Abstract

Micro, Small, and Medium Enterprises (MSMEs) play a crucial role in supporting regional economic growth, particularly in the aftermath of the COVID-19 pandemic. One concrete manifestation of governmental assistance is the implementation of Government Regulation Number 24 of 2018, which introduces the Online Single Submission (OSS) platform to streamline the licensing process, specifically in obtaining the Business Identification Number. Through OSS, the licensing procedure becomes more efficient, rapid, and transparent. The adoption of OSS aims not only to provide convenience for business entities but also to bolster investment in the MSME sector. It is recommended to enhance the comprehension of business stakeholders through additional training and awareness initiatives to fortify business legitimacy, foster MSME expansion, and generate positive effects on local economic development. The methods utilized for activity execution encompass lectures, discussions, and practical sessions, targeting micro, small, and medium-sized enterprises situated in Tawar Village, Mojokerto Regency. This endeavor has been effectively carried out, resulting in a notable increase in the successful registration of Business Identification Numbers (NIBs).

Abstract

This study aims to examine the principles of gender justice within the Islamic inheritance system, based on Surah An-Nisa’ verses 11-12, which stipulate a 2:1 ratio (a male receives two shares of the inheritance compared to a female). However, in the modern era, with changing times and human mindsets, as well as demands for equal rights, this 2:1 stipulation is considered a problem of justice. This research is normative juridical research, employing the library research method. The legal materials used include literature studies, such as interpretations of sacred texts, fiqh books, books, journals, previous research results, websites, and other writings related to the issues being studied. The results of this research indicate that justice refers to fair and equal treatment for every individual in accordance with the principles of the Qur'an and Hadith. However, in the context of Islamic inheritance distribution, challenges arise due to social and cultural changes that affect its interpretation and application. Although the principles of justice remain, there needs to be a renewal in the interpretation and implementation of Islamic law to reflect social and economic developments and to advocate for gender equality. This adaptation is not an effort to oppose culture or religion but a step towards a more just society for all individuals, regardless of gender. In making this adaptation, religious values and cultural traditions must be reinterpreted in accordance with the spirit of inclusivity and justice inherent in Islam, so that Islam remains a relevant moral and legal guide for its followers.

Abstract

This study aims This study seeks to reassess the jurisdiction of local governments in granting Environmental Impact Assessment (AMDAL) permits in light of legal amendments, specifically Law Number 6 of 2023 regarding the Ratification of Government Regulation replacing Law Number 2 of 2022 on Job Creation. The Indonesian government has enacted a policy of regional autonomy to delegate greater authority to local governments in managing affairs within their regions. Environmental management is a key focus of regional autonomy implementation. Effective environmental management is essential for ensuring sustainable development in Indonesia, which boasts plentiful natural resources. Law Number 32 of 2009 on Environmental Protection and Management provides the regulatory foundation for matters related to industrial elements, law enforcement, and community involvement. This research aims to enhance understanding of the effects of regulatory changes on regional autonomy in environmental management and to provide policy recommendations for maintaining the balance between environmental sustainability and local government empowerment.

