Abstract

Penelitian ini bertujuan untuk menganalisis pelaksanaan perlindungan hukum terhadap konsumen dalam transaksi E-Toll di Kota Makassar, serta untuk menganalisis kendala yang dialami konsumen dalam mendapatkan perlindungan hukum saat menggunakan E-Toll di Kota Makassar. Kasus ini menyoroti bahwa pengguna mungkin mengalami masalah seperti saldo yang terpotong dua kali atau transaksi yang gagal tercatat dimana pengguna jalan tol diharuskan memiliki E-Toll Card sebagai opsi pembayaran di jalan tol, sehingga konsumen tidak memiliki pilihan alternatif lainnya untuk melakukan pembayaran dan menimbulkan ketidaknyamanan bagi konsumen yang ingin menggunakan jalan tol. Penelitian ini menggunakan metode penelitian Normatif dan Empiris. Dengan sumber data primer dan sekunder. Studi ini dilakukan di Kantor PT. Makassar Metro Network yang berlokasi di Menara Bosowa lantai 4 Makassar Sulawesi Selatan. Teknik pengumpulan data melalui wawancara dengan berbagai pihak terkait yang relevan dengan judul skripsi ini. Pelaksanaan perlindungan hukum terhadap konsumen dalam traksaksi E-Toll di Kota Makassar masih belum terlaksana dengan maksimal serta kendala yang dihadapi dalam perlaksanaan E-Toll mencangkup teknis dan oprasional termasuk aspek sosial. This research aims to analyze the implementation of legal protection for consumers in E-Toll transactions in Makassar City, as well as to analyze the obstacles experienced by consumers in obtaining legal protection when using E-Toll in Makassar City. This case highlights that users may experience problems such as balances being deducted twice or transactions that fail to be recorded where toll road users are required to have an E-Toll Card as a payment option on toll roads, so that consumers do not have other alternative options for making payments and cause inconvenience for consumers who want to use toll roads. This research uses Normative and Empirical research methods. With primary and secondary data sources. This study was conducted at the PT. Makassar Metro Network which is located on the 4th floor of the Bosowa Tower, Makassar, South Sulawesi. Data collection techniques through interviews with various related parties relevant to the title of this thesis. The implementation of legal protection for consumers in E-Toll transactions in Makassar City is still not implemented optimally and the obstacles faced in implementing E-Toll include technical and operational aspects including social aspects.

Abstract

Penelitian ini bertujuan untuk mengetahui tanggung jawab pelaku usaha atas kerusakan rangka pada sepeda motor yang telah dijual serta untuk mengetahui bagaimana penyelesaian sengketa hukum antara pelaku usaha dengan pengguna sepeda motor Honda. Penelitian ini menggunakan tipe penelitian empiris (field research) atau penelitian lapangan yaitu penelitian yang objeknya mengenai fakta sosial, gejala-gejala, peristiwa, dan fenomena yang terjadi di masyarakat. Hasil penelitian menunjukkan bahwa pertanggungjawaban dari PT Astra Honda Motor yang telah merugikan konsumen atas terjadinya kerusakan pada rangka ESAF melalui dua aspek, yaitu pertanggungjawaban dari pelaku dan metode penyelesaian sengketa yang relevan. Tujuan penelitian ini menganalisis tanggung jawab PT Astra Honda Motor terhadap cacat produk rangka ESAF menurut Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan menganalisis penyelesaian sengketa antara konsumen dengan PT Astra Honda Motor terkait cacat produk rangka ESAF dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Metode penelitian ini menggunakan legal research (normatif). This study aims to determine the responsibility of business actors for frame damage on motorcycles that have been sold and to determine how to resolve legal defense between business actors and Honda motorcycle users. This study uses empirical research (field research) or field research, namely research whose objects are social facts, symptoms, events, and phenomena that occur in society. The results of the study indicate that this study examines the responsibility of PT Astra Honda Motor which has harmed consumers for damage to the ESAF frame through two aspects, namely the responsibility of the perpetrator and the relevant settlement method. The purpose of this study is to analyze the responsibility of PT Astra Honda Motor for ESAF frame product defects according to Law Number 8 of 1999 concerning Consumer Protection and to analyze the settlement between consumers and PT Astra Honda Motor regarding ESAF frame product defects in Law Number 8 of 1999 concerning Consumer Protection. This research method uses legal research (normative).

