Abstract

Pemerintah telah mewajibkan pencatatan perkawinan bagi seluruh warga negara Indonesia yang telah melangsungkan perkawinan. Dengan adanya “kewajiban” pencatatan perkawinan tersebut apakah kewajiban tersebut setara dengan syarat dan rukun nikah yang telah ada sebelumnya di dalam ketentuan Agama Islam? Bila dikatakan tidak setara dengan rukun dan syarat nikah yang ada di Agama Islam, lantas bagaimana kedudukan pencatatan perkawinan dalam Hukum Islam dan Hukum Positif di Indonesia? Jenis penelitian ini merupakan penelitian hukum yuridis-normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Adapun bahan hukum yang digunakan bahan hukum primer dan bahan hukum sekunder dengan menggunakan analisis kepustakaan. Hasil penelitian ini yaitu: 1) kedudukan pencatatan perkawinan dalam hukum positif merupakan kewajiban administratif yang tidak dapat dijadikan sebagai syarat sah atau rukun perkawinan. 2) Di dalam Hukum Islam, pencatatan perkawinan harus dilakukan untuk mendapatkan keabsahan secara hukum (normatif-yuridis) akan tetapi bukan bagian syarat untuk mendapatkan keabsahan secara agama (normatif-teologis).Kata kunci: pencatatan perkawinan, hukum positif, hukum islam.

Abstract

In Indonesia, land regulations are regulated in the Basic Agrarian Law (UUPA) No. 5 of 1960, where the UUPA regulates the prohibition of land ownership rights for foreign citizens. The prohibition of ownership rights for foreign citizens is regulated in Article 21 of the UUPA, in accordance with one of the principles of agrarian law, namely the principle of nationality. This paper will examine the Denpasar District Court Decision Number 274 / Pdt.G / 2020 / PN Dps where there is ownership of land rights by foreign citizens. This study uses a normative legal research method with a statutory approach and an analytical approach. The technique of collecting legal materials through document studies, then the collected legal materials are analyzed using descriptive techniques equipped with a qualitative approach. The results of this study are that the Notarial Deed containing the transfer of land ownership rights from Indonesian citizens to foreign citizens is null and void and for this the Notary can be held accountable.

Abstract

Cyber threats are a big challenge for Indonesia along with the development of digital technology and dependence on cyberspace. This article aims to analyze the relationship between cyber threats and digital national defense and the role of national awareness in strengthening state resilience. This qualitative research with a literature analysis shows that Indonesia faces major challenges in digital resilience, such as low digital literacy, inadequate infrastructure, and limited experts in the field of cybersecurity. In conclusion, collaboration between the government, the private sector, and the community as well as increased digital literacy is needed to strengthen Indonesia's cyber resilience.

Abstract

This study examines the overburdening of the Constitutional Court (MK) due to the high volume of regional head election (pilkada) disputes, which has led to case backlogs, reduced legal efficiency, and increased state expenditures. Although institutions like Bawaslu and PTUN also have authority to resolve these disputes, many cases are submitted directly to MK, bypassing other mechanisms. Using a normative juridical method that includes legal analysis, historical context, comparative law, and case studies, the research evaluates previous dispute resolution practices and proposes a digitalization-based reform. Key challenges identified include procedural inefficiencies, high costs, and a lack of institutional coordination. The current system is viewed as suboptimal, with many disputes producing outcomes that fail to satisfy parties involved. To address these issues, the study proposes a digital platform aimed at streamlining the resolution process through integrated case registration, document submission, and inter-agency coordination. This system would reduce MK’s caseload, cut operational costs, and enhance transparency and accountability via real-time monitoring. By reinforcing the roles of Bawaslu and PTUN, the platform could help redistribute dispute resolution authority more effectively. The study concludes that digital transformation offers a viable solution to improve the efficiency, fairness, and cost-effectiveness of pilkada dispute resolution in Indonesia.

