Abstract

The purpose of this study is to explore in depth the concept of women's leadership from the perspective of Islamic law. The aim is to provide a clear understanding of Islamic guidelines regarding women's leadership and its limitations. Leadership is understood as behavior that aims to influence the activities of group members in order to achieve a common goal, designed to benefit both individuals and organizations. This study is a literature review using a descriptive-analytic method with a historical-philosophical approach, combining data analysis and documentation verification to ensure valid results. The findings show that women's leadership, from the perspective of Islamic law, is a flexible concept that continues to dialogue with the changing times. Islamic law does not provide strict or definitive practical guidelines regarding women's leadership, as this issue falls under mu'āmalah (human social relations), which requires further elaboration through ijtihad (independent reasoning) and humanitarian considerations. Based on this reasoning, there is no textual or contextual prohibition against women taking on leadership roles. Moreover, leadership is not inherently gendered, as gender is only a difference in identity. Gender refers to the differences between men and women in terms of social, cultural, psychological, and other aspects, which are always related to equal rights between men and women.

Abstract

Kekerasan di lingkungan sekolah telah berkembang menjadi persoalan hukum serius, khususnya ketika menimbulkan luka berat terhadap korban yang masih berstatus anak. Kekerasan antar-anak yang dipicu bullying menunjukkan bahwa sekolah belum sepenuhnya mampu menyediakan ruang aman bagi peserta didik. Penelitian ini bertujuan menganalisis kedudukan bela paksa dalam perkara kekerasan anak yang dipicu bullying di lingkungan sekolah serta pertanggungjawaban pihak sekolah terhadap peristiwa kekerasan tersebut. Penelitian menggunakan teori bela paksa, restorative justice, dan vicarious liability dengan metode yuridis normatif. Hasil penelitian menunjukan kedudukan bela paksa dalam perkara ini bergantung pada terpenuhinya unsur serangan seketika, melawan hukum, dan proporsionalitas tindakan pembelaan. Meskipun anak pelaku mengalami tekanan psikologis akibat bullying, tidak seluruh tindakan perlawanan dapat dikualifikasikan sebagai noodweer apabila melampaui batas kewajaran. Namun, kondisi tersebut dapat dipertimbangkan sebagai alasan pemaaf. Di sisi lain, sekolah memiliki tanggung jawab moral, administratif, dan potensi tanggung jawab hukum apabila lalai mencegah, mengawasi, dan menangani bullying. Kelalaian tersebut dapat dikualifikasikan sebagai omission yang berimplikasi hukum. Kesimpulannya, kekerasan anak akibat bullying umumnya tidak memenuhi unsur bela paksa sempurna, tetapi dapat menjadi alasan pemaaf karena tekanan psikis dan kelalain pihak sekolah. Penyelesaian perkara sebaiknya diarahkan pada restorative justice serta perbaikan sistem pengawasan di sekolah.

Abstract

The childfree phenomenon has triggered critical debates in contemporary Islamic family law and human rights discourses. This study examines the primary narrative constructions of childfree individuals as understood by young academics at State Islamic Higher Education Institutions in Indonesia. This study uses a qualitative approach, employing interviews and focus group discussions with 17 doctoral students from diverse academic backgrounds. Two theoretical frameworks were used: Halverson's Main Narrative Theory was employed to identify primary and alternative narratives in the formation of social meaning related to the childfree phenomenon. Maqāṣid al-sharī‘ah, as the objectives of Islamic law, is used to examine the religious dimension in the formation of contemporary Islamic family law. The research results revealed three narrative configurations. First, the narrative of individual piety, which views children as a divine trust and part of the maqāṣid al-sharī‘ah, specifically ḥifẓ al-naṣl (protection of lineage), perceives childless households as contrary to natural values and the objectives of marriage. Second, the narrative of human rights emphasises bodily autonomy and reproductive freedom for couples in accordance with international principles. Third, the integrative narrative arises from reflective academics who strive to balance individual piety with the principle of public benefit through a contextual approach to tanzīm al-nasl (family planning). This study contributes to Islamic family law policy in Indonesia by promoting more inclusive regulatory formulations and serves as a foundation for religious institutions and policymakers to develop contextual policies addressing contemporary issues.
