Abstract

implementation of the duties and functions of the regional disaster management agency in dealing with natural disasters that occurred in kupang city, lack of personnel and inadequate disaster service facilities in dealing with disasters that occurred in kupang city. in this case, the regional disaster management agency is lacking in the number of personnel and facilities to deal with the disaster that occurred, the number of field personnel and facilities should be increased to be able to help the people affected by the disaster that occurred. the formulation of the problem in this research is (1) how is the implementation of the duties and functions of bpbd in dealing with natural disasters in the city of kupang in 2021? (2) what are the factors inhibiting the implementation of the duties and functions of the regional disaster management agency (bpbd) in managing natural disasters according to regional regulation number 6 of 2010 in the city of kupang. the method used in this research is empirical legal research, namely examining the implementation of the duties and functions of the regional disaster management agency according to regional regulation number 6 of 2010 concerning the organization and work procedures of the kupang city regional disaster management agency by looking at how this law is implemented in the community through results interviews and from observations. research location, kupang city regional disaster management agency office and kupang city community. the types of data used here consist of primary and secondary data. based on the research results, there are data and facts that the author has obtained, the author concludes that the kupang city regional disaster management agency is still lacking in the number of field personnel and the infrastructure is still inadequate. in connection with this case, the author draws the conclusion; (a) disaster management and handling of refugees is fast, precise, effective and efficient because there are many agencies and organizations that take part in disaster management, (b) the kupang city regional disaster management agency must add field personnel and infrastructure. suggestion: regional disaster management agency must increase special disaster training and education for officials at least once a month so that bpbd officials become reliable and skilled officials in dealing with disasters according to their respective topics.

Abstract

The purpose of this study, conducted by the author, is to generally understand and analyze the relationship between the village chief and the village deliberative body (Badan Permusyawaratan Desa) in the implementation of development in Mundinggasa and Natanangge Villages. It aims to identify and examine the obstacles that hinder the relationship between the village chief and the village deliberative body in the implementation of village development in Mundinggasa and Natanangge Villages, using an empirical juridical method and analyzing qualitative descriptive data. The research focus includes the relationship between the village chief and the village deliberative body, development planning, implementation, supervision, and the impact of the relationship on the administration of the village. Data were directly obtained from the research location involving 12 respondents. The results of the study conducted by the author show that the relationship between the village chief and the village deliberative body in development planning is generally good. However, the main issue lies in the lack of communication and coordination between the village chief and the village deliberative body, resulting in the implementation of village development not proceeding smoothly and being vulnerable to exceeding the specified time frame in the development plan. A positive relationship can bring about beneficial changes in village governance, but a lack of harmony in the relationship, due to insufficient transparency from the government institutions, can lead to negative impacts.

Abstract

This research has been carried out in Nobi-Nobi Village, Central Amanuban District, South Central Timor Regency in September 2023. The purpose of this study is to identify the role that village heads play in the management of village funds in Nobi-Nobi Village, Central Amanuban District, South Central Timor Regency, as well as the factors that inhibit this management. Both normative and empirical juridical legal methodologies were employed in this investigation. Primary and secondary data are the two categories and sources of data. Literature reviews, interviews, and observation are used as data collection methods. Tabulation, coding, and editing are the three steps in data processing. The results showed that the management of Village Funds in Nobi-Nobi Village, Central Amanuban District, South Central Timor Regency from the planning stage, the implementation stage to the accountability stage has not run optimally in compliance with village financial management regulation Number of 2018 issued by the minister of home affairs. Inhibiting factors in the management of Village Funds in Nobi-Nobi Village are, lack of human resources, incomplete facilities and infrastructure, lack of awareness from the community and tend not to understand and sources of income that only come from one source, namely transfer funds.

