Abstract

The person designated as the owner of the job by the Budget User or Power of Budget User and in charge of carrying out the acquisition of goods and services is known as the Commitment Maker Officer. Contract-based procurement operations necessitate a high level of comprehension and/or proficiency, beginning with the stages of purchase planning, purchase execution, control, contract signing, and reporting and submission of work results. As a result, the PPK acts as its representative when forming alliances or agreements with other parties; in the absence of the Office of the Commitment Maker, the instance is unable to do so. The Office of the Commitment Maker determines whether a procurement of goods and services within an agency is successful or unsuccessful. This indicates that the fundamental functions of the Office of Commitment Makers are intimately tied to the utilization of the State budget since their execution calls for a distinct set of skills, accountability, and rigor than those of another administrative officer. State losses from damage or other claim claims will arise from errors in the Office of the Commitment Maker's discharge of its obligations

Abstract

This study aims to investigate the phenomenon of law enforcement apparently disregarding justice in viral social media cases in Indonesia, exploring its causes, manifestations, and implications for the country's legal system and society. The research employed a qualitative methodology, combining in-depth interviews with key stakeholders, focus group discussions, social media content analysis, and a comprehensive literature review. The findings reveal a complex interplay of factors contributing to this phenomenon, including a significant disconnect between public expectations and law enforcement realities, the influence of political connections on case handling, and the emergence of digital vigilantism. The study also identified gaps in existing legal frameworks, a lack of digital literacy among both the public and law enforcement officials, and the psychological toll on officers facing public pressure. These results highlight the need for multifaceted reforms in law enforcement practices, legal structures, and public communication strategies to address the challenges posed by viral social media cases and maintain public trust in the justice system.

Abstract

Abstract

Money laundering through crypto assets in Indonesia is a complex and challenging problem for law enforcement. This study aims to identify the challenges law enforcement faces against money laundering practices that utilize cryptocurrency. The research method used is qualitative analysis with a case study approach and interviews with experts in law and finance. The study results show that although there are regulations governing crypto asset transactions, money laundering practices are still rampant due to the anonymous nature and complexity of blockchain technology. Law enforcement has difficulty in tracking transactions and identifying perpetrators, especially due to the many loopholes in the law. Cooperation between government agencies and law enforcement is needed to improve the effectiveness of supervision and law enforcement against money laundering crimes using cryptocurrency. This study also recommends the need for clearer and more comprehensive regulations regarding the use of cryptocurrency in Indonesia to prevent further misuse.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap konsumen dalam transaksi e-commerce di Indonesia, dengan fokus pada efektivitas Undang-Undang Perlindungan Konsumen (UUPK) dan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE). Metode yang digunakan adalah pendekatan kualitatif melalui studi literatur terhadap peraturan perundang-undangan, jurnal ilmiah, dan hasil penelitian terdahulu. Hasil penelitian menunjukkan bahwa perlindungan konsumen masih lemah akibat implementasi regulasi yang tidak adaptif, lemahnya mekanisme perlindungan data pribadi, serta belum tersedianya sistem penyelesaian sengketa yang efektif dan digital. Ketidakseimbangan informasi antara konsumen dan pelaku usaha juga memperburuk posisi konsumen dalam transaksi daring. Penelitian ini menyarankan perlunya sinergi antara regulasi perlindungan konsumen dan kebijakan keamanan digital, serta pembentukan sistem penyelesaian sengketa daring yang terintegrasi. Temuan ini memberikan kontribusi terhadap pengembangan hukum perlindungan konsumen berbasis teknologi digital di Indonesia.

Abstract

Perjanjian kredit rumah antara konsumen dan developer umumnya menggunakan klausula baku yang disusun sepihak oleh developer. Hal ini menimbulkan ketimpangan, karena konsumen sering kali berada dalam posisi yang lemah dan berisiko dirugikan. Penelitian ini bertujuan untuk mengkaji penerapan klausula baku berdasarkan Undang- Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, serta menganalisis upaya hukum yang dapat ditempuh konsumen saat terjadi kerugian. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan didukung oleh analisis kualitatif. Berdasarkan hasil kajian, ditemukan bahwa banyak klausula yang melanggar Pasal 18 UUPK, seperti ketentuan hangusnya uang muka dan pengalihan tanggung jawab sepihak. Konsumen memiliki hak menempuh jalur penyelesaian melalui BPSK maupun pengadilan. Oleh karena itu, diharapkan penerapan sanksi terhadap developer dapat memperkuat perlindungan hukum konsumen.

Abstract

Tujuan dari penelitian ini untuk mengetahui bagaimana kedudukan dan perlindungan hukum terhadap tertanggung dalam kepailitan perusahaan asuransi. Jenis penelitian yang digunakan adalah penelitian hukum normatif, pendekatan yang digunakan adalah pendekatan perundang-undangan (Statute Approach). Hasil penelitian menunjukan bahwa dalam UU Kepailitan dan KUHPerdata, kedudukan daripada tertanggung dalam kepailitan perusahaan asuransi diperlakukan sama seperti kreditor konkuren, yaitu hak-haknya baru bisa dibayarkan setelah hak-hak dari kreditor separatis diselesaikan terlebih dahulu. Tetapi dalam UU Perasuransian memberikan perlindungan kepada tertanggung dengan kedudukan yang lebih tinggi, yaitu sebagai kreditor preferen (diutamakan) dibandingkan kreditor lainnya. Dengan menerapkan asas hukum lex specialis derogat lex generalis sudah tepat dilakukan, mengingat kedua produk hukum tersebut berada pada tingkat atau kedudukan yang sama (undang-undang), di mana yang satu mengatur hal yang bersifat khusus (kepailitan asuransi), dan yang lainnya mengatur hal yang bersifat umum (kepailitan pada umumnya).