Abstract

Kegiatan Pengabdian Kepada Masyarakat (PKM) yang dilakukan di SMK Negeri 14 Medan bertujuan untuk meningkatkan literasi Hak atas Kekayaan Intelektual (HaKI) di kalangan siswa sebagai upaya membangun budaya inovasi yang sadar hukum di lingkungan pendidikan vokasi. Berdasarkan observasi awal dan wawancara, ditemukan bahwa mayoritas siswa belum memahami konsep dasar HaKI dan belum pernah mendapatkan pelatihan terkait perlindungan karya. Melalui pendekatan edukatif berbasis kebutuhan, kegiatan ini menyelenggarakan sosialisasi interaktif, studi kasus, dan simulasi pendaftaran HaKI yang mampu mengubah persepsi siswa terhadap pentingnya perlindungan hukum atas karya orisinal. Selain itu, kegiatan ini juga mendorong partisipasi aktif pihak sekolah dalam merencanakan pembentukan Unit HaKI Sekolah sebagai bentuk keberlanjutan program. Hasil menunjukkan adanya peningkatan kesadaran siswa terhadap pentingnya HaKI dalam kehidupan akademik dan profesional mereka. PKM ini membuktikan bahwa pendidikan hukum dalam bentuk yang aplikatif dapat diterima dengan baik oleh siswa SMK dan memberikan dampak positif terhadap sikap serta pemahaman mereka terhadap nilai-nilai orisinalitas dan legalitas karya.

Abstract

The application of chemical castration punishment for sexual predators is an appropriate policy to protect children from sexual predators in Indonesia, as formulated in Article 81 and Article 81A of Government Regulation in Lieu of Law Number 1 Year 2016 on the Second Amendment to Law Number 23 Year 2002 on Child Protection.  It is hoped that this policy can reduce the number of sexual violence that occurs in children. But there are polemics about the punishment, including; various groups think that castration punishment has violated human rights, the absence of technical instructions to perform chemical castration, to the rejection of the Indonesian Doctors Association (IDI) to become the executor of chemical castration because it is contrary to the medical code of ethics. This research has two problem formulations, namely; I) Why does the Government of Indonesia apply chemical castration punishment for sexual predators? II) How is the human rights perspective on chemical castration punishment? This research is a normative research with secondary data sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Using data collection techniques with literature study and interviews. While data analysis uses qualitative analysis so that this form of research is evaluative research. The approaches taken are conceptual approach, legislative approach, and historical approach. The purpose of this research, namely; I) to explain more deeply the development of child protection policies in Indonesia until the implementation of chemical castration punishment. II) to explain further about human rights perspective towards chemical castration punishment. Finally, it concludes that: I) The implementation of chemical castration punishment by the Government of Indonesia is an effort to reduce the number of sexual violence against children. II) Chemical castration punishment in Indonesia is in accordance with the spirit of human rights in Indonesia. Because it can protect the human rights of children who range to be harmed.

Abstract

This study examines the interaction between Islamic values and Batak traditions in the business practices of Muslim entrepreneurs in North Sumatra, focusing on haminjon (frankincense), which holds both spiritual and economic significance for Batak society. Unlike previous research that rarely explores the integration of religion and custom in trade, this study employs a qualitative ethnographic approach. Fieldwork was conducted over three months (April–June 2025) in Doloksanggul and Balige, involving seven participants: three Batak Muslim entrepreneurs, two haminjon traders, one customary leader, and one local ustaz. Data were collected through interviews, observations, and document analysis, and examined using thematic coding to identify negotiation patterns between adat and Islam. The findings indicate that Islamization in this context does not occur through doctrinal enforcement but rather through moral diplomacy, ethical conduct, and everyday commercial practices. Muslim entrepreneurs continue to uphold kinship ties and customary obligations, while reinterpreting them through Islamic principles such as honesty, justice, rejection of usury, and social responsibility. Within this process, haminjon serves as both a cultural and economic bridge, shifting from a ritual object into a symbol of halal trade and moral integrity. Theoretically, this study proposes a contextual model of Islamic business ethics rooted in local values yet adaptable to cultural pluralism. Practically, it underscores trade as a medium of Islamization, showing that the integration of religion and tradition occurs through productive reinterpretation that strengthens collective identity and supports sustainable development.

