Abstract

Cempaka is a strategic place for drivers to stop and rest because Cempaka has the potential of distinctive local products that attract drivers to stop and rest. But, this is not supported by adequate facilities. Drivers who stop by can only rest for a limited time with limited facilities. However, not a few drivers who force themselves to rest for a long time in food stalls, mosques or minimarkets, resulting in long queues and forcing visitors to park their vehicles on the shoulder of the road because of limited parking space. This is what underlies the planning of the rest area in Cempaka, with the concept of an integrated rest area, which makes this rest area integrated with the development of the existing potential in Cempaka.

Abstract

This research aims to examine law enforcement against business actors who cause water pollution in Cianjur Regency. Today's rapid development has a negative impact on the environment. Liquid waste from industry and domestic is the main cause of water pollution, which threatens the quality of water used as a source of daily needs. This research uses a normative juridical approach and descriptive analysis method. Data is obtained through literature studies by searching for primary materials and supported by secondary materials. The impacts of water pollution by business actors include: a decrease in the quality of water resources, public health problems, and losses for farmers. The implementation of law enforcement against business actors is faced with several obstacles, including the lack of awareness of the importance of the environment and the lack of effective criminal sanctions. To maintain the right to a good and healthy environment, serious environmental protection and management as well as strict law enforcement are required by all parties concerned. Obstacles in law enforcement against business actors who commit water pollution include non-optimal environmental protection and management, violations of existing regulations, and obstacles in the waste filtration process. Therefore, decisive action is needed in law enforcement, including operational requirements, waste treatment, and more effective supervision to control and prevent water pollution in Cianjur Regency.

Abstract

The massive growth of financial technology-based online lending services in Indonesia has given rise to a serious legal problem, namely the practice of hidden cost imposed upon consumers without prior adequate disclosure of fee information. This study aims to analyze the legal framework governing cost transparency in online loan agreements, to identify the factual forms of hidden cost practices, and to examine the legal protection available to consumers under Law Number 8 of 1999 on Consumer Protection. The normative juridical method with descriptive-analytical specification was employed, with primary legal materials comprising the Consumer Protection Law, the Civil Code, and OJK Regulation Number 10/POJK.05/2022. The findings indicate that cost transparency regulations are normatively available; however, the absence of an explicit definition of hidden cost in POJK 10/2022 creates a normative gap that enables providers to claim formal compliance without fulfilling the substantive requirements of transparency. Hidden cost practices manifest in three forms: administrative fee deductions from disbursed funds without prior notice, imposition of disproportionate service fees, and progressive late payment penalties whose calculation mechanisms are not disclosed from the outset of the agreement all of which violate Article 18 of the Consumer Protection Law and potentially undermine the free consent requirement under Article 1320 of the Civil Code. Legal protection operates through a preventive channel in the form of transparency obligations and a repressive channel comprising clause nullification and compensation liability; however, its effectiveness will only be optimal when provider substantive compliance, non-merely-formal OJK supervision, and consumer legal awareness operate simultaneously and sustainably.

Abstract

The national energy transition toward renewable sources represents a strategic response to mounting ecological crises and high dependence on fossil fuels that negatively impact environmental sustainability. Indonesia holds substantial renewable energy potential; however, its realization remains constrained by various legal and institutional challenges. Normative aspects concerning energy and environmental protection are governed by Law Number 30 of 2007 on Energy and Law Number 32 of 2009 on Environmental Protection and Management. Nevertheless, the implementation of both regulations has not been fully effective due to inconsistencies among legal products, weak enforcement mechanisms, and inadequate supporting policies. This study employs a normative juridical approach with a descriptive-analytical character, drawing on regulatory reviews, environmental law theories, and sustainable development concepts. The findings indicate that green energy advancement in Indonesia is not yet undderpinned by an integrated and effectively functioning legal system. Moreover, the application of fundamental environmental law principles, including the precautionary principle, prevention principle, and sustainability, remains suboptimal. Therefore, regulatory synchronization, strengthened law enforcement capacity, and more responsive policy formulation are required to promote genuinely sustainable green energy development, provide legal certainty, and ensure environmental protection along with improved public

