Abstract

This study examines the authority of the General Election Commission in supporting the voting rights of voters with disabilities during the 2018 Alor Regency Election. The General Election Commission effectively fulfilled its role through close coordination with ad hoc bodies and other stakeholders, focusing on improving accessibility at polling stations and conducting inclusive outreach programs. However, the Alor Regency General Election Commission faced various challenges in enhancing accessibility for voters with disabilities, including voter data changes, geographical conditions, and family attitudes toward individuals with disabilities. Additionally, internal challenges included a lack of understanding among Polling Station Working Group officers and limited resources. Despite these obstacles, the participation of voters with disabilities in the election was relatively satisfactory. These findings highlight the importance of continuous evaluation, capacity-building at the local level, and stronger support to ensure more inclusive elections in the future.

Abstract

This study examines the efforts of the General Election Commission of Manggarai Regency to increase voter turnout for the 2024 Election through fact-based legal strategies. Data were gathered via interviews and document analysis at the KPU Manggarai office. The study identified six key steps: (1) technological voter data management (WhatsApp, Sidalih); (2) inclusive registration (e-KTP access, Voting Rights Guard Post); (3) diverse socialization channels (Goes to School/Campus, social media, billboards); (4) political education targeting new voters, women, and persons with disabilities; (5) creative programs (e.g., Colour Run) and inter-institutional collaboration; and (6) accessible polling stations (facilities for the elderly and disabled, Braille templates). Despite these efforts, four main obstacles emerged: (a) limited human resources (Pantarlih competence); (b) infrastructure issues (road access, polling station shortages, weak electricity/network); (c) unbalanced budget allocation (only 0.35% or IDR 161 million for socialization out of IDR 45.3 billion); and (d) suboptimal participation (average 75.36%, below the 80% national target). Gaps between electoral districts (lowest in District 3: 73.39%) and minimal DPK/DPTb usage highlight persistent challenges related to geography, administration, and resource limitations.

Abstract

Penelitian ini berjudul: Fungsi Pemerintahan Kelurahan Waso Dan Bangka Leda Dalam Mendukung Pertumbuhan Ekonomi Dimasa Pandemik. Rumusan masalah dalam penelitian ini adalah 1) Bagaimanakah fungsi pemerintahan kelurahan dalam pembangunan daerah /kota pada era Covid-19 di Kelurahan Waso dan Bangka Leda Kecamatan Langke Rembong Kabupaten Manggarai?,2) Apa saja upaya dari pemerintah kelurahan Waso dan Kelurahan Bangka Leda dalam melaksanakan pembangunan di era pandemi COVID-19?. Tujuan penelitian adalah untuk menjelaskan 1) Fungsi pemerintahan kelurahan dalam pembangunan daerah /kota pada era Covid-19 di Kelurahan Waso dan Bangka Leda Kecamatan Langke Rembong Kabupaten Manggarai, 2) Upaya dari pemerintah kelurahan Waso dan Kelurahan Bangka Leda dalam melaksanakan pembangunan di era pandemi COVID-19. Jenis Penelitian yang digunakan adalah penelitian yang yuridis empiris. Sumber data yang digunakan adalah sumber data primer dan sekunder. Pendekatan yang digunakan adalah pendekatan sosio legal. Teknik pengumpulan data : wawancara, observasi, dan studi kepustakaan. Teknik analis data yang digunakan adalah kualitatif. Hasil dan Pembahasan : Pelaksanaan Tugas dan Fungsi Pemerintah Kelurahan dalam Pembangunan Daerah pada era Covid-19 di Kelurahan Waso dan Bangka Leda lebih berfokus pada pemenuhan kebutuhan dasar dari pemberdayaan masyarakat sedangkan pembangunan fisik selama masa pandemik untuk sementara dihentikan. Upaya dari Pemerintah Kelurahan Waso dan Bangka Leda dalam melaksanakan pembangunan Daerah di era Pandemic Virus Covid-19. Pada umumnya berfokus pada peningkatan kualitas dan akses terhadap pelayanan dasar khususnya dalam bidang kesehatan dan juga pengembangan ekonomi produktif.

