Abstract

Green Procurement constitutes a strategic policy to support sustainable development; however, in practice, its implementation in Indonesia remains largely confined to the tendering stage. In fact, procurement contracts serve as a legal instrument that ensures sustainability is genuinely realized. This article examines the integration of green principles into contracts through performance clauses, life-cycle costing, incentive mechanisms, and enforceable sanctions. The study identifies existing regulatory gaps and weak implementation, while at the same time proposing a contractual framework that is more operational, measurable, and capable of generating tangible impacts on the environment, the economy, and society.

Abstract

This study examines two central issues concerning coastal women in cases of marine environmental destruction in East Aceh: (1) how environmental criminal law normatively constructs women as perpetrators, and (2) how law enforcement can incorporate substantive and restorative justice principles. Using a normative juridical method supported by analysis of legislation and judicial practice, the research finds that although the Environmental Protection and Management Law formally requires proof of fault (mens rea) for individuals, its application often remains formalistic and result-oriented. The law does not adequately differentiate between primary actors and structurally vulnerable participants, leading to the disproportionate criminalization of coastal women. The study argues that achieving genuine environmental justice requires a contextual and gender-sensitive approach, including proportional assessment of culpability and the selective application of restorative justice mechanisms. Legal reform is therefore necessary to align environmental protection with substantive justice and gender equality principles in coastal communities.

Abstract

This research analyzes the practices of marine resource exploitation in the coastal area of East Aceh from the perspective of Islamic commercial law, focusing on a review of fiqh muamalah and ecological ethics. East Aceh, as a coastal area with significant marine potential, faces various problems of excessive exploitation such as the use of trawl nets, overfishing, and degradation of mangrove ecosystems. This study aims to assess the conformity of marine resource management practices with the principles of Islamic law, analyze the impact of excessive exploitation on maqashid sharia, and formulate a sustainable management framework based on Islamic values. The research method used is qualitative with a library research approach, analyzing Islamic legal literature, scientific journals, and related policy documents. The research findings indicate that the practice of exploiting marine resources in East Aceh contradicts the principles of fiqh muamalah such as la darar wa la dirar (not causing harm), the prohibition of israf (wastefulness), and the concept of amanah in resource management. From the perspective of Islamic ecological ethics, these practices violate the principle of mizan (balance), hifz al-bi'ah (environmental preservation) as part of maqashid sharia, as well as the responsibility of khalifah fi al-ardh. The conclusion of the research emphasizes the need for a transformation in the management of marine resources that integrates the principles of Islamic law with sustainable practices, through the application of a sharia economic system, the development of a halal value chain, and strengthening the role of Islamic institutions in education and supervision.

Abstract

Post-disaster recovery of educational infrastructure and clean water services requires collaborative and adaptive environmental governance to ecological damage. This community service aims to analyze and formulate a post-disaster environmental governance model in the recovery of educational infrastructure and clean water at MAN 1 Aceh Tamiang after flash floods and landslides. The community service uses a qualitative approach with a case study design. Data were obtained through observation, semi-structured interviews, documentation, online news, and social media related to school rehabilitation and clean water services. Data analysis was conducted using the Miles, Huberman, and Saldaña model through the stages of data reduction, data presentation, and thematic conclusion drawing. The results of the community service show that the recovery of schools and clean water services was carried out through the involvement of various actors, such as the community, volunteers, schools, local governments, and technical service providers. Rehabilitation included cleaning up approximately one meter of mud, restoring classrooms, rehabilitating sanitation facilities, repairing water supply lines, drilled wells, and traditional ring wells. The observation results found that the existence of physical infrastructure does not guarantee the functioning of services if it is not supported by integrated and responsive rehabilitation governance. Based on these findings, this Community Service Program proposes a collaborative environmental governance model that emphasizes intersectoral coordination, community participation, resilient clean water services, and strengthening post-disaster educational resilience. This model is expected to serve as a strategic approach to basic infrastructure rehabilitation in disaster-prone areas.