Abstract

Penelitian ini bertujuan untuk mengetahui modus tindak pidana laporan pencatatan palsu pada transaksi keuangan Bank Syariah Mandiri Morowali serta untuk mengetahui dasar petimbangan hakim yang memutus perkara Nomor 45/Pid.B/2018/PN.Pso. Penelitian ini dilaksanakan di Pengadilan Negeri Poso dengan menggunakan penelitian pustaka dan penelitian lapangan dengan tipe penelitian hukum normatif. Pengumpulan data menggunakan wawancara dan dokumen. Untuk menganalisis data menggunakan metode deskriptif kualitatif. Hasil penelitian ini adalah menunjukkan bahwa pada putusan Nomor 45/Pid.B/2018/PN.Pso dengan modus memanfaatkan posisi dominan atau kedudukan terdakwa sebagai pimpinan dengan jabatan Manager Operasional untuk melakukan tindak pidana perbankan syariah. Dan diketahui dasar pertimbangan hakim dalam memutus perkara adalah pertimbangan yuridis sesuai dengan aturan hukum pada Pasal 63 Undang-Undang Nomor 21 Tahun 2008 Tentang Perbankan Syariah, pertimbangan sosiologis terdakwa dan akibat yang langsung timbul. Tetapi hakim tidak mempertimbangkan akibat yang akan datang dari tindak pidana yang dilakukan terdakwa. This study aims to determine the mode of criminal acts of false recording reports on financial transactions of Bank Syariah Mandiri Morowali and to determine the basis for the judge's considerations in deciding case Number 45 / Pid.B / 2018 / PN.Pso. This research was conducted at the Poso District Court using library research and field research with the type of normative legal research. Data collection using interviews and documents. To analyze the data using qualitative descriptive methods. The results of this study indicate that in decision Number 45 / Pid.B / 2018 / PN.Pso with the mode of utilizing the dominant position or position of the defendant as a leader with the position of Operational Manager to commit a crime of Islamic banking. And it is known that the basis for the judge's considerations in deciding the case is legal considerations in accordance with the rules of law in Article 63 of Law Number 21 of 2008 concerning Islamic Banking, sociological considerations of the defendant and the immediate consequences. But the judge did not consider the future consequences of the criminal act committed by the defendant.

Abstract

Tujuan penelitian ini untuk mendeskripsikan dan mengetahui penerapan sanksi pidana dan hambatan dalam mengembangkan objek pariwisata di Toraja Utara. Penelitian ini menggunakan pendekatan deskriptif kualitatif dengan jenis data primer sekunder yang diperoleh dari studi kepustakaan dan wawancara. Hasil penelitian ini menjelaskan bahwa Toraja Utara dalam menerapkan sanksi belum dapat diterapkan karena sebagian bahkan seluruh objek wisata di Toraja Utara masih dikelola pihak yayasan atau keluarga, Hambatan penerapan sanksi karena anggaran yang lambat bahkan tidak ada, dan kurangnya sarana prasarana sehingga tidak menjangkau setiap pelanggaran Perda yang ada di Toraja Utara. Pemerintah Daerah perlu kerjasama dengan pemilik yayasan objek wisata agar terjadi keamanan yang baik sehingga mengurangi pelanggaran Perda terhadap pelaku pengrusakan objek wisata. The research aims to describe and determine the application of criminal sanctions and barriers in developing tourism objects in North Toraja. This study uses a qualitative descriptive approach with secondary primary data types obtained from literature and interview studies. The results of this study explained that North Toraja in applying sanctions can not be applied because some even the whole tourist attraction in North Toraja still managed by the foundation or family, barriers to application of sanctions due to slow budget Not even exist, and lack of infrastructures so as not to reach any violations of Perda that exist in North Toraja. The local government needs to cooperate with the owner of the tourism object in order to make good security, thus reducing Perda violations against the perpetrators of tourism objects.