Abstract

Based on Law No. 6 of 2014 concerning Villages, Article 1 paragraph (2) states that "Village Government is the organizer of government affairs and the interests of local communities in the government system of the Unitary State of the Republic of Indonesia. The Village Government is the Village Head or what is referred to by another name, assisted by Village officials as the organizing element of the Village Government." The problems faced include, among other things, the function of the village head in carrying out village development in Bipolo Village and Oeteta Village must increase enthusiasm, and encourage the community in carrying out village development to involve more of the entire Bipolo Village community and Oeteta Village community in development activities. And provide outreach to the community that the community also has a role to be involved in the implementation of village development. This research aims to find out the function of the village head in carrying out village development in Bipolo Village and Oeteta Village and to find out the factors inhibiting the function of the Village Head in carrying out village development in Bipolo Village and Oeteta Village. The method used in this research is empirical juridical and statutory and primary data and secondary data are used as types of data sources. The research results show that the function of the Village Head is in carrying out village development in Bipolo Village and Oeteta Village. Bipolo village is running quite well because some village development has been realized, but the community is not firm enough to fully support the implementation of village development. Oeteta Village is going quite well because all village development activities are still in the planning stage which will be implemented in 2023. Then, there are two inhibiting factors in implementing the duties and functions of the Bipolo and Oeteta village heads in implementing village development, namely human resources and facilities and infrastructure, which has not been effective in supporting the implementation of village development through increasing the economic, educational and health needs of the community. So researchers need to make collaborative efforts between the community and the village government to implement development in each village. There is awareness of bipolo and oeteta village heads in their duties and functions to prioritize the needs of local communities so that village development can run according to established plans. There is awareness of the village head and village officials to continue to supervise the implementation of village development through all village consultation proposals based on meetings to submit proposals which must be prioritized so that they can be implemented every year.

Abstract

This study discusses two issues, namely: (1) To what extent is the implementation of the function of the Regional Development Planning Agency of North Central Timor Regency in terms of the Regional Regulation of North Central Timor Regency Number 9 of 2008 concerning the Organization and Work Procedures of the Regional Development Planning Agency, Inspectorate and Other Regional Technical Institutions of North Central Timor Regency? (2) What are the factors that are obstacles in the implementation of the functions of the Regional Development Planning Agency of North Central Timor District? The research method used is the empirical method, which is research conducted directly to related parties to obtain primary data directly from respondents. The data collection techniques used are: observation, interviews, and documentation. The results of research and discussion: (1) The implementation of the functions of the Regional Development Planning Agency (BAPPEDA) in terms of Regional Regulation Number 09 of 2008 concerning the Organization and Work Procedures of the Regional Development Planning Agency, Inspectorate and Other Regional Technical Institutions of North Central Timor Regency in the process of regional development planning in North Central Tmor Regency is through Village/Village level Development Planning Deliberations, District Development Planning Deliberation, and finally the District Government Work Plan Development Planning Deliberation where the aspirations and proposals of the community are as a determination of the formation of the Regional Long-Term Development Plan (RPJPD), Regional Medium Term Development Plan (RPJMD) and then make a Regional Apparatus Work Plan (RKPD), as a strategy used by BAPPEDA for development programs in North Central Timor District. (2) Inhibiting factors in the implementation of the function of providing support for the implementation of local government in the field of development planning and the function of guidance and implementation of tasks in accordance with the scope of Bappeda's duties in North Central Timor Regency. There are several obstacle factors such as: Aspects of Geography and Domography related to human resources, aspects of community welfare, aspects of public services, and aspects of regional competitiveness.

Abstract

The village, which is the scope of the organization or is the smallest government structure and is closer to the community, has an important role in carrying out the autonomy mandated by the constitution as a path to a prosperous people. The Village Head has an important role in his position as an arm of the state that is close to the community and as a community leader, while the Village Consultative Body is an institution that carries out government functions. Village governance is a subsystem of the government administration system, so that villages have the authority to regulate and manage the interests of the community. In carrying out a unified government, the relationship pattern between the Village Head and the Village Consultative Body must be balanced and run according to their respective positions, duties and functions, none of which is higher, where both parties have an important role in implementing Village development. This research basically uses juridical-empirical methods. The results of this research show that: (1) The relationship between the village head and the Village Consultative Body is that currently development has not been implemented well from the planning stage to the implementation stage due to poor relations between the Village Head and the Village Consultative Body and (2) Lack of communication channels which can result in miscommunication, misunderstanding and disagreement in development priorities. And the education level of BPD members is also still relatively low.

Abstract

In Kupang City, the implementation of regional regulations on tourism development on Nunsui Oesapa beach has not been carried out properly. Community empowerment and the development of public infrastructure, public facilities, and tourism facilities have not been carried out optimally in accordance with applicable regulations. In order to optimize income from tourism on Nunsui Oesapa beach, by building adequate public infrastructure, public facilities, and public facilities as well as good community empowerment. The results of this study show that: (1) The effectiveness of Kupang City Regional Regulation Number 4 of 2019 concerning the City Tourism Development Master Plan for 2019-2025 at Nunsui Oesapa Beach in an effort to increase the original income of Kupang City has not been effective, (2) The contribution of income from Nunsui Oesapa beach tourism has not contributed well and (3) Factors that hinder the effectiveness of the implementation of Kupang City Regional Regulation Number 4 of 2019 concerning the City Tourism Development Master Plan for 2019-2025 at Nunsui Oesapa Beach in an effort to increase the original income of the Kupang City area, namely legal implementation factors, facilities and infrastructure factors, land ownership factors, and lack of promotional factors.

