Abstract

The Judicial Commission is an institution that was born as a result of demands for reform of the judiciary in Indonesia. The existence of the KY is not only limited to what is contained in the constitutional mandate, but is an external institution that has duties related to judicial oversight. More than that, the KY has a role in carrying out the function of checks and balances so that in the judicial power conditions can be created that are balanced, independent and free. Along his journey, KY experienced twists and turns. For example, the resistance of Supreme Court justices as externally supervised subjects, adjudication efforts at the Constitutional Court which weaken the role of the Judicial Commission as an external institution, and the authority to appoint and appoint Supreme Court judges, has made the Judicial Commission farther and farther away from realizing a clean and noble judiciary within the judiciary. The method used in this study is normative juridical with a statutory approach, a conceptual approach, and a case approach. The resulting conclusion is that through the reconstruction of the KY's authority, it is hoped that proposals for the appointment of constitutional judges can be based more on clear and transparent criteria and procedures, as well as taking into account the integrity and competence of prospective constitutional judges. In addition, to realize this, it is necessary to amend the 1945 Constitution of the Republic of Indonesia by amending the provisions of Article 24B paragraph (1) and Article 24C paragraph (3). These changes extend to laws, such as the Constitutional Court Law, the Supreme Court Law, and the Judicial Commission Law.

Abstract

Since the publication of UU Cipta Kerja, the element of community involvement in the preparation of AMDAL, which is the guidance of corporations in managing the environment, has become narrower. This research aims to analyze the role of the community in preparing AMDAL after the enactment of UU Cipta Kerja and to analyze the environmental impact of companies on fulfilling community rights after the enactment of UU Cipta Kerja. This research uses normative juridical research methods and a statutory approach as well as a conceptual approach. The lack of community involvement in the preparation of AMDAL actually harms human rights because the Indonesian constitution and laws and regulations guarantee that everyone can express opinions, has the right to a healthy living environment, and has the right to be included in policy decision making. The enactment of UU Cipta Kerja itself resulted in a restructuring of AMDAL arrangements which made it easier for business actors and paid less attention to environmental policies and their impact on society.

Abstract

Abstract The existence of a Thrifting Import Shop business is getting stronger in Indonesia. Based on data submitted by the Central Statistics Agency, imports of used clothing experienced an increasing trend in 2022 with a percentage of 26.22 percent and the value of imports of $ 272,146 from the previous year. Whereas this business accords with the Regulation of the Minister of Trade of the Republic of Indonesia Number 40 of 2022 concerning Amendments to the Regulation of the Minister of Trade Number 18 of 2021 concerning Goods Prohibited Exports and goods are prohibited from imports are illegal business activities. Therefore, the urgency and concept of the elimination of the import of imports shops as a form of law enforcement efforts for the Minister of Trade Regulation of the Republic of Indonesia Number 40 of 2022 concerning Amendments to the Regulation of the Minister of Trade Number 18 of 2021 concerning goods prohibited from exports and goods are prohibited from imports into problems that will be discussed in the study This. The purpose of the study is to analyze the urgency and concept of elimination of the import of import shops in Indonesia. The research method used is normative juridical with statute, conceptual, and comparative approaches. The results of the analysis from this study indicate that the elimination of the import of imports indeed needs to be done because it has a negative impact as issues of environmental damage, human health, threatening the existence of MSMEs, and harming the country through the loss of tax income. In addition, the elimination of the import of import shop business also aims to protect domestic textile workers. The concept of eliminating the business Thrifting Import Shop is to implement a policy of providing business subsidies. Also, this can be a win-win solution for law enforcement, and people who have been entrepreneurs in the field of thrifting imports do not lose their livelihoods and still earn income. It can even develop its business.Abstrak Eksistensi usaha thrifting impor shop semakin menguat di Indonesia. Berdasarkan data yang disampaikan oleh Badan Pusat Statistik, impor pakaian bekas mengalami tren kenaikan pada tahun 2022 dengan persentase 26,22 persen dan nilai impor $272.146 dari tahun sebelumnya. Padahal usaha ini menurut Peraturan Menteri Perdagangan Republik Indonesia Nomor 40 Tahun 2022 tentang Perubahan atas Peraturan Menteri Perdagangan Nomor 18 Tahun 2021 tentang Barang Dilarang Ekspor dan Barang Dilarang Impor merupakan kegiatan usaha yang ilegal. Oleh karena itu urgensi dan konsep penghapusan usaha thrifting impor shop sebagai bentuk upaya penegakan hukum Peraturan Menteri Perdagangan Republik Indonesia Nomor 40 Tahun 2022 tentang Perubahan atas Peraturan Menteri Perdagangan Nomor 18 Tahun 2021 tentang Barang Dilarang Ekspor dan Barang Dilarang Impor menjadi permasalahan yang akan dibahas dalam penelitian ini. Tujuan dari penelitian ini adalah untuk menganalisis urgensi dan konsep penghapusan usaha thrifting impor shop di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan komparatif. Hasil analisis dari penelitian ini menunjukkan bahwa penghapusan usaha thrifting impor shop memang perlu dilakukan karena memiliki dampak negatif seperti isu tentang kerusakan lingkungan, kesehatan manusia, mengancam keberadaan UMKM, dan merugikan negara melalui hilangnya pendapatan pajak. Selain itu, penghapusan usaha thrifting impor shop ini juga bertujuan untuk melindungi pekerja tekstil dalam negeri. Adapun konsep penghapusan usaha thrifting impor shop adalah dengan memberlakukan kebijakan pemberian subsidi usaha. Hal ini juga dapat menjadi win-win solution di mana hukum dapat ditegakkan dan masyarakat yang telah berwirausaha di bidang thrifting impor shop tidak kehilangan mata pencahariannya dan tetap mendapat penghasilan. Bahkan juga dapat mengembangkan usahanya.

