Abstract

This research examines religion and humanity from the perspective of the value of diversity referring to Surah al-Hujurat verse 13. A multicultural Indonesian society consisting of ethnic, cultural and religious aspects will have logical consequences for an attitude of understanding and respecting differences. So that diversity is seen as a necessity in all aspects of life without having to cause conflict. In the Qur'an, especially in Surah al-Hujurat verse 13, we find a portrait of a multicultural society as the embodiment of the symbol of Bhinneka Tunggal Ika. In this research, the method used is a literature study with technical data analysis in the form of analytical descriptive. The findings of this research are values reflected in the opinions of the mufassir, namely the value of syumuliyyah, the value of kafa'ah and the value of tasamuh. These three values should be internalized and implemented in realizing the spirit of religion in the context of national and state life.

Abstract

The provisions for prayer times have been determined based on the instructions contained in the Qur'an and Sunnah. The Prophet gave an example of starting a prayer time based on the shadow of an object perpendicular to the sun's position relative to the earth. For example, the midday prayer is set when the sun is at its culmination. This shows that the determination of the start of the prayer time is based on the observation of the sun which must be in a certain position for each prayer time. These provisions are transformed into a set of mathematical formulas based on ongoing astronomical observations. In subsequent developments, this prayer schedule will not only be in hard copy form but also in the form of a website and Android application. Several Android applications display the starting schedule for prayers in a place that is different from the others. Every android application that displays prayer times should refer to the initial provisions of the times stipulated in the Shari'a and Fiqh, not limited to mere calculations, nor is there an API which is a common reference for program developers. There needs to be a unified standard calculation system for the android application for prayer times. It is also necessary to make a standard API and Indonesian standards in accordance with the fiqh provisions for the start of prayer times set in Indonesia.

Abstract

Abstrak. Kewajiban dakwah di maknai sebagai kewajiban melaksanakan khuruj oleh anggota jama’ah tabligh, namun disisi lain, pelaksanakan khuruj dapat berdampak pada ditinggalkannya kewajiban sebagai kepala keluarga untuk sementara waktu dan mengorbankan sebagian harta dan waktu yang seharusnya digunakan untuk menafkahi Keluarga.  Penelitian ini bertujuan untuk mengetahui bagaimana pandangan Jamaah Tabligh di Desa Cisaranten Endah Kecamatan Arcamanik Kota Bandung terhadap pemberian nafkah kepada keluarga selama masa khuruj, dan bagaimana prakteknya di desa tersebut, serta menganalisnya dari perspektif fiqih munakahat.  Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus, data dikumpulkan melalui lembar kuisioner.  Hasil penelitian memperlihatkan bahwa secara umum, Keluarga naggota menilai tidak ada masalah dari segi pemberian nafkah dalam praktek khuruj, namun penulis menemukan beberapa permasalahan Keluarga anggota jama’ah tabligh yang dipicu oleh praktek khuruj tersebut.  Berdasarkan analisis fiqih munakahat dengan pendekatan maqashid al-shari’ah dapat disimpulkan bahwa khuruj sejalan dengan tujuan syariat (hifz al diin) namun harus dengan melihat situasi dan kondisi kesiapan yang berhubungan dengan niat, bekal, fisik dan keluarga yang akan ditinggal, menjadi pertimbangan utama dan wajib sebelum melakukan khuruj. Abstract. The obligation of dakwah is interpreted as the obligation to perform khuruj by the members of Jama’ah Tabligh. However, on the other hand, the implementation of khuruj can impact the temporary abandonment of family responsibilities as the head of the household, sacrificing part of the wealth and time that should be used to provide for the family. This study aims to understand the views of Jama'ah Tabligh in Desa Cisaranten Endah, Arcamanik District, Bandung City, regarding the provision of family sustenance during khuruj, and how this is practiced in the village, analyzed from the perspective of fiqh munakahat. This research uses a qualitative method with a case study approach, collecting data through questionnaires and observation sheets. The results show that, in general, families of members consider there to be no issues with the provision of sustenance during khuruj practice. However, the author found some problems faced by the families of Jama’ah Tabligh members triggered by the practice of khuruj. Based on the analysis of fiqh munakahat with the maqashid al-shari’ah approach, it can be concluded that khuruj aligns with the objectives of sharia (hifz al diin), but the situation and readiness conditions related to intention, provisions, physical readiness, and the family left behind must be the main considerations and obligations before performing khuruj.

