Abstract

The Constitutional Court Decision Number 90/PUU-XXI/2023 Concerning the Age Limit for Vice Presidential Candidates in the 2024 Presidential Election has caused much controversy, both politically and legally. This decision has profound implications for Indonesia’ political configuration, as it grants constitutional legitimacy to Gibran Rakabuming Raka, enabling him to run as a candidate for vice president of the Republic of Indonesia in the 2024 General Election. In the context of the legal debate, several problems have emerged, including the impact of this decision on the quality of democracy in Indonesia. One key concern is whether this decision is the initial gateway for Indonesia to enter a system called 'juristocracy'. This term refers to a situation where the Constitutional Court Decision justifies the practice of 'negative legislation', where the legislative function is constitutionally only given to the President and the DPR, but the Constitutional Court, through its 'final and binding' decision power, makes this a loophole that potentially damage democracy. This research is focused on examining the decision based on the two fundamental problems outlined above, using a library research method based on normative research, with a conceptual approach as its foundation. The analysis employs the theory of the rule of law to critically assess whether the decision has significant positive or negative implications for the sustainability of democracy and the existence of the rule of law in Indonesia in the future.

Abstract

Partisipasi masyarakat dalam pembuatan Peraturan Desa (Perdes) termasuk pada aspek pembangunan di Desa tidak hanya dipandang sebagai bagian dari proses tetapi juga merupakan bagian dari tujuan, dimana partisipasi merupakan salah satu indikator tingkat keberhasilan khususnya program pembangunan desa. Misal, partisipasi masyarakat dalam bentuk Pembentukan Peraturan Desa (Perdes) yang partisipatif harus mencerminkan komitmen bersama antara Kepala Desa (Kades), Badan Permusyawaratan Desa (BPD) dan masyarakat Desa, hal tersebut dilakukan guna membuat suatu Peraturan Desa yang benar-benar sesuai dengan kebutuhan masyarakat Desa tersebut. Partisipasi masyarakat dalam pembentukan Peraturan Desa merupakan wujud dari penyelenggaraan pemerintahan yang baik sesuai dengan prinsip-prinsip good governance, diantaranya meliputi keterlibatan masyarakat, akuntabilitas, dan transparansi. Sehingga kegiatan ini sangat penting dilakukan dalam bentuk perkuliahan Desa yaitu bagi masyarakat, Perangkat Desa dan Badan Perwakilan Desa (BPD). Dengan perkuliahan Desa ini diharapkan meningkatnya person masyarakat untuk kontribusi pada pembentukan peraturan di Desa sebagai sarana perwujudan Undang-Undang Desa dan Tata Kelola Pemerintahan Desa Yang Baik atau dikenal pula dengan istilah Good Governance. Adapun metode perkuliahan Desa yang digunakan adalah dalam bentuk pemberian materi perkuliahan yaitu Tata Kelola Pemerintahan, Asas-Asas Hukum Tata Kelola Pemrintahan, Pemerintahan Desa, Pengaturan tentang Desa, Pembuatan kebijakan, partisipasi masyarakat, gambaran dan mekanisme pembuatan peraturan, kriteria dan aturan tentang pembuatan perundang-undangan serta materi lain yang terkait dalam ruang lingkup partisipasi masyarakat dan pembuatan Peraturan Desa itu sendiri.  Kata Kunci: Peraturan Desa, Partisipasi Masyarakat dan Desa

Abstract

Prosperity and welfare have been ideals pursued by the founders of this nation and the current Indonesian government. These ideals are manifested in the preamble of the 1945 Constitution, which states: "The government shall protect the entire nation and all the blood spilled, promote general welfare, and educate the life of the nation." However, in reality, the issue of social inequality in Indonesia has become increasingly acute. According to data released by the Central Statistics Agency (BPS) in March 2024, the poverty line is defined as an income of Rp. 536,122 per person per month, with 25.22 million people recorded as living below this threshold. Meanwhile, the World Bank's poverty standard is defined as a minimum daily income of $2.15 or approximately Rp. 970,000 per month. There is a significant discrepancy between the standard set by the Indonesian government and that of the World Bank, which presents a serious issue that must be addressed. In 2014, Law No. 6 of 2014 concerning Villages provided a legal foundation and strategic framework for the development and empowerment of village communities. Through authority in village governance, development implementation, community guidance, and empowerment, it is hoped that villages will develop awareness and initiative. Subsequently, the central government initial village fund transfers through the state budget (APBN), allocating 10% of the total funds outside of regional transfers (on top), implemented gradually. The increase in budget allocation disbursed to villages aims to support village development to enhance community welfare and improve the quality of life while addressing poverty. This is achieved by fulfilling basic needs, constructing village infrastructure, developing local economic potential, and sustainably utilizing natural and environmental resources. Thus, the author formulates the following research problems: How can the concept of a welfare state be reformulated as a strategy for poverty alleviation through the utilization of village funds in Indonesia? What concrete measures can be taken to ensure effective and targeted use of village funds for poverty alleviation in Indonesia? This research employs a normative legal study approach supported by empirical data. The theoretical framework includes the theory of the welfare state, the theory of legal development, and Jeremy Bentham's theory of economic analysis of law
