The increasing number of street children will certainly affect the number of crimes committed considering the harshness of street life and the bad friendship environment can make a child who has never been faced with the law becomes a child who is dealing with the law. So in this case it is necessary to protect the law for street children. So that the main problem in this research is what are the factors that dominate a child being a street child in the Post-Natural Disaster Post Wolf Area, and how is the Model for Handling Street Children Post-Natural Disasters through an Innovation System Based on Family Empowerment. Abstract

The principle of legality is the main joint in criminal law. This is because the principle of legality relates to the rights and obligations of the community that have the potential to be subject to criminal law. Abstract

The existence of two opinions, especially capital punishment, has given rise to controversy over regulating the death penalty as a legal instrument for dealing with corruption. Some agree with the imposition of capital punishment, and some question the justification for this sentence, which does not give the perpetrators of criminal acts the opportunity to improve to become good human beings. The death penalty for corruption cases has never been imposed, so the death penalty cannot be used as an ultimum remedium against perpetrators of corruption. Regarding the severity of the main sentence to be charged, a maximum limit for each crime has been determined. In contrast, a specific minimum limit is not specified, but a general minimum limit, for example, imprisonment and a minimum of one day's confinement. This type of research is carried out using a normative approach, namely by analyzing problems through legal principles and referring to legal norms contained in statutory regulations. The results of the study show the need for amendments to the Law on the Eradication of Corruption Crimes by formulating the death penalty for all acts of corruption without particular criteria, such as disaster situations, due to their significant impact on society, the nation, and the State, so that it becomes the ultimum remedium. The need for judges to impose severe criminal sanctions to create a deterrent effect for corruptors and other people who have the opportunity to commit corruption to become reluctant or afraid to commit acts that violate the Law because the criminal sanctions are severe.

Abstract

This study examines the fulfillment of the sexual needs of married prisoners through an integrative framework combining Human Rights principles and maqāṣid al-syarī‘ah. Using Class IIA Palu Penitentiary as a case study, it analyzes the legal, institutional, and socio-cultural factors contributing to the absence of policies regulating the maintenance of lawful marital relationships within the Indonesian correctional system. This research employed a qualitative socio-legal approach. Empirical data were collected through in-depth interviews with married prisoners and correctional officers, field observations, and analysis of relevant legal documents and correctional regulations. The empirical findings were integrated with normative legal analysis based on Human Rights principles and the maqāṣid al-syarī‘ah framework. The study reveals that neither Indonesian correctional regulations nor Class IIA Palu Penitentiary provides explicit legal or institutional mechanisms for fulfilling the sexual needs of married prisoners. This regulatory gap is shaped by the absence of specific legal provisions, institutional constraints, security considerations, and prevailing socio-cultural perspectives. The findings further demonstrate that maintaining lawful marital relationships contributes to protecting human dignity, preserving family integrity, and supporting prisoners' psychological well-being, provided that any future policy is implemented proportionately and remains consistent with correctional objectives, institutional security, and applicable legal principles. This study is limited to a single correctional institution; therefore, its findings cannot be generalized to all Indonesian prisons. Nevertheless, it provides a conceptual foundation for developing correctional policies that accommodate family relationship maintenance while balancing prisoners' fundamental rights, rehabilitation, institutional security, and public interests. This study contributes to the literature by integrating Human Rights principles and maqāṣid al-syarī‘ah within a socio-legal framework to examine the fulfillment of married prisoners' sexual needs in Indonesia. It proposes an Integrated Family Relationship Maintenance Framework to strengthen family preservation, human dignity, and rehabilitation within the Indonesian correctional system.

Abstract

Introduction: Handling Domestic Violence through restorative justice raises the issue of the balance between case resolution, victim protection, and prevention of repeated violence. This issue is important to study in law enforcement practice at the police level. Purposes of the Research: This study aims to analyze the mechanism of implementing restorative justice in handling domestic violence crimes in the Sigi Resort Police and identify obstacles to its implementation, especially related to victim protection and volunteerism. Methods of the Research: The research uses empirical legal methods with a qualitative approach. Data were obtained through interviews and documentation related to the handling of Domestic Violence cases at the Sigi Police Station. The analysis was carried out in a descriptive-analytical manner by linking field findings and the legal framework of restorative justice. Findings of the Research: The results of the study show that the application of restorative justice includes the receipt of reports, preliminary examinations, case feasibility assessments, mediation, and the preparation of peace agreements. The research also identified challenges in the form of psychological distress, victims' economic dependence, and the need for supervision of voluntariness in the peace process. These findings show the importance of more measurable victim protection mechanisms and supervision of the implementation of agreements. In conclusion, this study contributes to the study of the implementation of restorative justice by emphasizing the need for a balance between case resolution, perpetrator responsibility, and victim safety in handling Domestic Violence.

Abstract

Prisoners retain the right to fulfill their sexual needs with their spouses during imprisonment, however, Indonesia has yet to establish regulations that facilitate the exercise of this right. Although many scholars advocate addressing this issue from a human rights perspective, empirical research remains limited. Therefore, this study examines the fulfillment of prisoners’ sexual rights through a human rights framework. Employing a qualitative case study design with a juridical-empirical legal approach, data were collected through field observations, in-depth interviews, and analysis of legal documents. The findings reveal that prisoners’ right to sexual relations with their spouses has not been realized because prisons lack the necessary regulations and implementation mechanisms. Furthermore, national legislation does not provide standard operating procedures for fulfilling prisoners’ sexual rights. The study concludes that ensuring the fulfillment of prisoners’ sexual needs at Palu Prison requires a human right–based policy framework. As a practical contribution, it proposes the establishment of a Safe Counseling and Relationship Zone, a dedicated facility integrating psychological and marital counseling with a hygienic, private, and dignified space where prisoners and their spouses may maintain intimate relationships within an appropriate legal and institutional framework.