Abstract

Abstrak. Dalam aturan yang berlaku, seseorang yang mewakafkan harus melakukan pencatatan dan pendaftaran aset wakaf. Namun masyarakat Islam di Indonesia dalam proses penyerahan wakaf oleh wakif masih cenderung atas dasar saling percaya dan secara lisan saja tanpa adanya proses pencatatan. Maka dari itu penulis tertarik untuk meneliti dan mengungkap bagaimana praktik perwakafan yang terjadi di DKM Thoriqotul Hikmah desa Negla dalam Perspektif Hukum Islam dan Undang-Undang Wakaf. Metode penelitian yang diterapkan adalah kualitatif dengan pendekatan yuridis normatif. Data primer mencakup bahan hukum primer seperti undang-undang, peraturan pemerintah, Kitab Hukum Islam (KHI) Alquran dan Hadis. Data Hukum sekunder berupa buku, jurnal maupun literatur lainnya yang berkaitan dengan wakaf, sementara data hukum tersier berupa Kamus Besar Bahasa Indonesia. Berdasarkan hasil penelitian, dalam hukum Islam perwakafan di DKM Thoriqotul Hikmah sudah sesuai dengan hukum Islam dimana rukun dan syarat sudah terpenuhi, namun dari segi prosedurnya masih terdapat kekurangan karena seluruh aset wakaf belum tercatat secara resmi. Kemudian dalam UU Wakaf, Praktik perwakafan yang terjadi di DKM Thoriqotul Hikmah belum sepenuhnya mematuhi ketentuan, yaitu dalam mekanismenya perwakafan aset wakaf tidak dicatatkan sesuai ketentuan yang berlaku, yaitu dalam UU Wakaf No 41 Tahun 2004 Pasal  69 ayat (2) dan Pasal 11. Abstract. In the applicable rules, a person who gives waqf must record and register waqf assets. However, the Islamic community in Indonesia in the process of handing over waqf by waqf still tends to be based on mutual trust and only verbally without a recording process. Therefore, the author is interested in researching and revealing how the practice of waqf that occurs in DKM Thoriqotul Hikmah Negla village in the Perspective of Islamic Law and Waqf Law. The research method applied is qualitative with a normative juridical approach. Primary data includes primary legal materials such as laws, government regulations, Islamic Law Books (KHI) of the Qur'an and Hadith. Secondary legal data is in the form of books, journals and other literature related to waqf, while tertiary legal data is in the form of the Great Dictionary of Indonesian Language. Based on the results of the research, in Islamic law, waqf at DKM Thoriqotul Hikmah is in accordance with Islamic law where the harmony and conditions have been met, but in terms of procedures there are still shortcomings because all waqf assets have not been officially recorded. Then in the Waqf Law, the practice of waqf that occurs at DKM Thoriqotul Hikmah has not fully complied with the provisions, namely in the mechanism waqf assets are not recorded in accordance with the applicable provisions, namely in the Waqf Law No. 41 of 2004 Article 69 paragraph (2) and Article 11.