Abstract

Keberadaan lembaga ekonomi syariah di Indonesia sangat penting untuk mendorong pertumbuhan ekonomi di negara ini, khususnya bagi para pelaku usaha kecil dan mikro. Lembaga keuangan syariah, yang mencakup sejumlah industri, termasuk perbankan, asuransi, dan koperasi Islam, beroperasi sesuai dengan prinsip-prinsip syariah. Lembaga keuangan syariah mengalami kesulitan karena, meskipun tujuannya adalah pembiayaan bebas riba, sejumlah operasi ekonomi syariah berpotensi menimbulkan risiko perselisihan, termasuk gagal bayar. Tantangan dalam penelitian ini adalah bagaimana menyelesaikan perselisihan dalam keuangan syariah di Indonesia. Penelitian ini merupakan penelitian normatif hukum. Tujuan dari penelitian ini adalah untuk mengkaji dan menentukan tindakan terbaik dalam skenario ekonomi syariah yang melibatkan keuangan syariah dan klien mereka. Menurut temuan penelitian ini, sengketa ekonomi syariah antara keuangan syariah dan klien mereka dapat diselesaikan melalui jalur litigasi Pengadilan Agama, yang mengutamakan nilai-nilai dan prinsip-prinsip syariah sebagaimana yang digariskan dalam Fatwa Dewan Syariah Nasional No. 04/DSN-MUI/IV/2000 tentang murabahah. Selain menempuh upaya non litigasi juga dapat melakukan upaya litigasi di pengadilan Agama untuk mengadili sengketa ekonomi syariah, sebagaimana diatur dalam “Pasal 49 Undang-Undang Nomor 3 Tahun 2006 juncto Undang-Undang Nomor 50 Tahun 2009 tentang Perubahan Kedua atas Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama,” dan putusan “Mahkamah Konstitusi Nomor 93/PUU-X/2012” yang menegaskan yurisdiksi peradilan agama dalam penyelesaian sengketa syariah melalui jalur litigasi, dengan tetap mengedepankan prinsip-prinsip syariah untuk memberikan kepastian hukum dan melindungi kepentingan semua pihak tanpa adanya pihak yang merasa dirugikan.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) play a crucial role in Indonesia's economy, yet they often face challenges in protecting their intellectual property rights (IPR), particularly trademarks. This study aims to analyze the effectiveness of legal protection for trademarks owned by MSMEs and identify the barriers they encounter. Employing a normative juridical approach combined with empirical research, data were collected through document analysis, interviews, and surveys involving MSME actors in Surabaya and Mojokerto. The results reveal that despite the existence of comprehensive IPR regulations, the effectiveness of trademark protection remains limited. Key obstacles include a lack of understanding among business actors, complex registration procedures, and insufficient legal literacy. Survey findings show that over 50% of respondents perceive inadequate knowledge as the main barrier to trademark protection, followed by procedural complexities. Although costs were less of a concern, many MSMEs still fail to register their trademarks, leaving them vulnerable to infringement. This study concludes that while Indonesia’s legal framework for IPR is well-established, its implementation requires significant improvement through enhanced education, streamlined procedures, and strengthened enforcement. Strengthening these aspects is essential to empower MSMEs, encourage innovation, and boost their competitiveness both domestically and internationally.

Abstract

Pinjaman online merupakan layanan keuangan berbasis teknologi (financial technology/fintech) yang memberikan kemudahan bagi masyarakat Kelurahan Babatan untuk mendapatkan akses pembiayaan secara daring dengan syarat yang relatif sederhana. Namun, tingginya minat terhadap layanan ini tidak diiringi dengan pemahaman yang memadai terkait legalitas penyedia jasa maupun risiko yang dihadapi, seperti konsekuensi hukum akibat keterlambatan pembayaran atau penyalahgunaan data pribadi. Banyak warga terjerat dalam pinjaman online ilegal karena kurangnya edukasi dan informasi terkait cara memilih layanan yang terpercaya. Situasi ini diperburuk oleh minimnya sosialisasi tentang hak-hak konsumen, sehingga masyarakat tidak mengetahui langkah hukum yang dapat ditempuh saat menghadapi intimidasi atau pelanggaran oleh pihak penyedia layanan ilegal. Untuk mengatasi permasalahan ini, dilakukan pendampingan interaktif kepada warga di wilayah RW 7 Perumahan Wisma Indah 2, Kelurahan Gunung Anyar Tambak, Kecamatan Gunung Anyar, Kota Surabaya, yang mencakup edukasi tentang aspek legalitas penyedia layanan, langkah hukum yang dapat diambil saat menjadi korban pinjaman ilegal, serta strategi menghindari jebakan layanan tidak sah. Pendampingan dilakukan melalui simulasi kasus, diskusi kelompok, dan penyampaian materi secara langsung untuk meningkatkan kesadaran dan pemahaman warga terhadap risiko serta manfaat layanan pinjaman online. Hasil kegiatan menunjukkan adanya peningkatan kemampuan masyarakat dalam mengenali penyedia layanan yang legal, memahami hak-hak mereka sebagai konsumen, dan menghindari praktik pinjaman ilegal yang dapat merugikan baik secara finansial maupun hukum

Abstract

This study seeks to examine the public accountability of business entities through the lens of consumer protection law, specifically addressing the types of legal liability that include criminal, civil, and administrative dimensions.  Consumer protection has emerged as a paramount concern due to the increasing intricacy of global trade, which poses numerous risks to consumers.  In this context, business entities are anticipated to behave responsibly concerning the products and/or services they provide in the marketplace.  The study utilises a normative legal methodology, incorporating statutory and conceptual frameworks.  The legal materials comprise primary sources, including statutory regulations, and secondary sources, such as legal literature and judicial rulings.  The results demonstrate that the responsibilities of business entities surpass contractual commitments and encompass ethical and societal obligations to guarantee the safety, comfort, and security of consumers.  Law No. 8 of 1999 on Consumer Protection explicitly mandates administrative, civil, and criminal penalties for infringements of consumer rights.  Consequently, the amalgamation of regulatory mechanisms, robust legal enforcement, and corporate ethical standards is crucial for the establishment of an equitable and sustainable consumer protection framework.
