Abstract

This research examines the utilization of buildings in Parepare City based on Regional Regulation No. 5/2014 on Building and the effectiveness of supervision conducted by the local government. This research uses a qualitative approach with a social/empirical method. Data were obtained through observation, interviews, and documentation. The results showed that building utilization in Parepare City is not always in accordance with the initial designation. Some buildings have changed functions, such as the culinary market building which turned into a public service office to optimize its utilization, Building 202 which was abandoned after a change in function, and the Jiwasraya building which is not operating due to bankruptcy. Supervision by the PUPR Office is structured, but still faces obstacles in changing the function of buildings and the lack of optimal socialization and supervision. In the perspective of Siyasah Idariyah, the Parepare City Government is responsible for maintaining spatial order and protecting the community from the negative impact of building conversion. The principles of shura and accountability are applied in policy making, with the use of technology and persuasive approaches to increase public awareness. This step is in line with the principles of benefit and responsibility in Islam.

Abstract

Tujuan penelitian yaitu menganalisis peran lembaga adat dalam pengelolaan hutan adat pasca putusan MK Tahun 2015 serta pengaruh peran lembaga adat tersebut terhadap pengelolaan hutan adat terutama dalam mempertahankan eksistensi hutan adat. Metode yang digunakan dalam penelitian ini yaitu tipe penelitian normatif dengan pendekatan historis, pendekatan konsep, dan pendekatan perundang-undangan yang didukung oleh data sekunder selanjutnya dianalisis secara deskriptif kualitatif. Hasil penelitain yaitu Perubahan peran lembaga adat pasca putusan Mahkamah Konstitusi tahun 2015 menguatkan posisi dan kewenangan lembaga adat dalam pengelolaan hutan adat. Dengan perubahan ini, lembaga adat memiliki tanggung jawab yang lebih besar dalam menjaga keseimbangan ekosistem, melestarikan keanekaragaman hayati, serta memastikan penggunaan sumber daya alam yang berkelanjutan. Peran lembaga adat dalam pengelolaan hutan adat antara lain membuat batasan dalam pengelolaan sumber daya hutan lindung melalui nilai-nilai dan norma, pengawasan kawasan hutan dilakukan secara langsung maupun secara tidak langsung, penyelesaian konflik, mengambil keputusan bersama terkait pengelolaan sumber daya hutan lindung, memberikan izin terkait pemanfaatan sumber daya hutan, dan pemberdayaan masyarakat.Urgensi utama lembaga adat dalam masyarakat hukum adat yaitu menjaga keberlanjutan budaya, lingkungan, dan kehidupan masyarakat adat terkait pengelolaan hutan adat untuk kesejahteraan masyarakat hukum adat berlandas pada hukum adat. Perubahan peran lembaga adat pasca putusan Mahkamah Konstitusi tahun 2015 menguatkan posisi dan kewenangan lembaga adat dalam pengelolaan hutan adat. Namun, implementasi yang efektif memerlukan upaya kolaboratif dari berbagai pihak untuk memastikan perlindungan hak-hak masyarakat adat dan keberlanjutan pengelolaan hutan adat di Indonesia.

Abstract

Enforcing criminal law against corruption in Indonesia faces significant challenges due to the dynamics of legal change, particularly following the enactment of Law No. 1 of 2023 on the National Criminal Code. This study aims to analyze how the principles of legality and lex favor reo, as applied to the interpretation of criminal provisions, affect the consistency of law enforcement, particularly in the context of Article 23 of the Law on the Eradication of Corruption, which refers to several provisions of the old Criminal Code. Using a normative legal research method with a conceptual approach and a comparative analysis of court decisions, data are collected through literature reviews and regulatory analysis. The research findings indicate that changes in the normative reference of primary norms in the National Criminal Code have led to significant differences in the criminal threats and criminal provisions referenced in Article 23 of the Law on the Eradication of Corruption. The application of the lex favor reo principle becomes crucial, as the most lenient provisions are applied not only to the defendant but also in the context of the National Criminal Code, where the terminology is expanded to include the concepts of the perpetrator, accomplice, suspect, defendant, and convict. The consistency of the Supreme Court in adhering to a material theory limited to the interpretation of "changes in legislation" underscores the protection of individual rights. A comprehensive harmonization and synchronization between the National Criminal Code and the Law on the Eradication of Corruption is essential to prevent normative conflicts and to ensure legal certainty in the implementation of Article 23 of the Law on the Eradication of Corruption.

Abstract

This study aims to analyze the conflict between public access rights and the rights of local communities on Cempedak Island in managing marine areas. The method used is socio-legal, through an analytical approach to national legal frameworks, doctrines, and case studies. The study results show that this conflict creates a dilemma between the interests of local communities and public access rights. The 1945 Constitution and related regulations provide a legal basis for public access rights, but local communities also have rights set out in policies and regulations. This paper critically presents a model of conflict resolution, regulatory, and resource processes that often ignore local community participation. Evaluations of previous Government policy procedures show a lack of consultation and involvement of local communities and public access in policy processes that can result in gaps and prolonged conflicts. This research emphasizes the need for a participatory-collaborative approach. Innovation is the gradual application of the need for community identification to implement comprehensive methods that integrate positive legal analysis with the social and local communities' cultural realities. Conflict techniques on Cempedak Island actively involve communities in decision-making to encourage sustainability, protection, community interests, and public access rights, ultimately creating new policies and rules.
