Abstract

It is undeniable that there are various social conflicts in Indonesia which involve various groups of people such as the religious conflict in Poso (2001), in Sampit (2001), in Ambon (2002) and others. Most of them were caused by uncertain, unfair, and misused regulations on keeping people’s religious tolerance. It was also caused by the lack of people’s empowerment in keeping religious tolerance. This study aims to examine dalihan na tulo as a mechanism for resolving religious conflicts in the Mandailing community, North Sumatra. This research uses juridical empirical methods, consisting of anthropological and sociological law approaches. Data were collected by means of interviews and literature studies. The result of the research showed that Dalihan na Tolu tradition based-model of maintaining religious tolerance and resolving conflicts in religious believers was done by using the philosophy of Dalihan na Tolu, Pastak-pastakni Paradaton, Uhum dohot Patik and Tutur dohot Poda. There are three types of negotiation system in resolving the conflicts: Tahi Dalihan na Tolu, Tahi Godang Parsahutaon, and Tahi Godang Haruaya Mardomu Bulung (big negotiation among the neighboring villages). Anthropologically and sociologically that the Mandailing community has proven successful in using adat as a resolution of religious conflicts, so as to create peace and order as a function of law in society.

Abstract

Perkawinan adalah ikatan lahir batin antara seorang pria dengan seorang wanita yang bertujuan untuk membentuk keluarga (rumah Tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa, Pasal 1 Ayat (1) Undang-Undang No. 1 Tahun 1974 tentang Perkawinan. Bahwa salah satu tujuan dari suatu perkawinan adalah mempunyai keturunan (anak) yang dilahirkan dari seorang istri. Persolan yang timbul tentang kedudukan anak yang ibunya hamil duluan baru menikah. Berdasarkan Pasal 55 Ayat (1), Undang-Undang No. 1 Tahun 1974, Tentang Perkawinan. Bahwa bukti seorang anak yang sah hanya bisa dibuktikan dengan akta kelahiran yang berhubungan dengan ayah dari pada anak. Pengabdian Kepada Masyarakat ini dilaksanakan di Kelurahan Kwala Bekala Kecamatan Medan Johor Kota Medan. Mitra dalam kegiatan ini adalah ibu-ibu Persatuan Wirit Batak Islam (PWBI),yang dilaksanakan oleh Dosen / staf pengajar serta melibatkan mahasiswa/i Universitas Muslim Nusantara Al Washliyah. Pelaksanaan kegiatan ini berupa sosialisasi, tentang Pasal 55 Ayat (1) Undang-Undang No. 1 Tahun 1974 tentang Perkawinan, diskusi interaktif dan konsultasi hukum, yang diharapkan dapat menambah wawasan tentang hukum.

Abstract

Mitra consists of 271 heads of families out of 685 heads of families in Marindal-I Village who still own land with land ownership status in the form of a Certificate signed by the village head or in the form of a sale and purchase letter and others in the form of a Land Certificate signed by the Patumbak District Head. and several plots of inherited land in Marindal-I Village, it turns out that their ownership rights have not been divided by other heirs. As a result, some heirs cannot use the land certificate of the inherited land they are part of as collateral in borrowing money from the bank for business capital. Method of implementing assistance methods for communities who do not yet have a Certificate of Ownership Rights together with the Team with staff from the Marindal-I Village Head's office to take care of land registration and carry out training and assistance to the community and partners regarding procedures for registering land with the BPN Office as regulated in statutory regulations applicable. The results obtained were land registration at the Deli Serdang Regency BPN Office of as many as 43 families out of the 97 targeted, carrying out training in the process of managing and completing land registration files and forming Kelompok Masyarakat Pendaftar Tanah (KMPT) whose main task is to assist in the land registration process continuously and continuously.

Abstract

The main purpose of this research is to find a model of punishment in preventing social conflict on local wisdom of Dalihan na Tolu indigenous people. The questions posed in this research include the multi-dimension social conflict prevention model based on local wisdom of Indonesia, the deliberation stage of preventing such conflict and strategies adopted by local wisdom to resolve social conflict. The research further focuses its examination on local society that is Dalihan na Tolu indigenous people. This research uses empirical juridical research method, which is departed from local wisdom norms, or known as adat laws and examines the application of such laws in society. This research proposes that the multi-dimensional model of social conflict prevention should be carried out using the rules contained in: Dalihan na Tolu custom, Sipaingot, Pastak ni Paradaton, Uhum dohot Patik, Hapantunon, Tutur dohot Poda, Marga, Martahi, Mangupa. While the system and strategies of negotiation to reach consencus in preventing multi-dimensional social conflict based on the following norms: Tahi Ungut-ungut, Tahi Dalihan na Tolu, Tahi Godang Parsahutaon and Tahi Godang Haruaya Mardomu Bulung. It is argued that the punishment model usually used by Batak community should be adopted both in preventing as well as resolving social conflict exists in society.