Abstract

Although Law Number 6 of 2014 concerning Villages gives authority to the Village Head and Village Consultative Body to be able to form Village Regulations, in fact no Village Regulations have been produced. The objectives of this activity include: a) providing knowledge about aspects that need to be regulated in Village Regulations; b) providing knowledge about the process of forming Village Regulations; c) providing knowledge and skills to find and determine problems that can be regulated in a Village Regulation; and d) providing knowledge about the systematics, sentences and legal language in Village Regulations. This activity was carried out using the survey method, briefing and interactive question and answer/dialogue which were divided into two stages, namely the preparation stage and the implementation stage. This activity involved 40 participants consisting of the Village Head, Village Apparatus, Village Consultative Body (BPD), and the community. The training activity on Village Regulation drafting techniques in Penfui Timur Village is a solution for solving the problems faced. Through this activity, it is hoped that there will be an increase in knowledge and skills in drafting Village Regulations in Penfui Timur Village.

Abstract

Peraturan Desa, Peraturan Kepala Desa, dan Peraturan Bersama merupakan tiga perangkat hukum utama desa. Karena peraturan desa berfungsi sebagai landasan hukum untuk menyusun tata kelola pemerintahan desa, maka peraturan desa merupakan produk hukum yang paling tepat menggambarkan kemandirian desa di antara ketiganya. Peraturan Desa dimaksudkan untuk memenuhi kebutuhan masyarakat yang dinamis dan terus berubah, selain mengharuskan kepatuhan terhadap peraturan yang lebih ketat. Tujuan dari kegiatan ini adalah untuk membantu masyarakat Noelbaki lebih menghargai nilai partisipasi mereka dalam pembuatan undang-undang desa sehingga peraturan akhir lebih sesuai dengan kebutuhan mereka. Metode yang diterapkan dalam sosialisasi ini meliputi interaksi langsung, ceramah, serta diskusi atau dialog mendalam mengenai materi yang telah disampaikan. Selama sosialisasi, peserta menunjukkan antusiasme tinggi dengan aktif mengajukan pertanyaan kepada narasumber terkait materi yang mereka terima. Tujuan dari kegiatan ini adalah untuk meningkatkan pemahaman masyarakat terhadap proses pembuatan peraturan desa sesuai dengan Undang-Undang Nomor 6 Tahun 2014. Sebagai hasilnya, masyarakat lebih nyaman menyuarakan tujuan mereka dan memahami betapa pentingnya konsensus saat membuat peraturan desa. Masyarakat kini lebih sadar akan hak dan kewajiban mereka untuk ikut aktif dalam pembangunan desa, melalui materi yang disampaikan, seperti pembentukan peraturan desa sesuai Undang-Undang Nomor 6 Tahun 2014, peran serta dalam musyawarah desa, dan pentingnya kolaborasi antara pemerintah desa dan warga. Keterlibatan masyarakat dalam membuat peraturan desa meningkat sebagai hasil sosialisasi ini, tetapi kerja lanjutan masih diperlukan untuk menjamin keberlanjutan hasilnya.

Abstract

This study investigates the level of transparency in the management of Village Funds in 2022 in Mondu Village, East Sumba Regency, by referring to Permendagri Number 20 of 2018. Using empirical legal research methods and socio-legal approaches, it was found that although important documents such as the APBDes and RKPDes exist, information is still difficult to access because it is only available in physical form (such as notice boards and manual archives) without a digital platform. The Accountability Letter (SPJ) for Village Funds is inaccessible to the general public, and reliance on manual systems hinders community participation, especially from vulnerable groups. The results of the study indicate a gap between compliance with administrative regulations and the principle of true transparency, which is further exacerbated by the lack of technological infrastructure, low public understanding of the APBDes, and lack of socialization and active involvement. Structural problems such as unstable internet connections and lack of computer access further exacerbate accountability problems. Recommendations from this study include accelerating the digitalization of documents, strengthening technology-based village information systems, and increasing community capacity through more intensive socialization. These changes in governance are expected to increase public trust and encourage more inclusive village development by following the principles of good governance.