Abstract

Pemilu merupakan pesta demokrasi yang digelar dalam periode tertentu Dalam penyelenggaraan agenda pemilu tersebut seringkali muncul persoalan dari pihak-pihak yang tidak puas atas keputusan yang disampaikan oleh penyelenggara pemilu atau sering disebut dengan sengketa pemilu (proses dan hasil). Tujuan penelitian ini untuk mengetahui dan menganalisis pengaturan kewenangan mahkamah konstitusi dalam penyelesaian sengketa pemilu di Indonesia serta dampak kewenangan mahkamah konstitusi dalam penyelesaian sengketa pemilu di Indonesia terhadap demokrasi di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif (library research) yang didukung oleh fakta empirik yang penulis dapatkan di lapangan, dengan menggunakan metode penelitian ini penulis mengkaji data-data,buku-buku serta peraturan perundang-undangan yang memiliki kaitan dengan isu yang penulis angkat. Hasil penelitian yang telah dilaksanakan yaitu Pengaturan kewenangan mahkamah konstitusi dalam penyelesaian sengketa pemilihan umum di Indonesia Mahkamah Konstitusi telah banyak memutus perkara tersebut, baik dalam perkara perselisihan hasil Pemilu Legislatif maupun Presiden. Pemilu merupakan cara yang ditentukan oleh konstitusi dan Undang-undang untuk memilih pejabat Negara, oleh karena itu hal penting yang fudamental dalam keberlangsungan pemerintahan seperti ini adalah sangat tepat apabila terjadi perselisihan hasil Pemilu diberikan kepada badan peradilan yang dibentuk khusus untuk mengawal Konstitusi. Dampak Kewenangan Mahkamah Konstitusi dalam Penyelesaian Sengketa Pemilihan Umum Terhadap demokrasi di Indonesia, didasarkan pada upaya membangun demokrasi (kedaulatan rakyat) dan nomokrasi (negara hukum) sekaligus sehingga setiap kebijakan negara yang dibuat atas nama rakyat haruslah sesuai dengan prinsip-prinsip hukum dan filosofi hukum yang mendasarinya hukum adalah legal policy atau garis (kebijakan) resmi tentang hukum yang akan diberlakukan baik dengan pembuatan hukum.

Abstract

Telah dilakukan studi dengan judul “Fungsi Pengawasan Badan Permusyawaratan Desa (BPD) Dalam Pembangunan Desa Studi Desa Golo Munde Kecamatan Elar Kabupeten Manggarai Timur Provinsi Nusa Tenggara Timur. Penelitian ini menggunakan metode penelitian yuridis empiris dengan tiga pendekatan yaitu pendekatan perundang-undangan, konseptual, dan Sosiologis Hukum (Socio Legal). Berdasarkan hasil wawancara, dapat disimpulkan bahwa Fungsi Pengawasan Badan Permusyawaratan Desa (BPD) Dalam Pembangunan Desa terdapat pandangan mengenai fungsi pengawasan BPD dalam Pembangunan Desa bawasanya fungsi pengawasan BPD terhadap pertanggungjawaban pembangunan desa harus lebih ditekankan pada kepatuhan kepala desa atas ketentuaan peraturan perundangan yang berlaku.kepala desa tidak boleh mengambil tindakan hanya berdasarkan kebijakan aatau kebaikan tanpa memperhatikan ketentuaan peratuaran perundangan-undngan yang berlaku. Bagi masyarakat banyak kasus kepala desa atau aparatur desa lainya di tempaat lain terjebak kasus korupsi bukan karena makan uang Desa tetapi disebakan oleh ketidakpatuhan terhadap ketentuaan peraturan yang berlaku.Dalam menjalankan fungsi pengawasan juga disebabkan oleh ketidakmampuan anggota BPD dalam memahami peranya sebagai anggta badan permusyawaratan desa.

Abstract

The Micro, Small and Medium Enterprises Tax is part of the tax category that has very promising potential in the revenue of the Rote Ndao Region. However, with the increasing number of Micro, Small and Medium Enterprises Weaving Ikat, there are various phenomena that have emerged, including micro, small and medium enterprises owners not fulfilling their obligations to register and pay taxes. Based on the observations of the author, the background of the subject matter can be formulated: (1) To what extent is the Legal Awareness Raising of Micro, Small and Medium Enterprises Weaving Ikat Against the Obligation to Pay Taxes in Rote Ndao District? (2) What are the Factors Inhibiting the Improvement of Legal Awareness of Micro, Small and Medium Enterprises Weaving Ikat Against the Obligation to Pay Taxes in Rote Ndao District?. To answer these problems, research is carried out using the Qualitative Descriptive Analysis Method in accordance with the data obtained while still paying attention to legal theories, principles and rules, so this research is a research sourced from primary, secondary, and tertiary data using an empirical juridical approach. The results of this study show: (1). Increasing Tax Law Awareness of micro, small and medium enterprises owners in Rote Ndao Regency is still minimal because there is still an unconsciousness of their obligations as taxpayers. (2) Factors that hinder the increase in legal awareness of Micro, Small and Medium Enterprises Weaving Ikat, namely due to the absence of Regional Regulations on taxpayers, lack of income earned by Micro, Small and Medium Enterprises actors, lack of knowledge and minimal understanding from taxpayers