Abstract

Penelitian bertujuan untuk menganalisis implementasi pelindungan data pribadi nasabah di lingkungan PT Bank Mega, Tbk Makassar dengan menitikberatkan pada tiga aspek utama, yakni proses identifikasi dan verifikasi data, pemrosesan data, serta pengamanan data pribadi nasabah. Dengan menggunakan pendekatan kualitatif dan metode normatif empiris, penelitian ini menggambarkan praktik aktual yang dijalankan oleh lembaga perbankan, serta hambatan yang dihadapi baik dari sisi internal maupun eksternal. Hasil menunjukkan bahwa pelaksanaan pelindungan data dilakukan secara sistematis melalui prosedur operasional yang merujuk pada regulasi perbankan dan standar internal, seperti mekanisme verifikasi berlapis menggunakan alat ABAKA dan formulir persetujuan pemrosesan data. Meskipun terdapat upaya peningkatan perlindungan data, hambatan tetap muncul, antara lain keterbatasan pengetahuan dan integritas karyawan, serta kejahatan siber dari pihak luar yang berupaya membobol sistem keamanan data. Dalam praktiknya, bank telah menetapkan protokol mitigasi seperti pelatihan internal, pembaruan sistem, dan pemeliharaan data berdasarkan klasifikasi risiko nasabah. Penelitian ini menyimpulkan bahwa pelindungan data pribadi memerlukan sinergi antara regulasi yang komprehensif dan pelaksanaan teknis yang berkelanjutan, serta kesiapan sumber daya manusia dalam menghadapi tantangan teknologi digital. This study discusses the implementation of customer personal data protection in PT Bank Mega, Tbk Makassar by emphasizing three main aspects, namely the data identification and verification process, data processing, and securing customer personal data. Using a qualitative approach and empirical normative methods, this study describes the actual practices carried out by banking institutions, as well as the obstacles faced both internally and externally. The results show that the implementation of data protection is carried out systematically through operational procedures that refer to banking regulations and internal standards, such as a layered verification mechanism using the ABAKA tool and a data processing consent form. Despite efforts to improve data protection, obstacles still arise, including limited employee knowledge and integrity, as well as cybercrime from external parties trying to break into the data security system. In practice, the bank has established mitigation protocols such as internal training, system updates, and data maintenance based on customer risk classification. This study concludes that personal data protection requires synergy between comprehensive regulations and ongoing technical implementation, as well as human resource readiness in facing the challenges of digital technology.

