Abstract

This research critically assesses the role and effectiveness of the National Legislation Programme (Prolegnas) in the process of legal policy-making in Indonesia. This research aims to assess the extent to which Prolegnas can plan legislation in accordance with national legal needs. The method used is a literature review, in which various legal sources and reports on the implementation of Prolegnas are analysed in depth. The results of this study will provide insight into the various obstacles and challenges faced in the implementation of Prolegnas. It is also expected that this research will provide recommendations on how to improve the effectiveness of Prolegnas in supporting a more targeted and sustainable legal policy

Abstract

Ideally, every individual holds a balanced responsibility toward their rights and legal freedoms, as guided by Islamic Fiqh and the Universal Declaration of Human Rights (UDHR). However, in reality, imbalances between the exercise of rights and responsibilities often occur, both in social and legal contexts. This study aims to analyze the concept of individual responsibility toward rights and legal freedoms from the perspectives of Islamic Fiqh and the UDHR, as well as to identify the common ground between these two perspectives. This article falls under normative research with a qualitative approach, utilizing analysis of relevant primary and secondary literature. The findings reveal that both Islamic Fiqh and the UDHR emphasize a balance between rights and responsibilities, although differences exist in principles and contexts of application. These findings underscore the importance of harmonizing Islamic legal principles and universal norms to achieve social justice.

Abstract

Ideally, the application of criminal law theory in the prevention and handling of criminality in Indonesia should be able to respond to the dynamic social changes and evolving nature of crime. Criminal law policy should not only focus on enforcement aspects but also on comprehensive prevention, integrating social approaches and legal education as part of preventive strategies. This is essential for the Indonesian criminal justice system to be more effective in reducing crime rates and improving the legal system as a whole. The aim of this research is to analyze the application of criminal law theory in the prevention and handling of criminality, as well as to identify the challenges in implementing these theories through case studies. This article falls under qualitative research, using a descriptive-analytical approach aimed at describing and analyzing the application of criminal law theory within the context of Indonesian law. The research results show that the application of criminal law theory in crime prevention and control faces challenges in regulation, law enforcement, and social response, often creating a gap between the ideal concept and practical implementation. Therefore, an integrative approach that considers normative, sociological, and empirical aspects is needed to ensure the effectiveness of criminal law policies in achieving justice and public protection.

Abstract

Radikalisme dalam unjuk rasa buruh yang senter pada tahun ini diantaranya adalah menentang Peraturan Pemerintah (PP) Nomor 51 Tahun 2023 tentang Pengupahan dikarenakan isi dari peraturan tersebut dirasakan merugikan dan menurunkan tingkat kesejahteraan yag biasa di terima oleh para buruh pekerja sektor formal menurun. Penelitian dalam makalah ini adalah menganalisis latar belakang terjadinya aksi radikalisme yang dilakukan oleh para buruh pada saat aksi unjuk rasa, selanjutnya dampak yang dirasakan terhadap masyarakat wilayah sekitar dalam keseharian. Melalui pendekatan kualitatif dan studi literatur, makalah ini bertujuan untuk memberikan pemahaman yang lebih mendalam tentang akar permasalahan dan potensi, solusi penanganan aksi unjuk rasa tersebut dan cara dalam meminimalisir radikalisme dalam gerakan buruh.
