Abstract

This objective discusses the transfer of functions of waqf assets in the perspective of Islamic law and waqf law in Indonesia. In the fiqh literature, there is a difference of opinion among scholars regarding the prohibition of selling or converting waqf assets. Some scholars interpret this prohibition literally, thus arguing that waqf assets, such as mosques and mosque equipment, may not be sold or exchanged, even if they are no longer usable. However, there are scholars who understand that the prohibition only applies to waqf that can still be utilised, while old waqf that is no longer useful may be sold or exchanged. This opinion is particularly adopted by scholars who follow the school of Ahmad bin Hanbal, as explained in Ibn Qudamah's al-Muqni. Meanwhile, the Constitution of Islamic Law (KHI) explains that waqf assets basically cannot be changed or used other than the waqf pledge. However, there is a dispensation mechanism that allows the transfer of the function of waqf property with the approval of the sub-district Religious Affairs Office, the Sub-district Ulema Council, and the local Sub-district Head, provided that the reason for the transfer is in accordance with the public interest or because the waqf property is no longer in accordance with the waqf pledge. Waqf Law No. 41/2004 also regulates the transfer of waqf property functions. In principle, waqf assets are prohibited from being used as collateral, confiscated, granted, sold, inherited, donated, and transferred in other forms. However, there is an exception if the waqf asset is used for the public interest in accordance with the general spatial plan and does not conflict with Islamic law. Waqf assets that undergo a change in status must be exchanged for assets that have at least the same benefits and exchange value as the original waqf assets.

Abstract

Ayat-ayat yang terdapat dalam Al-Qur'an dan hadits Nabi Muhammad SAW yang sedikit menjelaskan tentang konsep wakaf dapat menjadi pedoman bagi para ahli fikih Islam. Sejak zaman Khulafa'ur Rasyidin sampai sekarang, dalam pembahasan dan pengembangan hukum wakaf menggunakan metode eksplorasi hukum (ijtihad). Oleh karena itu, sebagian besar hukum wakaf dalam Islam ditetapkan sebagai hasil ijtihad, dengan menggunakan metode ijtihad seperti qiyas, maslahah al-mursalah dan lain-lain. Penafsiran yang sering dilontarkan oleh para ulama, wakaf ini sangat identik dengan sadhaqahjariyyah, yaitu suatu amalan ibadah yang memiliki pahala yang terus mengalir selama masih dapat dimanfaatkan oleh kehidupan manusia. Berdasarkan konsep hukum Islam tentang wakaf harus sesuai dengan peraturan perundang-undangan yang berlaku di negara tentang wakaf. dengan Undang-Undang dan Peraturan Pemerintah yang telah kami uraikan tadi, maka Pemerintah dan Nazhir harus mampu dan konsisten menjalankan peraturan tersebut dalam pengelolaan, pengawasan dan pengembangan tanah wakaf, barulah masyarakat akan merasakan pentingnya lembaga wakaf dalam kehidupannya. Maka, jika selama ini lembaga nazhir dikenal tidak profesional dan tidak aman terhadap harta benda wakaf yang dipercayakan kepadanya, maka nazhir akan terkubur dengan sendirinya. Dan ke depan, wakaf akan menjadi jawaban yang paling konkrit terhadap permasalahan sosial, khususnya peningkatan ekonomi guna mewujudkan kesejahteraan dunia dan akhirat.

Abstract

Jaminan kesehatan rakyat adalah program yang digagas oleh Kementrian Kesehatan sebagai wujud amanah UUD 1945. Terhitung pada tanggal 1 Januari 2014, program ini dioperasikan oleh Badan Penyelenggara Jaminan Sosial (BPJS). dengan diterbitkannya UU No. 24 Tahun 2011 tentang BPJS, MUI menyambut baik pemerintah telah melakukan upaya untuk meningkatkan kemudahan akses masyarakat pada fasilitas kesehatan sehingga makin banyak warga masyarakat yang merasakan manfaat program jaminan kesehatan tersebut. bertepatan pada agenda setiap 3 tahun sekali MUI menggelar sidang ijtima’ Ulama Komisi Fatwa se-Indonesia yang ke-V di dalam sidang ini salahsatunya membahas tentang Badan Penyelenggara Jaminan Sosial (BPJS) Kesehatan. sidang ini melahirkan sebuah keputusan yang menegaskan bahwa program pemerintah ini hanya modus transaksional, secara umum program BPJS Kesehatan belum mencerminkan konsep ideal jaminan sosial dalam Islam. Beragam pendapat bermunculan ketika MUI pada tanggal 10 Juni 2015 resmi mengumumkan hasil dari sidang Ijtima’, bahwa BPJS Kesehatan tidak sesuai dengan prinsip syariah, MUI menilai program BPJS Kesehatan mengandung unsur-unsur yang menzolimi rakyat, berawal dari praktek akad yang tidak jelas sampai kepada terjadinya transaksi riba, garar, dan maisir. Media massa Nasional mengabarkan kritikan keras tokoh ormas Islam dan politik yang memunculkan pertanyaan kepada MUI. Beberapa mengatakan bahwa MUI seharusnya tidak sampai mengharamkan BPJS Kesehatan.

Abstract

This paper examines the existence of intellectual property rights (IPR) protection in the perspective of Islamic law and legislation in Indonesia. IPR protection is an important issue in the era of globalization, which requires harmony between national law and international legal principles. In the Indonesian context, in addition to referring to national legislation, this study also pays attention to how the principles of Islamic law view and regulate the protection of IPR. The research method used is qualitative with a normative and descriptive-analytical approach. The results show that Islamic law, although sourced from classical texts, has the flexibility to accommodate IPR protection through principles such as 'urf (custom), maslahat (benefit), and qiyas (analogy). Meanwhile, legislation in Indonesia has established a comprehensive range of rules to protect IPR, although its implementation still faces various challenges. This study concludes that there is significant harmony between Islamic law and Indonesian legislation in terms of IPR protection, which can be used as a basis for increasing the effectiveness of IPR protection in Indonesia.