Abstract

The trade sector is one of the supports for the continuity of human life in increasing economic growth. The era of global trade is in line with international conventions that have been ratified by Indonesia so the role of brands is significant in maintaining healthy business competition. A brand becomes a marker that can be expected to produce economic value. Brands have an important role in describing a product's quality and commercial value, so it is necessary to apply for brand registration. However, according to the Directorate General of Intellectual Property (DJKI) of the Ministry of Law and Human Rights, there are still many MSME players who have not registered their brands, because MSME capital is still limited and there is a lack of understanding of the benefits of brand registration for the MSME industry. The observation method was used when searching for target partners, which in this activity was Kedai Geprek Mavera, an MSME in the culinary sector in the South Jakarta area. The activity was carried out in the form of socialization to MSME actors directly orally, covering the meaning of brand rights, the importance of registering a brand right, then the risks if the brand is not registered, as well as a simulation of registering the target partner's brand rights.

Abstract

This study aims to analyze the regulation of secondary meaning and the formulation of proving secondary meaning within the trademark legal regime in Indonesia. The research employs a normative juridical method, supported by statutes, conceptual, and comparative approaches. The data used in this study consist of legal instruments such as Law Number 20 of 2016 concerning Trademarks and Geographical Indications, the TRIPs Agreement, the US Lanham Act, and Trademark Law. The results of this study indicate that Indonesia has not yet accommodated the regulation of secondary meaning in Law Number 20 of 2016 concerning Trademarks and Geographical Indications. In practice, there is no clear standard to determine whether a descriptive mark has acquired secondary meaning, which leads to case-by-case proof. It contrasts countries such as the United States and Thailand, which are provisions for proving secondary meaning. The absence of a provision for proving secondary meaning creates a legal vacuum when trademark infringement disputes arise. Therefore, there is a need for legal reform to regulate the proof of secondary meaning in trademark cases. A formulation for proving secondary meaning could be incorporated into Article 76 of Law 20/2016, which addresses trademark cancellation, by providing an exception for trademarks that have established secondary meaning through consumer association. Alternatively, the proof of secondary meaning could be considered during the substantive examination of trademark registration.

