Abstract

The purposes of this research are 1) to know and analyze the law enforcement for hate speech against religions and denominations in Indonesia, 2) to know and analyze the factors which influence the law enforcement for hate speech against religions and denominations in Indonesia. The research used an empirical method that reviewed the processing and functioning of law in society, specifically analyzing the law enforcement for hate speech against religions and denominations in Makassar, Polrestabes, and Pengadilan Negeri Makassar. The result of this research shows that the law enforcement for hate speech against religions and denominations in Indonesia is still ineffective, with numerous instances of hate speech occurring without any affirmative action from law enforcement agencies. Additionally, the police have been unsuccessful in enforcing the law against hate speech, and there is a lack of regulations governing hate speech against religions and denominations. The society's black-and-white mindset, which separates religious affairs from state affairs, also contributes to this issue. The recommendations are, 1) the apparatus must have an active role to get through the spread of hate speech against religions and denominations, in particular under Circular No SE/ 06 / X /2015 about handling hate speech as a procedure, 2) construct particular rules about speech and preaching involving religion and denominations, 3) create particular rules for hate speech against religions and denominations to determine any hate speech that will be determined.

Abstract

Kejahatan penodaan agama dipandang dari sudut kebebasan berekspresi dan kebebasan berpendapat. Demokratisasi yang telah melewati batas privat dalam diri setiap individu telah menjadikan penistaan agama sebagai sebuah dilema antara kebebasan berpendapat dan tindak pidana. Penelitian ini dilakukan dengan tujuan: (1) Menganalisis dan menjelaskan penerapan peraturan hukum dan undang-undang terkait penodaan agama melalui media sosial. (2) Menganalisis dan menjelaskan faktor-faktor yang mempengaruhi terjadinya penodaan agama melalui media sosial. Penelitian ini menggunakan metode penelitian hukum empiris, bertujuan untuk mengungkap fakta-fakta lapangan yang terjadi di masyarakat. Lokasi penelitian mencakup media sosial dan Polrestabes Kota Makassar. Data yang dikumpulkan terdiri dari data primer berupa hasil observasi langsung di lapangan, serta data sekunder berupa dokumen dan jurnal-jurnal ilmiah. Data tersebut dianalisis menggunakan metode kualitatif dan disajikan dalam bentuk deskripsi. Hasil penelitian menunjukkan bahwa penerapan pasal 4 Penetapan Presiden Republik Indonesia Nomor 1/PNPS 1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama sebagai aturan umum, serta Pasal 28 Ayat 2 Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik sebagai aturan khusus, telah dilaksanakan oleh penegak hukum. Tujuannya adalah untuk menciptakan sarana publik yang mempromosikan toleransi antar umat beragama berdasarkan Pancasila sebagai konstitusi negara secara serius dan bertahap.Disarankan agar pemerintah melakukan pengawasan ketat terhadap penggunaan teknologi informasi. Langkah ini bertujuan untuk mencegah dan menanggulangi tindakan penistaan agama melalui media online secara efisien dan efektif. Selain itu, penting untuk meningkatkan pemahaman dan kesadaran masyarakat tentang pentingnya berpikir dan berekspresi dengan baik dan benar. Pengawasan yang ketat dan edukasi yang tepat, diharapkan dapat mengurangi penodaan agama di media sosial dan menjaga kerukunan antar umat beragama di Indonesia.

Abstract

This study aims to analyze the process of evidence against the crime of narcotics synthetic Tobacco species regulated in Article 114 and Article 112 of law no. 35 Of 2009 On Narcotics. The research method used is normative legal research, which examines and interprets relevant legal regulations, legal documents, and legal doctrines in the context of evidence against synthetic tobacco narcotics crimes. This research is the latest research because there is no scientific work such as dissertation, thesis, thesis, national or International Journal that specifically discusses the evidence against synthetic Tobacco narcotics crimes under Article 114 and Article 112 of law no. 35 Of 2009 On Narcotics. The results showed that the legal qualification against synthetic Tobacco narcotics offense, as stipulated in Article 112 paragraph (2) and Article 114 paragraph (2) of law no. 35 of 2009 on narcotics, found a legal vacuum because synthetic tobacco is not clearly included in the classification of Narcotics Group I both derived from plants and non-plants, due to differences in sources, manufacturing processes, chemical composition, and effects on users. Regulations such as Kepmenkes No. 246 / Menkes/SK / 2017 on narcotics, ago guidelines No. 18 of 2021, and Perkap No. 6 of 2019 concerning the investigation of criminal offenses does not provide clarity regarding the classification of synthetic tobacco as Class I narcotics. In the aspect of criminal evidence against synthetic Tobacco narcotics, the evidence is carried out in a similar way to natural marijuana, which is a narcotic plant type i, where the entirety of synthetic tobacco is weighed, causing ambiguity in law enforcement.

