Abstract

Karena lahan terbatas, pemerintah berusaha mencari berbagai cara untuk mendapatkan tanah guna mendukung pembangunan, salah satunya dengan melakukan tukar-menukar tanah. Jika salah satu pihak gagal memenuhi kewajibannya, hal ini dapat menyebabkan sengketa dan membatalkan tukar-menukar. Penelitian ini bertujuan untuk mengungkap penyebab sengketa dalam tukar-menukar tanah dan cara penyelesaiannya, khususnya dalam pembangunan fasilitas pendidikan di SDN 03 Pakintelan, Gunungpati, Semarang.Sengketa terjadi akibat kelalaian pemerintah Kota Semarang, khususnya Kelurahan Desa Mangunsari, dalam peralihan hak tanah. Penyelesaiannya dilakukan melalui musyawarah dan negosiasi antara kedua pihak. Oleh karena itu, pemerintah disarankan lebih cermat dan aktif dalam menjalankan tugasnya.

Abstract

The case of Postponement of Debt Payment Obligations (PKPU) of PT Sentul City Tbk is one example of the complexity of dispute resolution between corporations and creditors. The PKPU application was filed by PT Prakasaguna Ciptapratama on January 7, 2021 at the Central Jakarta Commercial Court on the grounds that there was a debt due that had not been paid. Although the peace plan had been approved by the majority of creditors and ratified by the court on March 15, 2021, some consumers who felt aggrieved filed for a Judicial .Review (PK). They based their lawsuit on the postponement of the signing of the Deed of Sale and Purchase (AJB) which had lasted for more than 15 years. This study aims to analyze the legal aspects, financial implications, and social impacts of this case, including an evaluation of the PKPU mechanism in resolving debt disputes in Indonesia.

Abstract

The principle of non-intervention is the main foundation in international relations that affirms the prohibition of interference by other countries in the domestic affairs of a country. However, increasingly complex global dynamics, especially related to the increasing humanitarian crises such as genocide, ethnic cleansing, and systematic human rights violations have raised serious challenges to the absolutism of the principle. This article aims to analyze how the principle of non-intervention is normatively reinterpreted in the practices and actions of the United Nations (UN), especially through the Responsibility to Protect (R2P) doctrine. Using a juridical-normative approach and case studies of interventions in Rwanda, Kosovo, and Syria, this study reveals a shift in the meaning of non-intervention from an absolute prohibition to a limited allowance for humanitarian protection. This finding confirms that in conditions of extreme humanitarian crises, the legitimacy of international action is not only measured by state sovereignty, but also by the moral and international legal obligations to protect civilians. The UN, as a multilateral actor, plays a key role in balancing the principle of non-intervention with humanitarian imperatives, thus giving rise to dynamic and contextual normative reinterpretations.

Abstract

This article explores the caste system in Bali which has become an integral part of the social and cultural structure of Balinese society. The relationship between caste and social status reflects a deep and distinctive aspect of the structure of Balinese society. This article contains the history and how caste affects daily life and interaction patterns in Bali. In conclusion, the article also discusses the responsibilities of caste system holders in Bali involving a series of roles that are important in maintaining social and cultural balance in the Balinese indigenous community. They are responsible for maintaining and preserving the traditions and cultural values associated with each caste. In this article we can find out about the relationship and social system of caste in Bali.
