Abstract

Prinsip kejelasan hukum mengatakan bahwa standar hukum harus dirumuskan dengan cara yang jelas dan tidak ambigu. Ini penting untuk menghindari interpretasi yang berbeda, yang dapat menimbulkan keraguan bagi masyarakat. Ketika peraturan tidak jelas, orang atau organisasi yang mempengaruhi mungkin mengalami kesulitan untuk memahami hak dan kewajiban mereka, yang dapat menyebabkan pelanggaran hukum tanpa disadari. Penelitian ini dilakukan dengan penelitian kualitatif dengan pendekatan literatur adalah metode penelitian yang bertujuan untuk memahami fenomena secara mendalam melalui analisis data yang berasal dari berbagai sumber literatur, seperti buku, jurnal, dokumen resmi, dan regulasi. Prinsip kejelasan dalam UU 12/2011 menuntut agar setiap peraturan memiliki tujuan yang jelas dan rumusan yang tidak menimbulkan ambiguitas. Namun seringkali, praktik penyusunan peraturan tidak memenuhi standar ini, yang mengakibatkan berbagai interpretasi di lapangan. Ketidakjelasan ini dapat mengganggu kepatuhan masyarakat terhadap hukum dan menimbulkan ketakutan.

Abstract

This study examines the transformation of the role of PPKn teachers at SMPN 17 Medan from mere educators to moral role models in the digital era. This study, which used qualitative methods through observation and interviews, uncovered insights from PPKn teacher Mrs. Dina Noviana and her students. The study revealed that teachers must navigate the complexity of the digital environment, recognizing its positive and negative impacts on students’ character development. Teachers are now tasked with not only delivering curriculum content but also acting as role models in moral behavior, especially in online interactions. The study’s findings suggest that effective moral guidance is essential, balancing curriculum delivery with instilling ethical values. Students expressed appreciation for teachers who demonstrated positive attitudes and modeled appropriate behavior in both academic and digital settings. This study underscores the importance of PPKn educators evolving with digital trends, becoming relevant moral guides who are able to prepare students for future challenges while fostering character in a rapidly changing digital landscape. This study emphasizes that the role of PPKn teachers is essential in instilling ethical values, morality, and integrity, thus shaping future community leaders. Ultimately, these findings suggest the need for educators to adapt and refine their approaches to be effective in the digital era.

Abstract

This research discusses equality before the law in Indonesia by highlighting the role of the second principle of Pancasila, “Just and civilized humanity,” as the philosophical foundation of law enforcement. Although the constitution and various policies have affirmed the principle of equality, practice on the ground still shows injustice and discrimination, especially against low-income groups and those from certain social backgrounds. This study highlights the structural and cultural challenges, as well as the weak resources and integrity of law enforcement officials, that have led to suboptimal law enforcement. In addition, this study also evaluates the effectiveness of government policies in integrating Pancasila values into the legal system and highlights the importance of policy reforms to ensure fair treatment for all citizens. The findings of this research recommend the need to strengthen the implementation of Pancasila values and supervise the implementation of the law to realize substantive justice in Indonesia.

Abstract

The “turun ranjang” marriage is a traditional practice found in several Indonesian ethnic groups, in which a man marries the younger sister of his deceased or divorced wife. This tradition aims to maintain family harmony, protect children, and preserve kinship ties. From the perspective of Islamic law, such a marriage is permissible as long as it fulfills the legal requirements and pillars of marriage, including the presence of a guardian, witnesses, mutual consent, and the absence of coercion. However, if any of these conditions are not met, the marriage may be considered invalid according to Islamic law. While this tradition has positive aspects such as preventing adultery and preserving family unity it may also lead to social conflict when performed under pressure or without full consent. Therefore, it is essential for those involved to seek guidance from Islamic scholars or legal experts to ensure the marriage aligns with religious principles and promotes family harmony. Overall, the “turun ranjang” marriage can be accepted if conducted with sincerity, awareness, and compliance with Islamic law.