Abstract

Illegal logging in conservation areas constitutes a serious forestry crime that causes environmental degradation, biodiversity loss, and significant ecological and economic damage. Gunung Gede Pangrango National Park plays a strategic role in maintaining ecosystem balance and protecting biological natural resources; however, illegal logging activities continue to occur due to economic pressures, weak supervision, and limited public legal awareness. This study aims to analyze the implementation of law enforcement against perpetrators of illegal logging in conservation areas, identify obstacles encountered by law enforcement authorities, and examine conservation protection efforts based on Law Number 18 of 2013 concerning the Prevention and Eradication of Forest Destruction. The research employed a sociological-juridical method with descriptive-analytical specifications through normative and empirical approaches. Data were collected through library research, analysis of legislation, legal literature, and relevant court decisions. The findings indicate that law enforcement has been implemented through investigation, prosecution, and the imposition of criminal sanctions in accordance with applicable laws. Nevertheless, its effectiveness remains constrained by the limited number of forestry officers, extensive monitoring areas, low levels of legal awareness among local communities, and economic factors affecting residents surrounding forest regions. The study implies that stronger, integrated, and sustainable law enforcement measures, accompanied by community participation and preventive conservation policies, are essential to deter forest crimes and ensure the long-term preservation of conservation areas and environmental sustainability.

Abstract

Claim rejections in the provision of agricultural insurance often give rise to legal issues as they lie at the intersection of the contractual insurance legal regime and consumer protection law. Most previous studies have focused on purely contractual aspects, leaving a gap in how the position of farmers is assessed within this dual legal regime. This situation has the potential to create legal uncertainty for farmers as policyholders. This study aims to analyze the legal status of farmers as consumers within the legal framework of agricultural insurance and to examine the liability of insurance providers for claim rejections from a consumer protection perspective. This study employs normative legal research, using a statutory and conceptual approach. Legal materials were obtained through a literature review of legislation, expert doctrine, and relevant legal literature. The results of the study indicate that farmers in agricultural insurance can be classified as consumers of financial services who are entitled to legal protection, particularly regarding information transparency, contractual fairness, and dispute resolution. Claim rejections cannot be based solely on a formal interpretation of policy clauses, but must take into account the principles of good faith and balance. If a claim is rejected without valid grounds, the insurer may be held liable under breach-of-contract or tort principles. The focus of this research lies in reconstructing the insurer’s legal liability, which is not based solely on contract law but is integrated with consumer protection instruments. Therefore, regulatory harmonization between insurance law and consumer protection is required to strengthen legal certainty, justice, and the benefits of the law in the administration of agricultural insurance.

Abstract

Sexual violence and bullying in schools are serious and complex issues that negatively affect students’ psychological, social, and academic well-being. A learning environment that should serve as a safe and nurturing space can become harmful if these issues are not addressed appropriately. This community service program, conducted at SMA 1 Pasundan Cianjur, aims to introduce and integrate local Sundanese wisdom values such as silih asih (mutual affection), silih asah (mutual learning), and silih asuh (mutual care) as a cultural approach to preventing sexual violence and bullying in schools. The activities were carried out through seminars and interactive discussions involving students, teachers, and school staff. Data were collected through direct observation and feedback from seminar participants. The results indicate that the majority of students are aware of bullying practices in their school environment, and some reported having experienced or felt concerned about potential incidents of sexual violence or bullying. This program successfully raised awareness of the importance of cultural values as a foundation for character education and child protection within the educational setting. Moving forward, the integration of local wisdom is expected to become part of a sustainable preventive strategy to create a safe, inclusive, and culturally rooted school environment.
