Abstract

AbstrakKemajuan yang dicapai saat ini (pengetahuan, inovasi dan teknologi) menyebabkan perubahan mendasar terhadap pola hidup manusia. Kemajuan telah mencapai tingkat  adanya ketimpangan dalam mencapai keselarasan pelestarian lingkungan hidup. Persoalan timbulnya bencana kabut asap merupakan fakta yang membuktikan adanya ketimpangan tersebut.  Penelitian ini bertujuan untuk mengkaji perlindungan bagi organisasi lingkungan hidup yang mengalami bencana kabut asap. Metode pengkajian dengan menggunakan pendekatan perundang-undangan dan pendekatan empiris. Kajian pada penelitian ini mendapatkan syarat bagi organisasi lingkungan hidup dalam rangka mendapatkan hak gugat terhadap lingkungan yang mengalami bencana kabut asap merujuk pada Undang–Undang Republik Indonesia Nomor 32 Tahun 2009 tentang Perlindungan dan Pengendalian Lingkungan Hidup, tercantum pada Pasal 92 ayat (3). Hak gugat yang dimiliki tersebut berupa hak gugatan perdata, gugatan pidana dan gugatan administratif.

Abstract

The problem of domestic violence, hereinafter referred to as domestic violence, is actually a problem that often occurs in married life, but some people, especially in villages, do not consider what they experience as a wrong act in the eyes of the law. Therefore, the public needs to be given an understanding of domestic violence, so that if domestic violence occurs or experiences, the victim can take steps or resolve it legally according to Law Number 23 of 2004 concerning Domestic Violence. The aims of the Community Trial are (1) To provide an understanding of Law Number 23 of 2004 concerning Domestic Violence; (2) To provide an understanding of the forms of legal protection for victims of domestic violence that must be provided by the police; (3) To provide investigators with an understanding of penal mediation in criminal acts of domestic violence. This community service activity is motivated by phenomena that occur in society. This Community Service Activity (PPM) at the Faculty of Law, Sunan Bonang University, Tuban, was attended especially by residents of the Mulyoagung Village Government, numbering approximately 15 people. The activity was carried out at the Mulyoagung Village Hall, Singgahan District, Tuban Regency. carried out by means of socialization and/or providing education through the lecture method. The lecture method was used to explain increasing public awareness of domestic violence (KDRT) from a criminal law perspective in Indonesia on the basis of statutory regulations related to domestic violence and social agendas by distributing donations in the form of money to participants. Overall service activities can be said to be good and successful, seen from the success of the target number of training participants (100%), achievement of training objectives (75%), achievement of planned material targets (80%), and participants' ability to master the material (75%).

Abstract

The issuance of Minister of Trade Regulation Number 31 of 2023 concerning Business Licensing, Advertising, Guidance, and Supervision of Business Actors in Electronic Commerce is the Indonesian government's effort to regulate digital trading activities, including those conducted through social commerce platforms like TikTok Shop. This regulation aims to create a balanced trade ecosystem, ensure fair competition, and protect micro, small, and medium enterprises (MSMEs) in the midst of rapid technological advancements. However, the implementation of this regulation also raises challenges, particularly for MSME actors who rely on social commerce platforms as a marketplace. This paper aims to analyze the impact of the regulation on TikTok Shop and its implications for MSME development in Indonesia. The analysis is conducted by examining the content of the regulation and its effects on various stakeholders in the e-commerce ecosystem.

Abstract

The concept of cybernotary represents a transformative shift in the notary's role in the digital era, utilizing technology to enhance the efficiency and accessibility of legal services in Indonesia. While cyber notary holds potential for supporting the digitalization of notarial services and meeting the demands of modern society, its implementation in Indonesia encounters significant challenges, particularly in regulatory alignment and limited digital infrastructure. This study aims to provide a deeper understanding of how cyber notary supports the transformation of public services, making them faster, more efficient, and transparent, as well as to identify obstacles that must be overcome to achieve optimal implementation within state institutions. This research employs a qualitative approach, aimed at uncovering an in-depth understanding of e-Notarization's role in strengthening the digitalization process and enhancing the effectiveness of public services by state institutions. From a regulatory perspective, although there is a legal basis permitting electronic transactions, adequate technical and operational guidelines are still lacking to ensure smooth implementation. These challenges are particularly apparent in provisions requiring physical presence for the validation of signatures and fingerprints, which restrict the flexibility of notaries in serving the public digitally. As a result, these regulations constitute a principal barrier to the goals of cyber notary in delivering faster, more efficient, and more accessible legal services.