Abstract

Abstract. Indonesia is a country based on law, in various fields, especially in marriage, where the majority adhere to the Islamic religion. Even though various institutions and laws have been established that regulate marriage, underage marriages in the modern era still often occur in various regions in Indonesia. For this reason, outreach is needed to prevent and reduce child marriage. This research aims to determine several factors behind the occurrence of underage marriages in the Bandung Kulon District KUA as well as the role of Bandung Kulon District KUA counselors in preventing underage marriages. This research uses qualitative research methods with an empirical juridical research approach. This research has the conclusion that underage marriages in the KUA of Bandung Kulon District in 2021-2022 are among the highest in the city of Bandung based on the data that researchers found. Factors that cause underage marriages to occur are lack of socialization of marriage laws, differences in understanding among the public regarding the age limit for marriage according to Islam and law, educational factors, parental factors, economic factors, arranged marriage factors, customary and cultural factors and other factors. the child's own wishes. The impacts of underage marriage include negative impacts and positive impacts. The role of KUA counselors is to provide outreach to prospective brides and grooms who are getting married to build a good household, love each other and prioritize deliberation if they encounter problems. This guidance takes the form of outreach or coming directly by attending invitations and providing counseling to the community. Marriage law regarding marriage age limits, the correct reproductive system and dangers and collaborating with local village youth leaders or village officials or other agencies. Abstrak. Indonesia adalah negara yang berlandaskan hukum, diberbagai bidang terutama dalam pernikahan yang mayoritas menganut agama Islam. Meski telah terbentuk berbagai lembaga serta Undang-undang yang mengatur tentang pernikahan, namun pernikahan dibawah umur pada era modern sekarang masih banyak terjadi di berbagai daerah di Indonesia. Penelitian ini memiliki Tujuan yaitu untuk mengetahui beberapa faktor yang melatar belakangi terjadinya pernikahan dibawah umur di KUA Kecamatan Cibeunying Kidul serta peran penyuluhan KUA Kecamatan Cibeunying Kidul terhadap pencegahan pernikahan dibawah umur. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan penelitian yuridis empiris, penelitian ini memiliki kesimpulan yaitu pernikahan dibawah umur di KUA Kecamatan Cibeunying Kidul taun 2021-2022 termasuk paling tinggi di Kota Bandung berdasarkan data penelitian yang ditemukan. Faktor penyebab terjadinya pernikahan dibawah umur tersebut adalah Kurangnya Sosialisasi Undang- Undang pernikahan, Bedanya pemahaman dengan masyarakat tentang batasan usia menikah menurut agama Islam dan Undang-Undang, Faktor Pendidikan, Faktor orang tua, Faktor Ekonomi, Faktor perjodohan, Faktor adat dan Budaya dan Faktor kemauan anak itu sendiri. Dampak dari pernikahan dibawah umur, diantaranya dampak negatif dan dampak positif. Adapun penyuluhan KUA adalah melakukan sosialisasi kepada calon mempelai yang akan menikah untuk membina keluarga rumah tangga yang baik, saling menyayangi dan mengedepankan musyawarah jika mendapati masalah, bimbingan tersebut berupa sosialisasi atau datang secara langsung dengan menghadiri undangan dan menghadiri penyuluhan kepada masyarakat. Undang-Undang pernikahan mengenai batasan usia nikah tentang sistem reproduksi yang benar serta bahaya dan bekerja sama dengan tokoh pemuda desa setempat atau toko desa maupun instansinya.

