Abstract

The trade sector is one of the supports for the continuity of human life in increasing economic growth. The era of global trade is in line with international conventions that have been ratified by Indonesia so the role of brands is significant in maintaining healthy business competition. A brand becomes a marker that can be expected to produce economic value. Brands have an important role in describing a product's quality and commercial value, so it is necessary to apply for brand registration. However, according to the Directorate General of Intellectual Property (DJKI) of the Ministry of Law and Human Rights, there are still many MSME players who have not registered their brands, because MSME capital is still limited and there is a lack of understanding of the benefits of brand registration for the MSME industry. The observation method was used when searching for target partners, which in this activity was Kedai Geprek Mavera, an MSME in the culinary sector in the South Jakarta area. The activity was carried out in the form of socialization to MSME actors directly orally, covering the meaning of brand rights, the importance of registering a brand right, then the risks if the brand is not registered, as well as a simulation of registering the target partner's brand rights.

Abstract

This study analyzes the legal protection and responsibilities for interns in Indonesia, particularly regarding stipends and working hours based on Indonesian labor laws. The legal uncertainty surrounding the protection of interns opens the potential for exploitation, an issue that has not been widely discussed in previous studies, especially in comparison with the legal system in Australia. Employing a normative juridical study method and a comparative analysis with the Australian legal system, this study reveals a significant gap between existing regulations and practices in the fields. This comparative approach provides a new perspective in building a more progressive legal framework to protect interns in Indonesia. The study findings highlight a substantial disparity between existing regulations and practical implementation regarding the protection of interns. Ambiguities in the regulations create loopholes for unfair practices, such as excessive working hours and inadequate wages for interns. Therefore, this study urges comprehensive legal reforms to promote fairer labor practices, improve welfare, and ensure justice for all interns. Key issues discussed include the lack of clear guidelines, inconsistent implementation regarding stipend calculations, and the flexibility of working hours, which opens up opportunities for intern exploitation. The study concludes that legal updates, especially in labor laws, are necessary, including specific provisions on work hour limits and minimum stipend standards to ensure adequate protection for interns and promote fair and decent work practices. Penelitian ini menganalisis perlindungan hukum dan tanggung jawab bagi pekerja magang di Indonesia, khususnya terkait uang saku dan jam kerja berdasarkan undang-undang ketenagakerjaan Indonesia. Ketidakpastian hukum mengenai perlindungan pekerja magang, membuka potensi eksploitasi yang belum banyak dibahas dalam penelitian sebelumnya, khususnya dalam perbandingan dengan sistem hukum di Australia. Menggunakan metode penelitian hukum yuridis normatif dan perbandingan dengan sistem hukum Australia, penelitian ini mengungkap adanya celah signifikan antara regulasi yang ada dengan praktik di lapangan. Pendekatan perbandingan ini memberikan perspektif baru dalam membangun kerangka hukum yang lebih progresif untuk melindungi pekerja magang di Indonesia. Hasil penelitian mengungkapkan adanya kesenjangan signifikan antara regulasi yang ada dengan praktik di lapangan. Ketidakjelasan dalam peraturan menciptakan celah bagi praktik-praktik yang tidak adil, seperti jam kerja yang berlebihan dan upah yang tidak layak bagi pekerja magang. Penelitian ini mendesak adanya reformasi hukum yang komprehensif untuk mendorong praktik ketenagakerjaan yang lebih adil, meningkatkan kesejahteraan, serta mewujudkan keadilan bagi seluruh pekerja magang. Isu utama yang dibahas termasuk peraturan mengenai tidak adanya pedoman yang jelas serta penerapan yang tidak konsisten mengenai perhitungan uang saku, dan fleksibilitas jam kerja yang sering kali tidak jelas menyebabkan terbukanya peluang eksploitasi bagi tenaga kerja magang. Penelitian ini menyimpulkan bahwa diperlukan adanya pembaharuan hukum terlebih pada undang-undang ketenagakerjaan yang mencakup ketentuan spesifik tentang batasan jam kerja dan standar minimal uang saku guna memastikan perlindungan yang memadai bagi pekerja magang dan mendorong penerapan praktik kerja yang adil dan layak.
