Abstract

Indonesia is a country that has abundant genetic resources, multi ethnicity, and diverse cultures. This situation makes Indonesia very rich in traditional knowledge. Protecting traditional knowledge is very important because traditional knowledge is the identity of the community as the owner. Through Article 18B Paragraph (2) and Article 28I Paragraph (3) of the 1945 Constitution, traditional knowledge which is a traditional right and the identity of the indigenous culture are implicitly recognized as constitutional rights. Protection of traditional knowledge in Indonesia is regulated in the Copyright Law, Patent Law, and Culture Promotion Act. However, the protection of traditional knowledge in Indonesia has not been optimal, because it has not provided adequate protection to traditional knowledge.

Abstract

This research aims to analyze the implementation of the First Principle of Pancasila at Budisatrya Medan High School in shaping student character. The research method used is qualitative with a descriptive approach. Data collection techniques were carried out by interviews with students and teachers. The research results show that the implementation of the First Principle of Pancasila at Budisatrya Medan High School is quite effective in shaping student character. This can be seen from students' habits of praying, participating in religious activities, and trying to act honestly, fairly, and responsibly. The school has also carried out various programs to implement the First Principle of Pancasila, such as express Islamic boarding schools, congregational prayers in prayer rooms, providing religious extracurricular activities, and providing prayer rooms for Muslim students.

Abstract

This research aims to analyze legal protection for ownership of land rights for the public interest, and this research can be useful as a reference for readers. This research uses a qualitative descriptive research method, with a type of normative legal research - empirical or literature. Sugiyono said that quantitative research is a method used to examine the condition of natural objects where the researcher is the key instrument. type of normative-empirical legal research according to Muhaimin in his book entitled: Legal Research Methods says that normative-empirical legal research is "legal research that examines law as rules or norms and the application of legal rules in practice in society". The results found are that the existence of regulations regarding land acquisition provides a legal basis for the government to obtain land for the implementation of development in the public interest and is a guarantee for land rights holders to obtain adequate compensation, thereby providing better survival at a higher level of socio-economic life. prior to land acquisition. Land acquisition for development in the public interest is a land acquisition activity carried out by the government for the construction of public facilities. Land procurement consists of planning, preparation and implementation stages which involve the regional government as the executor of land acquisition, the ministry that carries out land affairs, land rights owners and affected communities.

Abstract

This research aims to analyze legal protection for holders of certified land rights. The research method used is the library study research method by utilizing sources related to the research title through books, journals, notes, previous research, and the like. The research results show factors that cause double certificates, such as inaccuracy and carelessness in the process of issuing certificates by the National Land Agency. The emergence of multiple certificates creates legal uncertainty for the owner and has the potential to cause disputes and losses for both parties. The legal protection obtained by land rights owners who are disadvantaged due to double certificates in the form of cancellation and revocation of related documents which are considered detrimental. From this research, it can be concluded that legal protection for certified land rights holders is important to ensure legal certainty and prevent the occurrence of disputes that harm the owners of land rights

Abstract

This research aims to find out how legislative science contributes to the formation of legislative regulations in Indonesia, what factors influence the quality of legislative regulations in Indonesia, and how the application of legislative science can improve the quality of existing legislative regulations. . Forming laws is an integral part of the task of managing a society consisting of a group of human individuals who have various aspects of life. Therefore, designing and drafting laws that can be accepted by society is a complicated task. The method the author used in this research is a qualitative method using library research, namely conducting research by collecting information from books and journals.

Abstract

The election of President Jokowi Dodo to the political elite seems to show intimacy in terms of policy formation. This can be seen in the formation of the draft KPK law which is basically not included in the national legislative program but was promulgated in a very short time and with a substance that seems to weaken Ad Hoc institutions. The Corruption Eradication Commission Bill has been passed and if changes are desired, it must involve all components of society, both legal experts and students. Seeing this, there is an instant and legal option, namely the establishment of government regulations in lieu of law. However, political conditions speak otherwise, in which all political parties do not want a Perpu. The role of the opposition is needed here as a balance controller who prioritizes the benefit of the people. Therefore, this research aims to review the role of the opposition in controlling the plan to establish the Corruption Eradication Law so that it remains fair in society. The research method used is a qualitative research method with a literature study approach. The research results show that basically the opposition acts as a check and balance against the government in power, such as monitoring the government, criticizing government policies, conveying community aspirations, providing alternative leadership, encouraging public discussion and debate. This aims to continue to prioritize the interests of the community.

Abstract

The proposed changes to the Draft Law on the Criminal Code (RUU KUHP) have attracted widespread attention from various parties. This research aims to examine and criticize these changes, especially from the perspective of criminal law and citizens' rights. This study uses qualitative research with a library approach in obtaining data for research results. The research results show that there are many problems related to changes to the Criminal Code Bill, which include the addition and deletion of several articles. The ambiguity of legal concepts, the possibility of abuse of power, and the consequences for individual freedom are the main focus of criticism. Changes may also affect citizens' rights and the judicial process.

Abstract

This research uses a qualitative approach to evaluate the effectiveness of traffic signs in improving road safety in Indonesia. Through a series of methods, including direct observation, in-depth interviews, and documentation study, this research aims to understand how traffic signs contribute to road safety and what factors influence their effectiveness. The results show that traffic signs play an important role in controlling traffic flow and preventing accidents. However, their effectiveness is often hindered by several factors. First, a lack of understanding by road users about traffic signs. Second, poor maintenance of traffic signs. Third, weak law enforcement. Based on these findings, this research recommends several steps to improve the effectiveness of traffic signs. First, increasing public education about the importance of obeying traffic signs. Second, routine and quality maintenance and repair of traffic signs. Third, stronger and consistent law enforcement against traffic violations. This research hopes that with the implementation of these recommendations, the effectiveness of traffic signs in improving road safety can be increased.

Abstract

The purpose of this writing, namely to find out the legal awareness of the community on land registration where land certificates become an important thing for land rights, there are also factors that hinder. This type of research is Empirical legal research is a type of research that combines legal and empirical methodologies. This method involves collecting empirical evidence, such as field observations and interviews. Descriptive research is a type of research that seeks to describe accurately and precisely a phenomenon or situation. The results showed that the community has a fairly good awareness related to proof of ownership of land rights with the existence of land certificates.

Abstract

In current conditions, foreign nationals in Indonesia are not becoming fewer and fewer, but are actually increasing in number. There are several reasons why there are so many foreigners in Indonesia, one of which is the global flow and modernization factor, and another reason is to Increase multilateral cooperative relations with other countries, so it is felt necessary to provide easy access for foreigners to visit or live in Indonesia. However, foreigners are not allowed to control land with ownership rights, where if foreigners obtain ownership rights then the land is controlled by the state. The research method used in this research is a qualitative descriptive method with a normative juridical approach which analyzes legal norms from the perspective of literature study. Data was obtained through literature study, interviews and documentation. The research was carried out to find out how land rights are controlled by foreign citizens according to the UUPA and how the use rights and the end of legal relations for residential homes for foreign citizens are carried out. Land ownership for foreign citizens in Indonesia is generally limited and regulated by Law Number 5 of 1960. They can obtain use rights to land, but ownership rights are limited to certain forms of foreign investment. This is intended to protect national interests and prevent foreign investment or accumulation of land by foreign parties.
