Abstract

All state have various laws that might apply to bullying behaviors. However, this law shows unintended. This study shows legal analysis in some journal, acts, and regulation in every state. Law Journals were conducted. It examines laws and policies dealing with cyberbullying in Indonesia, Malaysia and Brunei Darussalam starting with defining cyberbullying and then comparing the measures in which the issues surrounding cyberbullying have been addressed using various legal strategies.As of August 2017, 48 states had electronic harassment laws which explicitly included cyber bullying in US State. A total of 44 states included criminal sanctions in their cyber bullying laws. The authors point out that the majority of U.S. states have written legislation to address bullying and cyberbullying and that many state legislation that prohibit electronic bullying and developed consequences for doing so. This study was conducted to gain insight into how cyberbullying law implemented in Indonesia, Malaysia, and Brunei Darussalm.Last, after analyzing existing legislative methods an cyberbullying cases around the world, this article concludes with legal and policy recommendations based on these comparisons in Indonesia, Malaysia, and Brunei Darusallam.

Abstract

Hukum Lingkungan difokuskan kepadan Penciptaan dan Perlindungan kawasan lingkungan agar kawasan lingkungan di suatu daerah dapat terawat dan terjaga keasrian lingkungan nya. Pertanggung Jawaban Perdata dalam Penegakan Hukum Lingkungan di Daerah Marindal II Kecamatan Patumbak Kabupaten Deli Serdang ini melibatkan peserta didik dewasa kedalam struktur pengalaman belajar yang tentunya difokuskan kepada masyarakat yang di harapkan akan memahami dan mengerti tentang Hukum Lingkungan sebagai implementasi dari UU No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (PPLH) serta perubahan nya pada UU No 11 Tahun 2020 tentang Cipta Kerja.. Kegiatan ini dilakukan berdasarkan keadaan di lingkungan sekitar Kawasan Marindal II Kecamatan Patumbak Kabupaten Deli Serdang dimana masih terdapat adanya Potensi terjadinya Pencemaran dam/atau perusakan lingkungan misalnya limbah B3 dan lain-lainnya. Masyarakat di Kawasan Desa Marindal II tersebut akan diberikan Pemahaman mengenai Pertanggung Jawaban Perdata yang dapat dituntut kepada Perseorang atau Perusahaan yang baik dengan sengaja maupun tanpa sengaja mencemari lingkungan yang ada di sekitar Desa Marindal II.. Tujuan dari Pengabdian ini adalah agar masyarakat Marindal II mempunyai pengetahuan dan kesadaran dalam menjaga lingkungan dari pencemaran-pencemaran yang terjadi sebagai Implementasi dari UU No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (PPLH). Dari kegiatan ini dapat disimpulkan kurang nya Pengetahuan Masyarakat atas Hukum Lingkungan dan ketidaktahuan masyarakat terhadap langkah-langkah hukum yang dapat dilakukan untuk menggugat pelaku pencemaran dan/atau perusakan lingkungan hidup dalam Penegakkan Hukum Lingkungan.

Abstract

The quality of the environment is the most important part of human life in dignity and humility. In practice, ecocide are mostly committed by corporations, both national and transnational. Environmental crimes that are structured and systematic or often called ecocide do not concern as an extraordinary crimes. The International Criminal Court (ICC) has proposed to several countries such as Fiji, Vanuatu, and the Maldives that the need to add elements as international criminal crimes categorized as extra ordinary crimes in the Rome Statute and recognized as the fifth type of crime that becomes the jurisdiction of the International Criminal Court for trial. The purpose of this research is as a contribution to answer question. First, to analyze and to understand in developing extraordinary law enforcement against the crime of ecocide as extraordinary crime. Second, law enforcement review against ecocides in various regulations and various court decisions in Indonesia Third, to analyze the concept of international environmental law in the extraordinary enforcement law against ecocide crimes (Extra ordinary Crime) The research method used by researchers is normative juridical approach. This means that the legal material used as a study is secondary data. In this normative legal research it is not closed the possibility that empirical data (field) is also presented as an option to support and sharpen the study

Abstract

Green transportation policies in Indonesia have shown positive progress in reducing the environmental impact of the transportation sector. However, there are still major challenges that need to be overcome to achieve sustainable development goals in transportation. Limited infrastructure, the high cost of green vehicles, and the level of public awareness that needs to be increased are the main focus of this effort. The government needs to expand infrastructure, particularly in building electric vehicle charging stations across Indonesia, to support wider adoption of green vehicles. Active support from the private sector is also important in accelerating the development of environmentally friendly transportation technologies. In addition, consistent and sustainable policy development will provide certainty to investors and industry players to invest in green technology. The high initial cost of green vehicles is a major barrier for consumers. Therefore, appropriate fiscal incentives and subsidies are needed to make green vehicles more affordable and increase their attractiveness in the market. Raising public awareness about the long-term benefits of green transportation is also a crucial strategy through effective education campaigns. With strong collaboration between the government, the private sector, and the active participation of the public, Indonesia can overcome these challenges and achieve green transformation.

