Abstract

The phenomenon of non-Muslim leaders in Indonesia has given pros and cons in society. Those pros and cons do not only appear among the general public but also appear among students. This study analyzes the views of Muslim students at ‘Aisyiyah University Yogyakarta (UNISA) about the phenomenon of non-Muslim leaders in Indonesia. This research became important considering the last two issues that have emerged in the study of Islam in Indonesia, namely religious intolerance and moderation in few years. The type of this research is mixed qualitative-quantitative field research. The research findings show that there are two kinds of views of UNISA Muslim students about non-Muslim leaders; First, Muslim students who disagree about non-Muslim leaders. They argue that choosing a leader must be based on his/her religion first. This group believed that Islam is the main non-negotiable requirement for someone who wants to run for a leader. Some of them even firmly stated that choosing a non-Muslim leader is categorized as haram. Second, Muslim students agree and do not object to the existence of non-Muslim leaders. The second group believed that religion is not an absolute issue as the requirement for a person who wants to become a leader. This second group argues that track records are more important than religion or ethnicity. The educational background of students also influences their views. Students with religious education backgrounds tend to be more accepting of differences. On the other hand, students who have a general educational background tend not to easily accept differences. Therefore, it can be concluded that the better a person understands religion, the more tolerant of differences he/she will be.

Abstract

Artikel ini membahas tentang perceraian di kalangan Aparatur Sipil Negara (ASN) yang masih marak terjadi. Padahal sudah banyak anggaran serta peraturan pemerintah yang bertujuan untuk harmonisasi rumah tangga para ASN. Abdi negara dituntut untuk disiplin dan mampu menunjukkan prestasi kerja, di sisi lain juga berkewajiban menjaga keutuhan rumah tangganya. Penelitian ini termasuk penelitian normatif yang datanya diperoleh dari Pengadilan Agama Kelas I Lampung yang meliputi Pengadilan Agama Tanjungkarang dan Pengadilan Agama Metro. Artikel ini menyimpulkan faktor penyebab perceraian adalah faktor internal dan eksternal. Penyebab perceraian ASN di Pengadilan Agama Tanjungkarang dan Metro adalah faktor perselisihan dalam rumah tangga serta faktor ekonomi. Meski berprofesi sebagai ASN, dianggap belum mampu mencukupi kebutuhan rumah tangga. Dalam konteks hukum Islam, perceraian boleh dilakukan apabila perkawinan diteruskan akan menimbulkan mafsadah bagi keduanya, karena sudah tidak ada keharmonisan antara suami istri. Sedangkan dalam hukum positif faktor tersebut boleh menjadi alasan untuk bercerai.

Abstract

This article is about legal verses related to the noble status of women. So far, some people still think that the status of women is not as special as that of men. Such an assumption has a serious impact on gender inequality in the household, women are often positioned as officers who play a role in "wells, kitchens and mattresses". Whereas in the Qur'an the position of men and women in the family sphere has the same degree, has the same rights and obligations, has the same dignity. The focus of this article is to find the verses of women's law and their actualization of gender justice in the family. This type of article is library research (literary research), using a qualitative approach with discriminatory-analytic analysis, this article explains the verses about the glory of women in Islam. From several stories in the Koran, especially verses about the glory of women. It can be said that Islam came to proclaim the humanity of women as whole human beings. Women are noble beings who have dignity and worth. Islam asserts that all humans (male and female) are created from the same element (nafs wahidah). Islam is very strict about placing women as equal partners to men, including in the family.

Abstract

As part of reformation outcomes, the substitute heir in Islamic inheritance law has been long heeded by Indonesian jurists. However, amidst the facet of the traditional scheme, Indonesian Religious Court judges (judex factie) have not shared the same implementation of this succession. This article endeavors to examine the practice of substitute heir in the field. Relies on the Religious Court decisions as the primary source, this article argues that the norm of substitute heir (Article 185 of The Compilation of Islamic Law) has been implemented restrictedly according to The Compilation and the Supreme Court consensus. Restricted interpretation means the descendants of the pre-deceased side-relative was not accounted as substitute heir. It implies that the state reformation attempt in Islamic inheritance law has not come into play in the way the state desires.[Sebagai bagian dari hasil reformasi, substitute heir dalam hukum waris Islam telah lama diperhatikan oleh para ahli hukum Indonesia. Namun, di tengah sisi skema tradisional, hakim Pengadilan Agama Indonesia (judex factie) belum memiliki kesamaan pelaksanaan suksesi ini. Artikel ini mencoba mengkaji praktek penerapan substitute heir di lapangan. Berpijak pada putusan Pengadilan Agama sebagai sumber data utama, artikel ini berargumen bahwa norma ahli waris pengganti (Pasal 185 Kompilasi Hukum Islam) telah dilaksanakan secara terbatas menurut Kompilasi dan konsensus Mahkamah Agung. Penafsiran terbatas berarti keturunan dari kerabat menyamping yang telah meninggal dunia terlebih dahulu tidak diperhitungkan sebagai ahli waris pengganti. Ini menyiratkan bahwa upaya reformasi negara dalam hukum waris Islam belum diterapkan sesuai yang diinginkan negara.]
