Abstract

ABSTRAKPenelitian ini dilatarbelakangi adanya adat di Nagari Kinali khususnya di Jorong Sigunanti. Bahwasanya dalam masyarakat harta pamujang tidak termasuk ke dalam harta warisan yang bisa diwarisi oleh anak dan istri pewaris melainkan harta pamujang tersebut adalah hak dari keluarga pewaris. Dalam ajaran Islam, istri dan anak memiliki hak atas warisan yang ditinggalkan oleh suami yang telah meninggal. Berdasarkan hal ini, penulis tertarik untuk meneliti pemahaman masyarakat tentang praktik pembagian harta pamujang serta pandangan hukum Islam terhadap pelaksanaannya pembagian harta pamujang. Penelitian ini dilakukan menggunakan metode lapangan dengan pendekatan kualitatif, yaitu melalui wawancara dan observasi langsung di lapangan. Data yang didapatkan dianalisis menggunakan metode induktif. Dari penelitian yang dilakukan ditemukan bahwa masyarakat menganggap harta pamujang tidak termasuk ke dalam harta warisan. Karena harta pamujang merupakan harta yang dianggap berasal dari kampung laki-laki, sehingga anak dan istri pewaris tidak berhak atas harta pamujang tersebut. Harta pamujang adalah hak yang dimiliki oleh keluarga pewaris, seperti orang tua, saudara kandung, dan keponakan pewaris. Sedangkan, harta yang dapat diwariskan kepada anak dan istri pewaris hanya terbatas pada harta bersama yang diperoleh selama pernikahan. Jika dilihat dari perspektif hukum Islam, praktik pembagian harta pamujang yang diterapkan oleh masyarakat di Jorong Sigunanti tidak sejalan dengan aturan hukum Islam. This research is based on the existence of customs in Nagari Kinali, especially in Jorong Sigunanti. That in society, the property of the pamujang is not included in the inheritance that can be inherited by the children and wife of the testator, but rather the property of the pamujang is the right of the testator's family. In Islamic teachings, wives and children have the right to inheritance left by a deceased husband. Based on this, the author is interested in examining the community's understanding of the practice of dividing the property of the pamujang and the views of Islamic law on the implementation of the distribution of the property of the pamujang. This research was conducted using a field method with a qualitative approach, namely through interviews and direct observation in the field. The data obtained were analyzed using the inductive method. From the research conducted, it was found that the community considers the property of the pamujang not included in the inheritance. Because the property of the pamujang is property that is considered to come from the male village, so the children and wife of the testator are not entitled to the property of the pamujang. The property of the pamujang is a right owned by the testator's family, such as the parents, siblings, and nephews of the testator. Meanwhile, the property that can be inherited to the children and wife of the testator is limited to joint property obtained during the marriage. When viewed from the perspective of Islamic law, the practice of dividing the assets of the pamujang implemented by the community in Jorong Sigunanti is not in line with Islamic law.

Abstract

One of the factors that husband and wife often dispute is regarding propertya especially joint property. Generally, disputes regarding joint property arise after a couple decides to divorce. In this situation, each party will try to get what they consider to be their right. The judiciary plays an important role in resolving these disputes. The judiciary functions as a medium for disputing husband and wife to convey their arguments, especially in efforts to control joint property. In this research the author used a normative approach method, known as the literature study method. In this research, the primary data comes from case decisions number: 283/Pdt.G/2017/PA.Mtr and number: 59/Pdt.G/2023/PTA.Mtr. then secondary data was obtained from various books, journals and articles related to the research subject. This research describes how judges consider when deciding joint property cases in cases number: 283/Pdt.G/2017/PA.Mtr and number: 59/Pdt.G/2023/PTA.Mtr. The results of this research, the author found that dispute resolution carried out by judges is not only focused on the law, but must also consider a sense of justice. So that judges do not have to divide joint assets equally but rather adhere to the principles of balance, equality, non-discrimination and granting rights to parties that are considered fair, accompanied by considerations that are considered fair. This is reflected in the decision in case number: 283/Pdt.G/2017/PA.Mtr and number: 59/Pdt.G/2023/PTA.Mtr

Abstract

Integrative Thematic Learning is an educational approach that integrates various competencies from different subjects into a specific theme. This theme is current, closely related to the students' world, and present in their daily lives. This study aims to measure the validity, practicality, and effectiveness of integrative thematic teaching materials in elementary schools over a decade. Using a quantitative meta-analysis method, data were obtained from various databases identified based on established inclusion and exclusion criteria. The results showed that the validity of integrative thematic teaching materials reached 81%, while their effectiveness was 86%, and practicality was 85%. These findings indicate that the teaching materials have a high capability to enhance student learning performance and support their use in everyday learning processes. These findings provide a strong foundation for the development and implementation of curriculum teaching materials at the elementary level, as well as improving the quality of teaching and learning outcomes. Therefore, this study makes an important contribution to policymakers, educators, and curriculum developers in efforts to improve the quality of elementary education.