Abstract

Perjanjian internasional yang dibuat oleh Indonesia dengan Australia telah memberikan kerangka kerja mengenai peraturan perdagangan dan investasi. Pada Maret 2019, Pemerintah Indonesia dan Australia menandatangani The Indonesia-Australia Comprehensive Economic Partnership Agreement (IA-CEPA) memiliki dampak positif terhadap ekspor produk pertanian, meskipun terdapat beberapa tantangan  yang harus dihadapi dalam meningkatkan ekspor pertanian Indonesia ke Australia. Tujuan penelitian untuk menganalisis dampak hukum IA-CEPA terhadap ekspor produk pertanian Indonesia serta menganalisis kesesuaian IA-CEPA dalam hukum perdagangan internasional. Manfaat penelitian dapat memberikan kontribusi pada pemahaman yang lebih baik tentang perlindungan hukum yang diberikan kepada ekspor pertanian Indonesia berdasarkan IA-CEPA dan implikasi bagi para pembuat kebijakan, eksportir, dan pemangku kepentingan lain yang terlibat dalam sektor pertanian Indonesia. Penelitian ini menggunakan metode yuridis normatif yaitu pendekatan yang dilakukan berdasarkan bahan hukum perundang-undangan dengan cara menelaah teori-teori, konsep-konsep, dan asas-asas yang berkaitan dengan hukum perjanjian internasional dan hukum perdagangan internasional. Hasil penelitian menunjukkan bahwa dampak perjanjian Indonesia- Australia Comprehensive Economic Partnership  Agreement  (IA-CEPA) terhadap ekspor produk pertanian Indonesia memberikan peluang signifikan bagi Indonesia untuk meningkatkan ekspor produk pertanian, karena ketentuan dalam persetujuan IA- CEPA tidak bertentangan dengan peraturan perundang-undangan nasional yang berlaku. IA-CEPA menunjukkan kesesuaian dengan prinsip-prinsip yang ditetapkan oleh WTO dan GATT, yakni; prinsip non-diskriminasi, transparansi, dan perlakuan yang adil terhadap semua anggota, sehingga tidak ada pertentangan antara IA-CEPA dengan prinsip-prinsip hukum perdagangan internasional.

Abstract

Living in a village with Refugees could develop various conflicts neither from refugees nor villagers. The research question arises on the adaptation strategies of villagers to live with the refugees in their village in regard to achieve SDGs Number 16,3,4 & 5. The approach used in this service is socio-legal. The findings show that there are challenges faced by the villagers; (a) incomprehension of villagers living near to Emergency Refugee Camp; (b) tendency of social jealousy from villagers to refugees; and (c) uncertain time for refugee leaving to third country. There were two activities to achieve the results; Conducting pre-post test and legal lecture which involved the village/sub district/district/provincial Government and villagers concerning Law and Refugees. The findings showed that the objectives were achieved due to (a) Increased knowledge of participants about refugees; (b) The presence of village / sub-district / district and provincial officials, IDCs, UNHCR and IOM as participants and resource persons; In conclusion, these two factors provide the ability of villagers to adapt and mitigate conflicts in living side by side with refugees. However, local government and IDC support is needed to UNHCR and IOM to immediately place refugees in temporary camps with access to clean water.

Abstract

The Indonesia–Australia Comprehensive Economic Partnership Agreement (IA-CEPA) establishes a comprehensive legal framework intended to promote bilateral trade liberalization and regulatory cooperation between Indonesia and Australia in the agricultural sector. Despite significant tariff reduction commitments, agricultural trade between Indonesia and Australia continues to encounter substantial barriers arising from differences in domestic legal system including sanitary and phytosanitary (SPS) measures, technical standards, import licensing systems, and biosecurity regulations. While previous studies have predominantly examined IA-CEPA from economic and trade perspectives, limited attention has been addressed to the normative legal harmonization between the domestic legal frameworks of both countries in implementing the Agreement. This study examines the regulation of agricultural tariff barriers under IA-CEPA from the perspective of international trade law principles and analyzes the harmonization of Indonesian and Australian national laws in implementing agricultural trade policies under the agreement. This study addresses that gap by providing a normative legal analysis of the consistency between IA-CEPA obligations and the agricultural trade regulations of Indonesia and Australia. This research employs a normative juridical method using statutory, treaty, conceptual, and comparative approaches through the examination of IA-CEPA provisions, WTO Agreements, Indonesian agricultural trade legislation, and Australian biosecurity laws. The findings reveal that IA-CEPA incorporates the fundamental principles of international trade law, including transparency, non-discrimination, proportionality, regulatory coherence, and market access. However, the implementation of these principles remains constrained by conflicting domestic regulatory priorities. Indonesia maintains protective agricultural policies aimed at preserving food sovereignty, farmer protection, and domestic market stability, whereas Australia emphasizes strict biosecurity governance and SPS compliance requirements to protect public health and environmental security. Consequently, domestic regulatory measures rather than tariff commitments continue to constitute the principal barriers to bilateral agricultural trade. The study further demonstrates that legal harmonization under IA-CEPA remains only partially achieved due to regulatory inconsistencies, overlapping administrative requirements, and differing regulatory philosophies. The novelty of this research lies in its normative assessment of regulatory harmonization between international treaty obligations and domestic agricultural trade laws, offering a legal framework for evaluating the effectiveness of bilateral trade agreements in balancing trade liberalization with state regulatory autonomy. The study contributes to international trade law scholarship by proposing a normative framework for assessing regulatory harmonization between bilateral trade agreements and domestic agricultural regulations.