  ABSTRAK Berdasarkan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, lingkungan yang baik dan sehat adalah hak asasi manusia. Namun fenomena perubahan iklim mengakibatkan kondisi lingkungan yang cenderung merugikan masyarakat, seperti kekeringan, banjir, kualitas udara yang buruk dan kenaikan muka air laut. Petani padi menjadi salah satu aktor yang merasakan dampak perubahan iklim. Kerugian yang dirasakan akibat kenaikan suhu, perubahan pola curah hujan dan angin kencang adalah kegagalan panen. Penelitian ini bertujuan untuk mengetahui sejauh mana dampak perubahan iklim dirasakan petani dan bagaimana kebijakan daerah dapat menjamin tersedianya lingkungan yang baik agar panen padi masih dapat dinikmati petani. Hasil penelitian menunjukkan bahwa petani mengalami kesulitan mendapatkan akses informasi terkait prakiraan cuaca dan teknologi adaptif perubahan iklim. Di sisi lain, kebijakan daerah Kabupaten Tuban sejatinya telah mengatur perubahan iklim, namun terbatas pada pengendalian bencana alam, belum menyentuh dampak ekonomi petani akibat perubahan iklim. Beragam celah yang terdapat pada implementasi peraturan perundang-undangan khususnya di tingkat Kabupaten menyebabkan perlunya adanya Peratuan Bupati yang komprehensif mengatur tentang perubahan iklim. Mulai Rencana Aksi Daerah adaptasi perubahan iklim hingga pelaporannya dengan mempertimbangkan relevansinya dengan kebutuhan petani terdampak. Kata kunci: perubahan iklim; hak petani, hukum lingkungan. ABSTRACT Based on Law Number 32 of 2009 concerning Environmental Protection and Management, a good and healthy environment is a human right. However, the phenomenon of climate change results in environmental conditions that tend to be detrimental to society, such as drought, floods, poor air quality and rising sea levels. Rice farmers are one of the actors who feel the impact of climate change. The losses felt due to rising temperatures, changes in rainfall patterns and strong winds are crop failure. This research aims to find out to what extent the impact of climate change is felt by farmers and how regional policies can ensure the provision of a good environment so that farmers can still enjoy the rice harvest. The research results show that farmers have difficulty getting access to information related to weather forecasts and climate change adaptive technology. On the other hand, Tuban Regency's regional policy has actually regulated climate change, but is limited to controlling natural disasters, and has not yet touched on the economic impact on farmers caused by climate change. Various gaps in the implementation of laws and regulations, especially at the Regency level, have led to the need for special regulations, comprehensive Regent Regulations, that regulate climate change. Starting from the Regional Action Plan for climate change adaptation to its reporting by considering its relevance to the needs of affected farmers. Abstract

Child marriage remains a serious problem in Indonesia despite the revision of the Marriage Law, which raised the minimum age for marriage to 19 for both men and women through Law No. 16 of 2019. This practice remains widespread, especially in rural areas with a high prevalence due to economic and cultural factors, the existence of marriage dispensation mechanisms, and low legal literacy. The phenomenon of child marriage has multidimensional impacts, including reproductive health risks, high school dropout rates, low quality human resources, economic vulnerability, and psychological problems that can ultimately lead to high divorce rates and intergenerational structural poverty. Through Community Service Activities (PKM), prevention efforts are carried out by providing legal education and outreach regarding the risks of early marriage. Methods used include lectures, presentations, modeling, role plays, and small group discussions involving teenagers, parents, traditional leaders, and religious leaders. The results of the activities showed a significant increase in legal understanding, where 85% of participants were aware of the minimum age for marriage according to the latest regulations. Furthermore, there was increased awareness of the negative impacts of child marriage and a growing commitment from community leaders to continue ongoing outreach. The conclusion of this activity confirmed that marriage law education is an effective strategy in raising public awareness. However, preventing child marriage cannot rely solely on legal outreach; it needs to be strengthened through cross-sector collaboration, integration of materials into the school curriculum, family economic empowerment, and strengthening the role of religious and traditional leaders in shaping social opinion. Therefore, efforts to prevent early marriage require a more holistic, participatory, and sustainable strategy to protect children's rights and realize the development of a quality future generation.