Abstract

When wells are produced continuously, the reservoir pressure will continue to decrease resulting in decreased production performance from the well. To optimally increase the rate of production, optimization is carried out using an Artificial Lift Electrical Submersible Pump. Based on data from the journal, "MFR-21" well had previously been installed Electrical Submersible Pump but was no longer functioning due to the condition of ESP pump not running or dead due to damage, so the author's goal is to optimize the pump and predict the condition of the well in the future until when the pump is no longer optimal by using Wiggins 3 Phase IPR and carrying out a scenario of decreasing reservoir pressure to predict the Future IPR "MFR-21" well. The results of 3 Phase Wiggins IPR curve analysis obtained a total production rate (Qt/Qmax) 6257 bfpd. Obtained a target production rate of 5005.6 bfpd it is recommended to use the ESP design with the Centrilift GC-8200 pump which has a production recommendation 4400 – 10000 bfpd with a number of stages 168, Horse Power 281 HP, and pump efficiency 69%. As well as using the Future IPR method to reduce 3 reservoir pressures, namely 1750, 1000, 500. When the reservoir pressure reaches 1000 and 500 psia the pump is no longer optimum because the target Q at reservoir pressure is not included in the pump production recommendations. So at reservoir pressure 1000 and 500 psia it is necessary to re-optimize the pump again according to the condition of well.

Abstract

This study aims to find out and analyze how law enforcement against child fighting crimes that result in death and to find out and analyze what causes law enforcement to criminal acts of child fights that result in death. This study uses empirical normative research methods. The results of this study indicate that various law enforcement efforts have been carried out by the Takalar Resort Police apparatus in preventing and eradicating the Crime of Child Fights That Cause Death, starting from preventive and repressive efforts and as for the causes of inhibition of law enforcement against the Crime of Child Fights that Cause Death at the Resort. Takalar Police can be seen from three aspects, namely; components of structure, legal substance and legal culture. The recommendations of this research are expected to parents especially those with teenage children to be more familiar with the association and environment in which children interact on a daily basis. Parents must control their children more at least by maintaining worship and providing understanding about religion to children from an early age and socializing to avoid evil deeds and it is hoped that law enforcers, especially Takalar Resort officers must be more active in conducting patrols and raids in places which is prone to crime, the police and local government should conduct socialization more often in an environment that is prone to brawls, especially socialization to children because children are very vulnerable to bad associations. AbstrakPenelitian ini bertujuan untuk mengetahui dan menganalisis bagaimana penegakan hukum terhadap tindak pidana perkelahian anak yang mengakibatkan kematian serta unyukmengetahui dan menganalisi apa sebab penghambat penegakan hukum terhadap tindak pidana perkelahian anak yang mengakibatkan kematian. Penelitian ini menggunakan metode penelitian normatif empiris. Hasil penelitian ini menunjukkan bahwa berbagai upaya penegakan hukum telah dilakukan oleh aparat Resort Polres Takalar dalam mencegah dan memberantas Tindak Pidana Perkelahian Anak yang Mengakibatkan Kematian mulai dari upaya preventif maupun upaya represif dan adapun sebab penghambat penegakan hukum Terhadap Tindak Pidana Perkelahian Anak yang Mengakibatkan Kematian di Resort Polres Takalar dapat dilihat dari tiga aspek yaitu; komponen struktur, subtansi hukum dan budaya hukum. Rekomendasi penelitian ini adalah diharapkan kepada orangtua terkhusus yang memiliki anak remaja agar lebih memperhatikan pergaulan dan lingkungan dimana anak berinteraksi sehari-hari. Para orang tua harus lebih mengontrol lagi anak mereka setidaknya dengan menjaga ibadah dan memberikan pemahaman tentang agama kepada anak sedari dini dan diberikan batasan pergaulan untuk menghindari anak dari perbuatan jahat serta diharapkan kepada penegak hukum khususnya aparat Resort Polres Takalar harus lebih giat lagi melakukan patroli dan razia di tempat-tempat yang rawan terjadi suatu kriminalitas, pihak kepolisian serta pemerintahan setempat harus lebih sering lagi melakukan sosialisasi di lingkungan yang rawan terjadi tawuran, khususnya sosialisasi kepada anak karena anak sangat rentan terbawa ke pergaulan yang buruk.