Abstract

Penelitian ini mengkaji implementasi perlindungan data pribadi nasabah pada Bank BRI Kanwil Makassar dengan tujuan untuk mengevaluasi kesesuaian antara praktik perlindungan data dengan ketentuan hukum yang berlaku. Isu perlindungan data pribadi semakin relevan di era digital karena meningkatnya ancaman kebocoran informasi dan penyalahgunaan data nasabah oleh pihak-pihak yang tidak bertanggung jawab. Metode penelitian yang digunakan adalah yuridis empiris, dengan pendekatan normatif terhadap peraturan perundang-undangan yang berlaku dan pendekatan empiris melalui wawancara dengan pihak internal bank. Hasil temuan menunjukkan bahwa Bank BRI telah menerapkan sejumlah kebijakan, seperti transparansi dalam pengumpulan data, penyampaian tujuan penggunaan data, serta sistem keamanan digital yang canggih. Namun demikian, pelaksanaan di tingkat operasional masih menghadapi berbagai kendala, seperti kesenjangan pemahaman karyawan, kompleksitas sistem teknologi, dan rendahnya literasi digital nasabah. Faktor internal dan eksternal menjadi hambatan utama dalam implementasi kebijakan, termasuk belum optimalnya pengawasan terhadap pihak ketiga serta kurangnya kesadaran nasabah dalam menjaga informasi pribadi. Upaya mitigasi yang telah dilakukan oleh Bank BRI meliputi pelatihan internal, penguatan infrastruktur teknologi, dan penyederhanaan sistem operasional. Penelitian ini menyoroti pentingnya penguatan kerangka hukum dan edukasi publik sebagai bagian dari ekosistem perlindungan data yang berkelanjutan. Diharapkan hasil penelitian ini dapat menjadi masukan strategis dalam pembentukan kebijakan perlindungan data di sektor perbankan. This study investigates the implementation of personal data protection for customers at Bank BRI Regional Office Makassar, aiming to assess the alignment between practical applications and the applicable legal framework. The issue of personal data protection has gained urgency in the digital era, with increasing threats of data breaches and misuse by unauthorized parties. The research method employed is empirical juridical, combining normative analysis of relevant legislation with empirical data collected through interviews with internal bank departments. The findings indicate that Bank BRI has introduced several policies, including transparent data collection processes, clear communication of data usage purposes, and robust digital security systems. However, the implementation at the operational level still encounters several challenges, including employee knowledge gaps, technological complexity, and low digital literacy among customers. Both internal and external factors hinder the effectiveness of the current system, such as inconsistent compliance across units, limited supervision of third-party data processors, and lack of customer awareness in protecting personal information. Mitigation efforts include internal training programs, upgrades in technology infrastructure, and streamlined operational procedures. This research emphasizes the need for strengthening legal frameworks and enhancing public education as integral parts of a sustainable data protection ecosystem. The findings are expected to contribute to strategic policy development in the banking sector.

Abstract

This research aimed to analyze the implementation of diversion in the investigation process, prosecution, and court examination of children in conflict with the law. Four police sectors (Biringkanaya police sector, Tamalanrea police sector, Tallo police sector, and Mariso police sector) have been chosen, including the state prosecutor’s office and district court of Makassar cases in 2015. This research was carried out through document searches and interviews with investigators, public prosecutors, and judges. The result showed that the diversion had been applied to every step of the investigation, prosecution, and court examination, but the achievement and implementation could have been more optimal. Overall data from the four police sectors showed that during 2015 there were 74 (seventy-four) cases of children conflicting with the law, and 7 (seven) cases had succeeded in reaching a diversion agreement (9.46%). Public prosecutors had sought diversion at the level of examination at the prosecutor’s office, but no agreement was reached. In the Makassar District Court in 2015, 223 (two hundred twenty-three) cases and 24 (twenty-four) went through the diversion agreement.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan sanksi disiplin terhadap pelanggaran disiplin jam kerja Pegawai Negeri Sipil (PNS) di Kantor Wilayah Direktorat Jenderal Bea dan Cukai Sulawesi Bagian Selatan. Metode penelitian yang di gunakan adalah penelitian Hukum Normatif Empiris. Hasil penelitian menunjukkan bahwa penerapan sanksi disiplin terhadap pelanggaran disiplin jam kerja Pegawai Negeri Sipil di Kantor Wilayah Direktorat Jenderal Bea dan Cukai Sulawesi Bagian Selatan telah dilakasanakan sesuai dengan ketentuan peraturan perundang-undangan yang berlaku yaitu Peraturan Pemerintah 94 Tahun 2021 pasal 4 huruf f dan Peraturan Menteri Keuangan Nomor 221/PMK.01/2021, terutama terkait dengan pemotongan tunjangan dan akumulasi ketidakhadiran pada tahap hukuman disiplin ringan, sedang dan berat. Penerapan sanksi disiplin terhadap Pegawai Negeri Sipil yang melanggar ketentuan jam kerja di Kantor Wilayah Direktorat Jenderal Bea dan Cukai Sulawesi Bagian Selatan belum berjalan secara efektif yang ditunjukan masih ada pegawai melakukan pelanggaran dan terdapat pegawai yang melakukannya secara berulang serta tidak merasakan dampak atas pembelajaran dan pembinaan yang telah dilakukan. Penerapan hukuman belum efektif karena: (a) faktor sanksi dan hukuman, (b) penegakan hukuman disiplin, (c) sarana pengawasan dan monitoring dan (d) faktor individu pegawai dan masyarakat. This research aims to determine the application of disciplinary sanctions for violations of the working hours of Civil Servants (PNS) at Regional Office of Directorate General of Customs and Excise Southern Sulawesi.  The research method used is Empirical Normative Legal research. The results of the research show that the application of disciplinary sanctions for violations of civil servant working hours discipline at at Regional Office of Directorate General of Customs and Excise Southern Sulawesi has been carried out under the provisions of applicable laws and regulations, namely Government Regulations 94 of 2021 article 4 letter f and Minister of Finance Regulation Number 221/PMK.01/2021, especially related to deductions. allowances and accumulated absences which are at the stage of light, medium, and heavy disciplinary penalties. The application of disciplinary sanctions to civil servants who violate working hours provisions at Regional Office of Directorate General of Customs and Excise Southern Sulawesi has not been implemented effectively, as shown by the fact that there are still employees committing violations and there are employees who do it repeatedly and do not feel the impact of the learning and coaching that has been carried out. The application of punishment has not been effective because (a) sanctions and punishment factors, (b) enforcement of disciplinary penalties, (c) means of supervision and monitoring, and (d) individual employee and community factors.