Abstract

Abstract. Revitalization of KUA is an effort to strengthen the role of KUA not only through improving physical facilities but also improving the quality of human resources and services. This step is an important strategy that must be carried out together so that every service provided to the community is the best. Based on these problems, the purpose of this study is to determine the implementation of KUA revitalization at KUA Ciawigebang District, Kuningan Regency and to determine the impact of the implementation of KUA revitalization on the performance and services of employees at KUA Ciawigebang, Kuningan Regency. The research method used is descriptive analytical with a normative legal approach and data collection techniques are carried out through documentation studies and interviews with the Head of KUA and Employees at KUA Ciawigebang. The results of the study indicate that the Implementation of KUA Revitalization carried out at KUA Ciawigebang requires strengthening in terms of Legal Substance, Legal Structure and Legal Culture so that reform at KUA Ciawigebang can be achieved effectively, improve service quality, and strengthen the role of KUA Ciawigebang as an institution that is relevant and responsive to community needs, and the KUA Revitalization carried out aims to make KUA Ciawigebang more modern, responsive, and professional in serving the community and is able to provide an impact on high-quality services that support welfare and religious life in the community. Abstrak. Revitalisasi KUA merupakan upaya untuk memperkuat peran KUA yang tidak hanya melalui perbaikan fasilitas fisik tetapi juga peningkatan kualitas sumber daya manusia dan layanan. Langkah ini merupakan strategi penting yang harus dijalankan bersama agar setiap layanan yang diberikan kepada masyarakat menjadi yang terbaik. Berdasarkan permasalah tersebut, maka tujuan dari penelitian ini adalah untuk mengetahui pelaksanaan revitalisasi KUA di KUA Kecamatan Ciawigebang Kabupaten Kuningan dan untuk mengetahui dampak pelaksanaan revitalisasi KUA terhadap kinerja dan pelayanan para pegawai di KUA Ciawigebang Kabupaten Kuningan. Metode penelitian yang digunakan adalah deskriptif analitis dengan pendekatan yuridis noormatif dan teknik pengambilan data dilakukaan melalui studi dokumentasi dan wawancara dengan Kepala KUA dan Jajaran Pegawai di KUA Ciawigebang. Hasil penelitian menunjukkan bahwa Pelaksanaan Revitaslisasi KUA yang yang dilaksanakan di KUA Ciawigebang membutuhkan penguatan dari aspek Substansi Hukum, Struktur Hukum dan Budaya Hukum agar reformasi di KUA Ciawigebang dapat tercapai dengan efektif, meningkatkan kualitas layanan, dan memperkuat peran KUA Ciawigebang sebagai lembaga yang relevan dan responsif terhadap kebutuhan masyarakat, dan Revitalisasi KUA yang dilaksanakan tersebut bertujuan untuk menjadikan KUA Ciawigebang lebih modern, responsif, dan profesional dalam melayani masyarakat serta mampu memberikan dampak terhadap layanan berkualitas tinggi yang mendukung kesejahteraan dan kehidupan beragama di masyarakat.

Abstract

Abstract. As a form of worship to get closer to Allah SWT related to property, waqf is very beneficial. There are waqf land assets located in Centeng Village, Cihanjuang Village, Parongpong District, West Bandung Regency, which in its management is carried out by nazhir which is not in accordance with its obligations. So that nazhir as a manager of waqf assets has a role in the management of waqf assets. With that, the performance of the nazhir in managing waqf assets will determine the quality and quantity of the utilization of waqf assets. This study uses a normative juridical approach with a type of qualitative research, data collected by means of interviews and literature studies. Based on the results of the research, the performance of the nazhir towards its duties and obligations is not fulfilled due to the lack of knowledge about the duties of a nazhir, the lack of knowledge about the importance of waqf recording, and the lack of socialization by PPAIW or the government to the community. In Islamic law, the management carried out by the nazhir in Centeng Village, Cihanjuang Village, Parongpong District, West Bandung Regency is not in accordance with Islamic law where the nazhir does not carry out his responsibilities to carry out his duties properly by managing waqf land assets such as not doing records. Then in the Waqf Law, the management carried out by nazhir in Centeng Village, Cihanjuang Village, Parongpong District, West Bandung Regency is not in accordance with what is stated in Law Article 11 No.41 of 2004 concerning waqf. Abstrak. Indonesia adalah negara yang berlandaskan hukum, diberbagai bidang terutama dalam Sebagai salah satu bentuk ibadah untuk mendekatkan diri kepada Allah SWT yang berkaitan dengan harta benda menjadikan wakaf sangat besar manfaatnya. Ada aset tanah wakaf yang terdapat di Kampung Centeng Desa Cihanjuang Kecamatan Parongpong Kabupaten Bandung barat yang mana dalam pengelolaannya yang dilakukan oleh nazhir yang tidak sesuai dengan kewajibannya. Sehingga nazhir sebagai pengelola aset wakaf memiliki peran dalam pengelolaan aset wakaf. Dengan itu kinerja nazhir dalam mengelola aset wakaf akan menentukan kualitas dan kuantitas pemanfaatan aset wakaf. Penelitian ini menggunakan pendekatan yuridis normatif dengan jenis penelitian kualitatif, data yang dikumpulkan dengan cara wawancara dan studi pustaka. Berdasarkan hasil penelitian, kinerja nazhir terhadap tugas dan kewajibannya tidak terpenuhi karena kurangnya pengetahuan akan tugas seorang nazhir, kurangnya pengetahuan tentang pentingnya pencatatan wakaf, dan kurangnya sosialisasi oleh PPAIW ataupun pemerintah kepada masyarakat. Dalam hukum Islam pengelolaan yang dilakukan nazhir di Kampung Centeng Desa Cihanjuang Kecamatan Parongpong Kabupaten Bandung barat tidak sesuai dengan hukum Islam dimana nazhir tidak melakukan tanggung jawab untuk menjalankan tugasnya dengan baik dengan cara mengelola aset tanah wakaf seperti tidak melakukan pencatatan . Kemudian dalam UU Wakaf, pengelolaan yang dilakukan nazhir di Kampung Centeng Desa Cihanjuang Kecamatan Parongpong Kabupaten Bandung barat tidak sesuai dengan apa yang di sebutkan dalam UU Pasal 11 No.41 Tahun 2004 tentang wakaf.