Abstract

This study aims to determine and analyze the government's prevention and control efforts against criminal acts of exploitation of street children at intersections on behalf of beggars and applicable legal regulations related to criminal acts of exploitation of street children at intersections on behalf of beggars. Empirical legal research method. The results of this study indicate that, ) Knowing and analyzing the applicable legal effort regulations related to the criminal act of exploitation of street children at intersections on behalf of beggars. In accordance with the results of the author's research, the government's prevention and control efforts against criminal acts of exploitation of street children at intersections on behalf of beggars, Knowing and analyzing the government's prevention and control efforts against criminal acts of exploitation of street children at intersections on behalf of beggars. Suggestions from the author for the future, Concrete steps are needed to strengthen local regulations governing the exploitation of street children in Parepare City. The local government needs to immediately establish a specific local regulation to protect street children. In addition, it is important to provide adequate shelter facilities for street children after being disciplined, and improve coordination between institutions such as SATPOL-PP, PKSAI, and social rehabilitation centers to provide more effective reintegration and rehabilitation services.

Abstract

This research aims to analyze the process of criminalizing children and actions against delinquent children at the Maros District Court, as well as the obstacles faced in its implementation. The research method used was qualitative with interview and documentation techniques at the Maros District Court and the Maros Class II State Detention Center. The research results reveal that the implementation of Law no. 11 of 2012 Juncto Law no. 3 of 1979 concerning the Juvenile Court in Maros Prison has considered the statements of witnesses and victims in the criminal sentencing process. Punishment is generally imposed on children who commit crimes, except serious crimes, by considering negotiations and alternative sanctions. This opinion is generally held by juvenile court judges and greatly influences decision making. As a country that is legally bound by the UN Convention on the Rights of the Child, Indonesia is obliged to protect children who are in conflict with the law. Law no. 11 of 2012 Juncto Law no. 3 of 1979 concerning Children's Courts is expected to be a control in law enforcement that protects children's rights.

Abstract

Lime (Citrus aurantifolia Swingle) is one of the plants that can be used as traditional medicine. Parts of the lime plant that can be used as traditional medicine include the fruit, leaves, and peel. Lime peel waste is known to contain chemical compounds and as a raw material for medicine, standardization is needed to ensure its quality. The 70% ethanol extract of lime peel was made using the maceration extraction method. This study aimed to standardize both simplicia and 70% ethanol extract of lime (Citrus aurantifolia Swingle) peel according to the Indonesian Herbal Pharmacopoeia (2017) guidelines to ensure quality for pharmaceutical raw material applications.Lime peel was processed into simplicia and extracted using maceration with 70% ethanol. Standardization was performed on both simplicia and extract based on specific (organoleptic, phytochemical screening) and non-specific parameters (drying loss, water content, total ash, acid-insoluble ash, ethanol-soluble extract, water-soluble extract, and specific gravity). All analyses were performed in triplicate (n = 3) and statistical significance was tested using SPSS version 26 with a confidence level of 95% (p < 0.05).Both simplicia and extract met the pharmacopoeial requirements and can be recommended as standardized raw materials for herbal pharmaceutical formulations. These findings provide a reference for the quality control of herbal raw materials and promote sustainable utilization of lime peel waste.