Abstract

Pembangunan infrastruktur bukanlah hal yang mudah untuk dilaksanakan. Karena keragaman budaya dan kondisi geografis, sehingga dalam pelaksanaannya harus sesuai dengan nilai-nilai masyarakat adat. Penelitian ini bertujuan untuk menganalisis ketentuan pemanfaatan sumber daya alam masyarakat adat dan menganalisis implementasi hukum adat dalam pembangunan infrastruktur berkelanjutan. Penelitian ini menggunakan metode pendekatan yuridis normatif melalui bahan kajian hukum primer dan sekunder untuk mencari jawaban atas penelitian tersebut. Hasil penelitian menunjukkan bahwa pembangunan infrastruktur yang menjadi hak adat masyarakat adat untuk kepentingan umum dapat dilakukan dengan penyerahan tanah oleh pemerintah bersama masyarakat adat berdasarkan kesepakatan antar masyarakat adat dan peraturan yang berlaku. Dalam pembangunan infrastruktur suatu kawasan memerlukan sumber daya alam baik berupa tanah maupun hutan, tentunya dalam pelaksanaan pembangunan infrastruktur terkadang masuk ke dalam kawasan hutan adat dan tanah adat sehingga menimbulkan konflik yang semakin tajam, apalagi masyarakat adat telah menerima hak negara atau hak milik. pengakuan pemerintah daerah yang dituangkan dalam Peraturan Daerah.

Abstract

This research aims to analyze the legal legitimacy of ownership and control of culturally traditional assets in Indonesia, which drive the economicization of cultural wealth through the national tourism industry. Legal weaknesses impede recognition and support to promote the economicization of these cultural assets. The research begins with a review of regulations and policy documentation to understand the philosophical and sociological foundations of the regulation of cultural copyright ownership. The study also examines theoretical aspects of the implementation of the law.Field research is conducted through a series of in-depth interviews with experts and practitioners, both legal professionals and music industry practitioners, collecting data on public understanding through questionnaires. Field data is analyzed quantitatively, while document data and doctrinal studies are analyzed qualitatively.The results of the research indicate a low awareness of locally-based cultural intellectual wealth, as evidenced by the weak appreciation of society, including local governments, in inventorying and registering communal intellectual property assets. The subsequent effect is the weakness in optimizing the commercial value of communal intellectual property, especially in the cultural tourism sector.