Abstract

Diskursus hukum keuangan kian beragam. Sangat disesalkan tidak diikuti oleh alternatif yang relevan untuk menyelesaikan problem keuangan negara tersebut. Belum lagi peraturan perundang-undangan dan kebijakan yang mengatur keuangan negara di Indonesia cenderung mengabaikan doktrin badan hukum. Terkhusus badan hukum perdata yang memiliki orientasi bisnis. Sehingga menimbulkan perasaan tidak nyaman (insecure feeling) untuk memajukan bisnis yang mengakar (deep rooted business practice) yang dicita-citakan menjadi sokoguru bagi kemajuan perekonomian nasional. Konsekuensinya, konsep keuangan negara menjadi tidak rasional sebab peraturan perundang-undangan dan kebijakan yang dibangun tidak sehaluan dengan teori hukum yang seharusnya. Metode yang digunakan adalah penelitian hukum normatif, dengan metode pendekatan yuridis normatif yaitu penelitian yang dilakukan terhadap data yang bersifat sekunder dengan mempelajari dan mengkaji asas-asas hukum peraturan perundang-undangan. Urgensi penelitian ini adalah untuk mengetahui resiko dari perluasan lingkup keuangan Negara dan memberikan manfaat pada pemerintah dalam melaksanakan pengelolaan keuangan negara. Kesimpulan dari penelitian ini adalah kewenangan yang dilakukan oleh Badan Pemeriksa Keuangan untuk memeriksa Badan Usaha Milik Negara bertentangan dengan konsep Badan hukum. Sebab Undang-Undang Badan Usaha Milik Negara telah mengatur yang berhak untuk memeriksa laporan tahunan Persero adalah auditor eksternal yang ditetapkan oleh Rapat Umum Pemegang Saham.

Abstract

The massive floods in Sumatra in 2025–2026 resulted in significant loss of life and economic damage, driven by a combination of extreme weather and environmental degradation linked to business activities. This situation underscores that disaster management is not solely the responsibility of government, but also of the private sector. In Indonesian business law, Corporate Social Responsibility (CSR) constitutes a legal obligation for companies to address the social and environmental impacts of their operations. Therefore, strengthening CSR is crucial as an instrument for sustainable flood mitigation and recovery. This study aims to analyze the role and position of CSR in flood management in Sumatra, to reinforce CSR policies so they contribute more effectively to prevention and mitigation, and to examine corporate accountability when CSR is not optimally implemented, leading to environmental damage and increased flood risk. This research adopts a normative legal method with a descriptive-analytical approach, using statutory and case-based analysis. The data consist of secondary sources, including primary, secondary, and tertiary legal materials, collected through literature and document review and analyzed qualitatively. CSR in flood management functions as a strategic legal instrument for environmental prevention and recovery. Its optimization is essential to strengthen environmental protection and the resilience of flood-prone areas. CSR must shift from a charitable approach to a risk- and sustainability-based framework integrated with environmental and disaster law. Stronger ESG regulation, oversight, and reporting are necessary. Corporate accountability for suboptimal CSR includes administrative, civil, and criminal sanctions, alongside governance and reputational consequences, grounded in precautionary and polluter-pays principles.

Abstract

Cash waqf (wakaf uang) represents a significant Islamic philanthropic instrument with considerable potential for productive economic empowerment and poverty alleviation. Despite an estimated national potential exceeding IDR 180 trillion annually, actual realization remains below 1% due to complex structural barriers. This study aims to analyze the strategic role of cash waqf in productive economic empowerment while identifying key constraints and optimization strategies within a maqashid syariah framework. Employing a qualitative descriptive-analytical systematic literature review, the research reviewed legislation, fatwas, institutional reports, and peer-reviewed articles published between 2015–2025. Findings reveal three principal results: (1) cash waqf possesses a robust legal foundation through Law No. 41 of 2004 and MUI Fatwa No. 2 of 2002, yet a significant implementation gap persists between legal norms and field practice; (2) primary constraints are systemic and interrelated, encompassing low public literacy, weak nadzir capacity, insufficient fiscal incentives, and digitalization deficits; and (3) effective optimization requires an integrated ecosystem approach comprising governance strengthening, digital platform development, and cross-sectoral institutional synergy. The novelty of this study lies in its integration of legal, institutional, technological, and literacy dimensions within a single unified analytical framework grounded in maqashid syariah — an approach not yet comprehensively undertaken in prior literature. The principal contribution is the formulation of an operational maqashid syariah-based cash waqf governance model relevant to the Indonesian context, alongside systemic policy recommendations actionable by key stakeholders.
