Abstract

Living in a village with Refugees could develop various conflicts neither from refugees nor villagers. The research question arises on the adaptation strategies of villagers to live with the refugees in their village in regard to achieve SDGs Number 16,3,4 & 5. The approach used in this service is socio-legal. The findings show that there are challenges faced by the villagers; (a) incomprehension of villagers living near to Emergency Refugee Camp; (b) tendency of social jealousy from villagers to refugees; and (c) uncertain time for refugee leaving to third country. There were two activities to achieve the results; Conducting pre-post test and legal lecture which involved the village/sub district/district/provincial Government and villagers concerning Law and Refugees. The findings showed that the objectives were achieved due to (a) Increased knowledge of participants about refugees; (b) The presence of village / sub-district / district and provincial officials, IDCs, UNHCR and IOM as participants and resource persons; In conclusion, these two factors provide the ability of villagers to adapt and mitigate conflicts in living side by side with refugees. However, local government and IDC support is needed to UNHCR and IOM to immediately place refugees in temporary camps with access to clean water.

Abstract

Indonesia merupakan negara pantai yang berbentuk kepulauan terbesar dengan 17,504 pulau, yang kemudian Indonesia dianugerahkan hak khusus oleh hukum internasional. Rezim kepulauan pada bagian IV Konvensi Hukum Laut Internasional 1982 (UNCLOS 1982) mengatur bahwa negara kepulauan berhak mengatur sendiri alur laut kepulauannya dan rute udara yang melekat diatasnya. Indonesia telah menetapkan 3 alur laut kepulauan yang memiliki pola alur utara ke selatan dan sebaliknya, serta telah diakui oleh hukum nasional dan hukum internasional. Alur laut tersebut lazimnya digunakan oleh setiap kapal dan pesawat terbang asing untuk melintasi perairan kepulauan dengan hak lintas alur laut kepulauan. Negara kepulauan memiliki kewajiban untuk memastikan keamanan pelayaran dan penerbangan pada saat mereka melakukan transit pada alur laut kepulauan. Namun, hak ini sering kali menimbulkan permasalahan terhadap kepentingan nasional negara kepulauan, terutama latihan militer negara kepulauan pada rezim perairan kepulauan. Tulisan ini mendiskusikan apakah negara kepulauan dapat menggunakan rezim perairan kepulauannya untuk tujuan kepentingan militernya pada masa damai, sementara wilayah yang sama dipergunakan untuk pelayaran internasional, instalasi laut dan konservasi kanekaragaman hayati yang diatur berdasarkan hukum nasional Indonesia serta UNCLOS 1982.

Abstract

To promote national economic growth, the Indonesian government has introduced several laws, including investment policies related to carbon trading in indigenous forests. This article explores the legal concerns surrounding how investment strategies involving carbon trading in these forests could potentially lead to human rights violations, especially affecting Indigenous Peoples (IP). This study utilizes normative research methods and a case approach, with data collected through library research. This study shows that indigenous peoples gain both economically and environmentally from investment strategies involving carbon trading in indigenous forests. However, it may result human rights violations against IP. The state's failure to fully recognize Indigenous Peoples's rights has delayed the official acknowledgment of Indigenous Territories and Indigenous Forests. In contrast, business licenses for companies in the forestry sector trading carbon in Indonesia are processed quickly. This discrepancy can lead to potential human rights violations against IP, including threats to their indigenous forests and unfair access to social forestry management licenses.