Abstract

Kepemimpinan pendidikan global berperan strategis dalam mengelola keragaman budaya untuk menciptakan sistem pendidikan yang inklusif, adil, dan berkelanjutan. Artikel ini bertujuan untuk menganalisis strategi, tantangan, dan peluang dalam penerapan kepemimpinan pendidikan global melalui studi kasus pengelolaan keberagaman budaya di institusi pendidikan. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif, menggabungkan studi literatur dan analisis kasus dari institusi pendidikan multikultural. Hasil penelitian menunjukkan bahwa integrasi nilai-nilai lokal dan universal, pengembangan pendidikan multikultural, serta pelatihan lintas budaya adalah strategi yang efektif dalam mendukung inklusi dan kolaborasi lintas budaya. Pemimpin pendidikan yang mengadopsi kepemimpinan transformasional dan berbasis nilai menunjukkan kemampuan untuk mengatasi tantangan seperti stereotip budaya, resistensi terhadap perubahan, dan keterbatasan sumber daya. Selain itu, kecerdasan budaya (cultural intelligence) terbukti menjadi elemen kunci dalam menjembatani perbedaan budaya dan membangun hubungan yang harmonis. Kepemimpinan pendidikan global yang efektif dapat memanfaatkan keragaman budaya sebagai kekuatan untuk meningkatkan kualitas pendidikan. Dengan strategi yang inklusif dan berbasis budaya, pemimpin pendidikan dapat menciptakan lingkungan belajar yang relevan secara lokal dan kompetitif secara global, sekaligus mempersiapkan siswa untuk menjadi warga dunia yang toleran dan berintegritas.

Abstract

Salah satu permasalahan yang ada di masyarakat Kelurahan Bentuas, Kecamatan Palaran, Kota Samarinda adalah kurangnya rasa menyadari adanya potensi di sekitar mereka yang mungkin bisa mereka gunakan sebagai sumber daya tambahan agar berguna bagi pendidikan dan pemberdayaan masyarakat Kelurahan Bentuas. Pelaksanaan KKN UINSI ini meliputi berbagai rangkaian kegiatan yang dapat dikategorikan dibeberapa bidang utama yaitu bidang pendidikan, bidang keagamaan, dan dalam bidang social. Kegiatan tersebut terlaksana dengan baik dengan target peserta yang terpenuhi bahkan melebihi target yang ditentukan. Dalam bidang keagamaan, kegiatan yang dilaksaanakan meliputi mengajar di TPA Baitul Khair, mengadakan acara dalam rangka memperingati tahun baru Islam 1445H, memanagement tugas di langgar dan masjid. Begitupula dalam bidang social kegiatan yang dilaksanakan meliputi gotong royong dengan membersihkan lingkungan bersama di RT-02 dan RT-05, berpartisipasi dalam menyukseskan perayaan HUT RI dengan menjadi panitia pelaksana jalan sehat dan lomba-lomba yang diadakan di RT-04, RT-05, di TPA Baitul Khair RT-03, dan di SD 021 Palaran.

Abstract

The purpose of writing this article is to describe the teaching strategies for Islamic religious education as well as their effectiveness on the moral and spiritual development of students. This study employs a qualitative approach, utilising a case study method that involves observation, interviews, and documentation as data collection techniques. The results of the study show that PAI teachers at MBS Ummat implement teaching strategies based on Islamic principles, such as exemplary (uswatun hasanah), advice (mau'izah), and habituation of worship. This strategy is supported by the use of interactive and varied learning media, as well as approaches that are contextual and relevant to students' daily lives. Additionally, the support of the Islamic school environment plays a crucial role in the success of this strategy. This study concludes that the Islamic teaching strategies applied in MBS Ummat are effective in increasing religious understanding and the formation of Islamic character in students. Recommendations are given for continuous improvement in teacher professional development and the use of technology in teaching.
