Abstract

This study examines the shame culture phenomenon in the context of constitutional enforcement in Indonesia, particularly through a critical lens on the Constitutional Court Decision Number 90/PUU-XXI/2023. The research investigates the transformation of the Constitutional Court's role from merely a negative legislator to a positive legislator, along with its ethical and constitutional implications. The research method used is normative juridical with conceptual and case approaches. The results indicate the subordination of shame culture to political interests in Constitutional Court decision-making, which potentially degrades the values of constitutionalism and judicial ethics. This study concludes that strengthening shame culture within constitutional judicial institutions is an urgent need to re-establish the constitution's dignity as an instrument for limiting power and preventing authoritarianism. Research recommendations include reforming the selection mechanism for constitutional judges, strengthening judicial codes of ethics, and increasing public participation in constitutional judicial oversight.

Abstract

Bank credit agreements are legally binding arrangements between debtors and creditors, including when the debtor passes away. In such cases, legal responsibility for the outstanding debt may be transferred to the substitute heirs. This study aims to examine the legal liability of substitute heirs in bank credit agreements and analyze acts of default or unlawful conduct that may arise when obligations are not fulfilled. The research employs a normative legal method with a descriptive approach and juridical analysis of legislation, jurisprudence, and legal doctrines. The results show that substitute heirs bear limited liability based on the portion of inheritance received. However, in practice, breaches of obligation often occur, either due to ignorance or intentional neglect, resulting in legal consequences that harm the bank as creditor. Therefore, strengthening regulations and educating the public on the legal responsibilities of heirs are essential to ensuring legal certainty and balanced protection for all parties in the banking system.

Abstract

Perwalian merupakan upaya pertanggungjawaban seorang wali terhadap pribadi anak yang bersangkutan maupun harta bendanya atau dalam kata lain pengambilalihan kewenangan dalam mengasuh anak dan mengelola harta benda anak tersebut. Penelitian ini menganalisis proses pengajuan hak perwalian jika orang tua dari seorang anak meninggal secara bersamaan. Jika pada umumnya permohonan perwalian diajukan oleh satu pihak yakni orang tua yang hidup terlama, namun, jika kedua orang tua meninggal secara bersamaan, membuka setidaknya ruang sengketa perwalian terhadap anak yang ditinggalkan itu sendiri. Di fase ini diperlukan peran hakim yang aktif dan progresif yang mampu menilai, menimbang serta menganalisis aspek-aspek yang mungkin akan bersinggungan dengan pola asuh terhadap anak yang ditinggal mati oleh kedua orang tuanya tersebut. Hakim harus mengedepankan kesejahteraan anak tersebut yang tentunya sangat berhubungan dengan kondisi finansial dan kesehatan calon wali anak tersebut. Selain itu, terkait mekanisme pengawasan terhadap perwalian itu sendiri juga harus diatur lebih lanjut, bukan hanya berdasar pada amanah yang telah diberikan hakim kepada wali anak tersebut, namun, peran pengawasan juga mempersempit ruang tidak terpenuhinya hak-hak anak tersebut. Meski perwalian diberikan kepada salah satu pihak keluarga, namun, tidak menutup kemungkinan bahwa pihak keluarga lain dapat mengakuisisi hak tersebut dengan alasan-alasan terkait kesehatan fisik maupun mental wali hingga kondisi finansial wali itu sendiri, adapun hal ini disebut sebagai perubahan perwalian.

Abstract

Domestic workers (DWs) or domestic assistants (ARTs) are a common occupation in Indonesia, with around 5 million people working as DWs by 2022. However, legal protection for domestic workers who are abused by their employers remains a complex issue. This study aims to identify the legal protections available for domestic workers who are victims of abuse in Indonesia. Although Law No. 13/2003 on Manpower recognizes domestic workers as workers, legal protection for them is limited as they are not considered workers in certain businesses. Minister of Manpower Regulation No. 2/2015 on the Protection of Domestic Workers is an attempt to provide protection, but still has weaknesses in covering aspects such as wage standards, working hours, and leave. In addition, the Criminal Code also provides protection against violence against domestic workers, but has limitations in terms of complaint offense. Legal protection for domestic workers who are victims of violence by their employers is hampered by the limited definition of employment relationship in the Manpower Law. Despite efforts through special regulations and criminal law, further efforts are needed to improve legal protection for domestic workers, including improving the definition of employment relationships, improving the implementation of ILO Conventions, and adjusting criminal law to more effectively address cases of violence against domestic workers.

Abstract

This research examines the conflict of interest arising from the exercise of property rights over another person’s assets within Indonesia’s civil law system. Property law not only protects ownership rights but also serves as a legal instrument to guarantee creditors and third parties in the modern economy. The core issue emerges when absolute ownership rights conflict with limited real rights that grant preferential status to creditors. Using a normative juridical method through analysis of legislation, legal doctrines, and court decisions such as Supreme Court Rulings No. 2911 K/Pdt/2019 and No. 1248 K/Pdt/2007, this study finds that the existence of real rights has transformed ownership from an absolute concept into a relative or functional one. While owners retain their rights, these rights are limited by the existence of real rights to ensure legal certainty for creditors. The study concludes that harmonization is needed between ownership protection and creditor certainty through clearer regulations, strict procedural enforcement, and increased legal awareness to achieve a balance between legal certainty and substantive justice in property law practice.