Abstract

This paper explains that Islamic courts have a central role in upholding the law based on the principles of justice and benefit in accordance with sharia teachings. This study aims to examine the application of Maqasid Syariah the main objectives of sharia, which include the protection of religion, life, intellect, descendants, and property in the judicial process, in order to achieve a balance between al-‘adl (justice) and al-maslahah (benefit). The research method used is a literature study with a normative-juridical approach, involving an analysis of classical and contemporary Islamic legal sources, as well as a review of relevant judicial decisions. The results of the study indicate that the integration of Maqasid Syariah in judicial practice can maintain the relevance of law to social dynamics, while ensuring that the principle of justice remains the primary foundation. Achieving this balance requires an active role of judges in interpreting sharia arguments comprehensively and contextually, so that legal decisions are not only normatively valid but also beneficial for the welfare of the community

Abstract

The development of the Sharia economy in Indonesia requires a dispute resolution mechanism that ensures legal certainty, justice, and effective law enforcement. However, the coexistence of National Sharia Arbitration Board (BASYARNAS)  and the Sharia Court has created a dualism of authority concerning jurisdiction, institutional legitimacy, and the enforcement of Sharia arbitration awards. This study aims to analyze the authority conflict between BASYARNAS and the Sharia Court and to formulate a harmonization model based on the principle of maslahah. Using a normative legal research method, the study employs statutory, conceptual, and philosophical approaches through the analysis of legislation, court decisions, and relevant legal doctrines. The findings reveal that the authority dualism originates from regulatory disharmony between arbitration law and religious court regulations, resulting in legal uncertainty and obstacles to the enforcement of Sharia arbitration awards. The study proposes a maslahah-oriented harmonization model that positions BASYARNAS as the institution responsible for resolving Sharia economic disputes through arbitration, while the Sharia Court functions as the supervisory, legalizing, and enforcing authority for arbitration awards. This model strengthens institutional coherence and legal certainty within the Sharia economic dispute resolution framework. The study contributes to the development of constitutional and Sharia economic law scholarship and provides recommendations for regulatory synchronization to establish an integrated, effective, and equitable dispute resolution system.

Abstract

A Government Regulation in Lieu of Law (PERPPU) is a constitutional instrument granted to the President under Article 22 of the 1945 Constitution of the Republic of Indonesia in cases of compelling emergency. Although normatively intended as an emergency mechanism, the practice of issuing PERPPUs has sparked debate regarding the limits of their constitutionality, particularly in the context of the relationship between the executive and legislative branches of government. This study aims to analyze the constitutionality of PERPPUs within the Indonesian legal system and examine the tensions between the President and the House of Representatives (DPR) from a checks and balances perspective. This study uses normative legal methods with a statutory and conceptual approach. The analysis was conducted on constitutional provisions, Law Number 12 of 2011 concerning the Formation of Legislation, and Constitutional Court Decision Number 138/PUU-VII/2009, which defines the objective parameters of compelling emergency. The results indicate that a PERPPU is formally valid if it meets the procedures stipulated in Article 22 of the 1945 Constitution and obtains DPR approval. However, substantively, the practice of interpreting the phrase "compelling urgency" still leaves room for subjectivity, potentially expanding executive authority in the legislative sphere. This asymmetry of power arises because the PERPPU is effective from its promulgation before the House of Representatives (DPR) approves it, thus ensuring ex post legislative control. This study proposes a reconstruction of the parameters of compelling urgency by emphasizing restrictive interpretations, objective proof of legal vacuum and time constraints, and strengthening substantive evaluation by the DPR. Thus, the constitutionality of the PERPPU can be maintained without sacrificing the principles of the rule of law and the balance of power within Indonesia's constitutional democratic system.

Abstract

The development of the sharia economy in Indonesia has given birth to an increasingly complex legal relationship between business actors and consumers, while the construction of consumer protection in Law No. 8 of 1999 concerning Consumer Protection is still basically still built based on the conventional economic law paradigm. This condition raises the need to reconstruct the consumer protection framework to be more responsive to the characteristics of sharia economic transactions, especially through the integration of the principles of muamalah fiqh and dispute resolution mechanisms through sharia arbitration. This study aims to analyze the construction of consumer protection in Law No. 8 of 1999 from the perspective of muamalah fiqh and formulate a legal reconstruction paradigm that accommodates sharia principles in the resolution of sharia economic consumer disputes. The research uses a normative juridical method with a legislative, conceptual, and Islamic legal approach. Legal materials are analyzed qualitatively by examining the relationship between consumer protection norms, the principles of fiqh muamalah, and the mechanism of sharia arbitration in Indonesia. The results of the study show that consumer protection in the sharia economy is not enough to be placed solely on the formal balance of rights and obligations, but needs to be based on the principles of justice (al-'adl), benefit (maslahah), willingness of the parties (al-taradhi), trust, transparency, and prohibition of gharar, usury, tadlis, and practices that cause harm. In this context, sharia arbitration has a strategic position as a dispute resolution mechanism that is able to integrate the certainty of national law with the substantive value of sharia economic law. The reconstruction of Law No. 8 of 1999 is therefore directed at a more explicit recognition of the characteristics of consumers and sharia transactions, the integration of the principles of fiqh muamalah as a basis for substantive protection, and the strengthening of sharia arbitration as an alternative to resolving consumer disputes in the sharia economy.