Abstract

Kaidah-kaidah fikih merupakan kaidah hukum yang berisfat menyeluruh yang mencakup semua bagian-bagiannya. Terdapat lima kaidah fikih asasi yang disepakati, salah satunya yaitu al-‘adat al-muhakkamah (adat itu bisa menjadi dasar dalam menetapkan suatu hukum) yang diambil dari kebiasaan-kebiasaan baik yang tumbuh dan berkembang di dalam masyarakat sehingga dapat dijadikan dasar dalam menetapkan suatu hukum sesuai dengan nilai-nilai yang berkembang di dalam masyarakat. Dengan menguasai kaidah-kaidah fiqh kita akan mengetahui benang merah yang menguasai fikih, karenanya menjadi titik temu dari masalah-masalah fikih, dan lebih arif di dalam menerapkan fikih dalam waktu dan tempat yang berbeda untuk kasus, adat kebiasaan, keadaan yang berlainan. Kaidah fikih asasi kelima adalah tentang adat atau kebiasaan, dalam bahasa Arab terdapat dua istilah yang berkenaan dengan kebiasaan yaitu al-‘adat dan al-‘urf. Adat adalah suatu perbuatan atau perkataan yang terus menerus dilakukan oleh manusia lantaran dapat diterima akal dan secara kontinyu manusia mau mengulanginya. Sedangkan ‘Urf ialah sesuatu perbuatan atau perkataan dimana jiwa merasakan suatu ketenangan dalam mengerjakannya karena sudah sejalan dengan logika dan dapat diterima oleh watak kemanusiaannya dalam berbabagi kebiasaan termasuk dalam bermuamalah. Kendati, demikian adat –istiadat atau kebiasaan yang dapat dilegitimasi oleh syariat adalah adat-istiada yang shahih, bukan yang fasid.

This study aims to ascertain and evaluate the processes followed by national and Islamic law to recover waqf assets following a calamity. The 1945 Constitution, Law No. 41 of 2004 on Waqf, and other regulations are among the key legal data sources used in this qualitative study employing a normative juridical method from the viewpoint of Islamic law, which is derived from the Quran, the Hadith, and the views of relevant scholars. Periodicals and other pertinent articles are examples of secondary legal sources. Next, using descriptive analytic techniques, the data was gathered through library research and examined to determine the synchronization stage and compliance with legal norms and principles. The study's findings demonstrate that waqf assets—such as damaged land and buildings—can be recovered. In Islamic law, as long as there is no proof of someone's ownership, the assets return to the state. This is almost the same as positive law in Indonesia, namely if the affected waqf assets are destroyed or damaged and previously had a waqf certificate, efforts can be made to identify the waqf assets, and if important files related to the waqf are lost, you can contact BPN to get a copy, but if the assets are destroyed according to the UUPA the land returns to the state. Financing can be done by optimizing the funding of cash waqf and cash waqf for efforts to repair and rebuild these assets.
