Abstract

This writing aims to enhance the understanding of the community, particularly students in Bolaang Mongondow, regarding the legal perspective on early marriage and the importance of safeguarding the fundamental rights of children by the constitution and prevailing legislation. The method of community service involves legal counselling in three different schools in Bolaang Mongondow over two days in October 2023. Lectures, discussions, and legal consultations provide comprehensive knowledge and understanding. The results and discussions indicate that this activity not only improves basic knowledge but also deepens the understanding of the adverse effects of early marriage on the physical, mental, and social development of children. Through understanding the concept of children's fundamental rights and relevant legislation, students in Bolaang Mongondow are expected to avoid early marriage and participate in positive transformation. The ultimate goal is to create a safer environment and protect children's rights in the North Sulawesi Province, hoping that the outcomes of this community service can serve as a foundation for more effective preventive and educational programs. ABSTRAK Tulisan ini bertujuan untuk meningkatkan pemahaman masyarakat, yaitu siswa di Bolaang Mongondow tentang perspektif hukum terhadap perkawinan dini serta pentingnya melindungi hak-hak asasi anak sesuai konstitusi dan peraturan perundangan-undangan yang berlaku. Metode pengabdian melibatkan penyuluhan hukum di empat sekolah berbeda di Bolaang Mongondow selama dua hari pada bulan Oktober 2023. Pendekatan ceramah, diskusi, dan konsultasi hukum digunakan untuk memberikan pengetahuan dan pemahaman yang komprehensif. Hasil dan pembahasan menunjukkan bahwa kegiatan ini tidak hanya meningkatkan pengetahuan dasar, tetapi juga memperdalam pemahaman dampak negatif perkawinan dini terhadap perkembangan fisik, mental, dan sosial anak. Melalui pemahaman konsep hak-hak asasi anak dan peraturan perundangan-undangan, siswa di Bolaang Mongondow diharapkan dapat menghindari praktik perkawinan dini dan ikut serta dalam transformasi positif. Tujuan akhirnya adalah menciptakan lingkungan yang lebih aman dan melindungi hak-hak anak di Provinsi Sulawesi Utara, dengan harapan hasil kegiatan pengabdian ini dapat menjadi landasan bagi program-program preventif dan edukatif yang lebih efektif di masa depan. Abstract

Interfaith marriages in people's lives have been practised in many areas in Indonesia, even if it's not legally registered. The rule of law in Indonesia does not accommodate interfaith marriages. When interfaith marriage happens, the registration system should follow marriage registration either at the KUA (office of religious affairs) for Muslims or in the Civil Registry office for other religions. This study aims to analyse the practice of interreligious marriage in Manado and how they maintain a good marital relationship between the spouse of different religions. This research employs a qualitative approach by collecting data through interviews with 30 informants who practice interfaith marriages in Manado. The results of this research found that many people in Manado consider interfaith marriage as permissible. They argue that religion is a relationship between humans and God, while marriage is related to human beings. The family of different religions based their relationship on the principle of "Torang Samua Basudara" (we are bound through kinship). Based on this principle, the family avoids using religious symbols in their communication that can cause tension and disrupt harmony among family members. The principle of torang samua basudara is the basis for establishing good communication in the family.

Abstract

This research explores the alignment and divergence of the principles of Mapalus with Islamic legal and ethical frameworks, contributing to the broader discourse on integrating local wisdom with Islamic values in multicultural societies. Mapalus, a communal tradition rooted in the Christian-majority Minahasan society, has been adopted by the Muslim minority by applying Maqāṣid Syarī’ah principles, particularly in community well-being, justice, and property protection. Through empirical data from interviews with religious leaders and community members, the study highlights how Islamic jurisprudence guides modifications to traditional Mapalus practices, ensuring compliance with religious obligations while preserving core cultural values. The research reveals that while Islamic values of justice, reciprocity, and mutual assistance align with Mapalus' cooperative ethos, certain rituals require adaptation or exclusion to adhere to Islamic law. This integration is facilitated by the involvement of religious leaders, who mediate potential conflicts and help maintain social harmony. The study concludes that Mapalus is a model for successfully integrating local wisdom with Islamic values in a multicultural context, demonstrating the flexibility of cultural practices and religious principles in fostering unity and cooperation across diverse communities.

Abstract

This study aims to analyze the legal protection of victims of domestic violence (KDRT) that occurs due to underage marriage in North Sulawesi through the perspective of Maqasid Sharia. The research method used is qualitative with a juridical-empirical approach, collecting data through in-depth interviews with victims of domestic violence, law enforcement officials, and religious leaders, as well as document analysis from related institutions. The results of the study show that the implementation of legal protection for victims of domestic violence in child marriage is still weak due to social stigma, lack of training of officials, and low public legal literacy. The Maqasid Sharia approach emphasizes the protection of individual souls, intellect, and honor as the main principles for handling domestic violence cases in child marriage. This study recommends increasing legal awareness, training on gender issues for officials, and strengthening cross-agency collaboration to create a more effective protection system. These findings are expected to enrich the literature and contribute to the development of policies for the protection of victims of domestic violence in Indonesia.
