Abstract

Authentic deeds have a very important position. This is because authentic deeds are recognized by law and have very strong evidentiary power. Often cases of identity forgery by the witness used in the making of authentic deeds are found, which have a serious impact and cause various problems. The notary is only in charge of recording the data and information provided by the witness, as is known, the notary does not have the authority to conduct a material and passive investigation of false information and identities by the witnesses, but often if the notary is dragged and held accountable in the event of a dispute. The purpose of this writing, in general, the author wants to develop legal knowledge in the field of notary law. The writing in this journal analyzes the responsibility of notaries for authentic deeds that use false identities and the efforts that can be made by notaries to prevent identity forgery in making authentic deeds. So that unwanted things do not happen to people in good faith and notaries. The method of approach used is a qualitative approach, a research method that focuses on a deep understanding of the phenomenon being studied through the interpretation of context and meaning. This approach tends to generate descriptive data in the form of words, imagery, or narratives, and focuses more on understanding how and why a phenomenon occurs rather than simply measuring its frequency or magnitude. The results of the study show that the responsibility of a notary in making authentic deeds can be seen from the negligence of the Notary in making authentic deeds, the negligence in question is if the notary has made a deed that is not in accordance with the existing rules or the notary consciously and deliberately makes a deed with the aim of benefiting himself or certain parties, then the notary can be held responsible, However, if the negligence that arises is not from the notary but from the witness, either intentionally or unrelated to the identity or false information provided by the witness which is used as the basis for making an authentic deed and makes the deed incorrect, then it becomes the responsibility of the parties themselves as it is known that the notary has no obligation and is passive in terms of materially investigating the information and or the identity submitted by the witness.

Abstract

The presidential threshold is considered to have no normative problems, but when viewed in practice, there are substantive problems. This is because the Presidential Threshold is the nomination threshold as stipulated in Article 222 of Law Number 7 Year 2017 concerning General Elections. This raises big questions about the General Election as a means of organizing democracy, because parties that do not have the number of seats as mentioned cannot propose a pair of candidates for President and Vice President so that it has the potential to limit democratic rights while in the 1945 Constitution of the Republic of Indonesia does not provide restrictions on each political party to propose a pair of candidates for President and Vice President as contained in Article 6A paragraph (2) of the 1945 Constitution of the Republic of Indonesia.

Abstract

In this case, the entertainment industry is an industrial sector that is very prone to the exploitation of children physically, socially, sexually, and economically. This is because children are recruited and employed on the basis of appearance, work excessively to the point of confiscating children's playing and learning for the material gain of their parents, and sometimes being put in the worst jobs resulting in sexual exploitation due to involvement in prostitution activities. However, there are many factors that make a child forced to work. Child labor is closely related to exploitation, very dangerous work, and hinders education and hinders physical development. This study aims to analyze how forms of legal protection arrangements can make child laborers avoid acts of exploitation, what are the factors that cause the entertainment industry to be prone to child exploitation, and how the government's efforts in tackling child labor in the entertainment industry sector are from acts of exploitation. This study uses the normative legal method or a statutory approach by reviewing all regulations and laws related to and related to the legal issue being studied. The results of this paper state that although there are a number of regulations protecting child labor, the tendency of child labor problems, especially in the entertainment industry sector, has developed in a complex manner towards the worst forms of exploitative work. Disharmonization of regulations and other government efforts related to the handling of child labor is also an influence. Therefore, various ways have been attempted by the government in overcoming this problem, but in fact, it is still not in accordance with what is expected.