Abstract

The study is intended at exploring and identifying in depth how different factors influence the level of compliance with tax obligations. To obtain representative data, a random sampling method was applied, and 100 respondents were selected to participate. Data collected from respondents was then analyzed using double linear regression techniques, which allowed researchers to measure and assess the relationship between each factor studied and compliance with tax obligations in a comprehensive manner. Specifically, high awareness of tax liability contributes greatly to increased tax compliance. In addition, in-depth knowledge of tax regulations also plays an important role in determining how obedient a person is in fulfilling his or her tax obligations. The quality of tax authorities also plays a role in improving compliance, with good service inclining to inspire taxpayers to comply more. Moreover, implementation of rigorous and consistent tax sanctions has also been shown to improve compliance with tax obligations. In other words, this study provides evidence that awareness of tax obligations, a good understanding of tax regulations, adequate quality of service from tax authorities, effective enforcement of sanctions, and individual motivation play an important role in improving tax compliance. These findings confirm the importance of focusing on these and provide valuable insights for future tax policies. Abstract

The growth of the Indonesian cosmetics industry reached 21.9% with details of 913 companies in 2022 and 1,010 companies in mid-2023. This encourages business actors to compete so that a series of innovations and advertising strategies are carried out in order to attract consumers' attention. However, in the advertising process, business actors sometimes overclaim the contents of their products. On the other hand, the existence of this overclaim is not accompanied by consumer knowledge of the contents of a beauty product. This study examines in more depth the role of law in protecting consumers and the legal responsibility of skincare owners as business actors for overclaiming their beauty products. The research method used is juridical-normative with a statutory regulatory approach and a conceptual approach. The results of this study indicate that the role of law in protecting consumers against overclaims in product marketing has been accommodated in Indonesian national law starting from UUPK to BPOM-level regulations. Regarding legal accountability, it is mandatory for business actors as regulated in the UUPK and BPOM Regulation Number 3 of 2022.

Abstract

Stunting is a chronic malnutrition problem caused by inadequate nutritional intake over a long period of time, resulting in impaired optimal physical and cognitive development. The problem of stunting and malnutrition requires coordination between various parties to overcome it. In Agam Regency, especially Nagari Kamang Hilia, the stunting rate is still relatively high, with a prevalence of 24.6%, according to the latest Indonesian Nutrition Status Survey (SSGI). One of the factors influencing this is the high cost of nutritious food, which reduces the interest of mothers in serving healthy menus for the family. Therefore, education and training on nutritious food processing with alternative food sources is needed to increase public understanding. This program targets posyandu cadres and PKK mothers as the main targets, with the aim of providing knowledge about the importance of fulfilling nutrition to prevent stunting and malnutrition. The results of this activity are expected to increase awareness and interest of mothers in processing nutritious food that is attractive and liked by families, especially children.

Abstract

Motivasi dari setiap penderita berkaitan dengan efikasi diri yang dimiliki oleh penderita tersebut. Tingkat motivasi pada penderita diabetes mellitus tipe II yang rendah dapat mempengaruhi efikasi diri penderita, sehingga manajemen perawatan diri penderita diabetes mellitus tidak dapat berjalan dengan baik. Tujuan penelitian ini adalah untuk mengetahui hubungan motivasi dengan efikasi diri pada penderita diabetes mellitus di Desa Tarai Bangun Wilayah Kerja UPT Puskesmas Tambang Tahun 2023. Jenis penelitian adalah penelitian kuantitatif dengan desain cross sectional. Penelitian dilakukan pada tanggal 12- 24 Oktober 2023 dengan jumlah sampel 99 orang penderita diabetes mellitus tipe II menggunakan teknik total sampling. Pengumpulan data menggunakan kuesioner. Analisa data yang digunakan adalah analisa univariat dan bivariat dengan uji Chi Square. Hasil analisa univariat diperoleh 53 responden (53,5%) memiliki motivasi kurang baik dan 53 responden (53,5%) efikasi diri kurang. Hasil uji Chi Square menunjukkan ada hubungan motivasi dengan efikasi diri pada penderita diabetes mellitus (p value = 0,001). Kesimpulan terdapat hubungan yang signifikan antara motivasi dengan efikasi diri pada penderita diabetes mellitus tipe II di Desa Tarai Bangun Wilayah Kerja UPT Puskesmas Tambang Tahun 2023. Diharapkan penderita dapat meningkatkan efikasi diri dengan cara menambah informasi akan pengetahuan dalam melakukan perawatan diri, sehingga manajamen perawatan diri dapat berjalan dengan baik, terutama informasi terkait penyakit diabetes mellitus dari media sosial maupun sumber informasi lainnya, mempertahankan pola makan sehat, olahraga dan monitoring gula darah secara berkala.