Abstract

Public information disclosure is a principle underlying public access to information produced or owned by public bodies. In practical reality, although there are regulations and provisions governing public information disclosure, there are still many public bodies in East Nusa Tenggara that have not fulfilled their obligations to provide adequate information to the public. Therefore, the formulation of the problem in this study is how urgent is the public information disclosure in East Nusa Tenggara Province and how is the application of the principle of good governance in constitutional law to the urgency of public information disclosure in East Nusa Tenggara Province. This research is a Juridical-Normative research using Juridical-Normative analysis techniques. The results of the study show that the urgency of public information disclosure in East Nusa Tenggara Province is increasingly apparent, although the Public Information Openness Index score increased in 2023, the impact has not been significant on socio-economic improvements such as poverty rates and the Human Development Index (HDI). The principles of good governance, including transparency, accountability, and professionalism, are key to optimizing public information management. Challenges such as low professionalism in Regional Apparatus Organizations and lack of accountability need to be addressed through training, improving the monitoring system, adopting technology, and aligning local regulations with national standards. These efforts will support the creation of an effective, responsive, and participatory government in inclusive and sustainable development.

Abstract

Since 2020 until now, the world, including the City of Kupang, has been hit by the spread of corona virus disease 2019 which does not yet appear to be over and requires enormous attention and budget to carry out efforts to overcome it. The research in this thesis discusses the productivity of the supervisory performance of the Kupang City Regional People's Representative Assembly in dealing with corona virus disease 2019 in Kupang City.The method used by the author is a normative juridical research method using a case methodology. The findings of this research suggest that the Kupang City Regional Representative Council in carrying out its supervisory function, including in handling corona virus disease 2019 in Kupang City, continues to use its authority and function normatively, by tightening oversight so that all corona virus disease 2019 countermeasures policies in Kupang City can run as they should and can more effective in controlling the spread of corona virus disease 2019 in Kupang City.

Abstract

This study examines the role of village government in empowering communities through the ikat weaving program in Harubala, Gayak, and Nobo Villages (East Flores). Findings indicate a mismatch in policy implementation: Gayak and Nobo Villages provide budget support and form groups, despite not having specific Village Regulations, while Harubala does not make this program a priority in the RPJMDes/RKPDes. Several major inhibiting factors include: (1) The quality of human resources in village officials (most of whom have a high school education) who are inadequate in formulating policies, understanding regulations (e.g. HAKI), and providing support; (2) Marketing constraints (depending on the local market, lack of use of digital technology, and competition between villages); and (3) Inadequate infrastructure (no weaving houses and limited production tools). The impact of empowerment was only felt significantly in Gayak with an increase in women's income, while the program in Harubala and Nobo stagnated or stopped. To optimize the role of the village government, there needs to be strengthening of subsidiarity-based policies, increasing human resource capacity, providing strategic facilities, and integrating modern marketing so that cultural potential can be transformed into a sustainable economic basis.

Abstract

This study investigates the way the Social Service of Lembata Regency regulates and implements services for people living in poverty using a social law approach. The findings show that although six main programs, Health Insurance Contribution Assistance Beneficiaries, Family Hope Program, Non-Cash Food Assistance, Direct Cash Assistance, Regional Health Insurance, Indonesia Smart College Card, have been implemented in accordance with national provisions (Permensos 262/2022) and SK Kadinsos No. 25/2024 with a fairly large reach (for example: 88,287 National Health Insurance recipients), its effectiveness is hampered by various factors both internal and external. From the internal side, the challenges faced include: (1) the absence of a specific regulation to address poverty, (2) a definition of poverty that is not in accordance with the local context, (3) inaccuracy of DTKS data (overlapping, including residents who are well-off or have died), (4) limited budget (the Joint Business Group program has not been implemented), and (5) uneven distribution of assistance (one District Social Welfare Worker, serves two sub-districts). From the external side, the main challenges are the mindset of community dependency (aid is used for non-basic consumer goods), minimal awareness of independence, and lack of cooperation from the community. This study recommends a comprehensive approach: strengthening regional regulations, updating technology-based data collection systems, increasing allocations from the Regional Government Budget, and integrating assistance that focuses on behavioral change.
