushul fiqh science as an effort to reactualize Islamic law. The results showed four main findings. First, Hasan Hanafi pays great attention to the revitalization of ushul fiqh through a historical approach, by emphasizing the importance of the historical and human dimensions in understanding the concept and methodology. This dimension is actually inherent in the classical methodology of ushul fiqh, but has been obscured as the discipline has developed. For Hanafi, the historical dimension is present in all elements of ushul fiqh, including adillah syar'iyyah, thuruq al-istinbath, and al-ahkam al-syar'iyyah, which are represented through the keywords "history" and "human". Second, the revitalization offered by Hanafi is a methodological update that adapts ushul fiqh to social reality, humanity, and the development of science, without breaking away from the traditions and treasures of classical scholars. Third, Hanafi's thinking is considered relevant for the reactualization of Islamic law because it is able to respond to the dullness and freezing of ushul fiqh by reviving its vital spirit and elan through a historical approach. Fourth, the historical idea is rooted in Hasan Hanafi's great project of al-Turats wa al-Tajdid, which views the loss of the human and historical dimensions as the cause of the stagnation of the progressivity of Muslim thought and praxis. Thus, this framework offers a conceptual basis for contextual readings of Islamic law that are adaptive, critical, rooted in tradition, and responsive to the challenges of global contemporary times.

Abstract

The practice of the fee system in the wakalah (house purchase and sale) contract in Way Laga Village covers the payment mechanism (2% or IDR 6 million of the IDR 300 million price), payment timing (upfront), the form of agreement (verbal), and the duties of the representative. This study also analyzes the perspectives of Islamic economic law on the implementation of the fee system, including its compliance with the pillars of wakalah bil ujrah (contractual agreement), the principle of ujrah (indebtedness), the potential for gharar (unlawful agreement), the trustworthiness of wakalah (indebtedness), and the principle of justice. This research also involves an in-depth study from an Islamic economic legal perspective regarding the validity of this mechanism and the possibility of violations. The method used was a qualitative field-based approach with a descriptive analytical approach. Primary data were collected through in-depth interviews with parties directly involved in the transaction. The data was then processed through editing, coding, and structured grouping using inductive analysis based on field findings and guided by the principles of Islamic jurisprudence (fikih muamalah). The results indicate that the practice of fee payments is carried out verbally without a clear, legally binding written contract. The fee is paid by the muwakil to the agent before the transaction is completed, thus violating the principle of the agent's trust, creating elements of gharar (uncertainty), tadlis (false statements of facts), and raising fundamental doubts about the validity of the wakalah contract as a whole. A serious problem arises if the agent fails to fulfill his duties within 5 months, as his duties are rendered ineffective even though the fee was paid in advance by the muwakil before the house was sold.
