Abstract

Drinking khamr (liquor) is an offence under the Criminal Act (Qanun Jinayat) in Aceh and Brunei Darussalam. This paper aims at comparing the law relating to khamr in both jurisdictions. The study was made through content analysis using comparative approach. It is found that both in Aceh and Brunei Darussalam, drinking khamr is subjected to penalty in the form of whipping not exceeding 40 times. The sentence that was adopted from Shariah to be imposed within a trial held by the Shariah Court. Beside similarity, there are some differences especially in relation to the applicability, enforcement and proceedings. The law on khamr in Aceh as stipulated in its Qanun Jinayat is enforced by the Shariah Judge, while the prosecution of drinking khamr in Brunei Darussalam requires the role of prosecutor. Abstract

The fingerprint is one of the technologies that can be used to identify a person. Even today, the fingerprint is a technology that is considered quite reliable because it is proven to be relatively accurate, safe, and comfortable to use as identification when compared to other biometric systems. This study aims to determine the legal strength of fingerprint-proof in the process of investigating a criminal act of theft based on the Criminal Procedure Code. This research uses empirical normative research with a statute approach. The results showed that. The fingerprint-proof system does not require witnesses, because, in terms of proof of fingerprint identification, the minimum provisions for proving the two pieces of evidence should be fulfilled by the existence of a certificate regarding the fingerprint, documentary evidence plus a statement from a dactyloscopy expert as one of the legal evidence. One of the obstacles faced by investigators when they are at the crime scene to collect/find evidence of fingerprints is if the place of the incident has changed its authenticity or is contaminated. Efforts are made by investigators to work around this by seeking the police or investigating officers to immediately be alert and responsive in receiving public reports about the existence of a crime.

Abstract

Keadilan sosial merupakan tanggung jawab negara dalam pencapaiannya bagi seluruh rakyat Indonesia. Sila keadilan sosial adalah melaksanakan tujuan negara yaitu mewujudkan tata masyarakat Indonesia yang adil dan makmur, sehat dan sejahtera berdasarkan Pancasila, dalam Pasal 28 UUD 1945 menyatakan “setiap orang berhak hidup sejahtera lahir dan batin, bertempat tinggal dan mendapatkan lingkungan hidup yang baik dan sehat”. Namun, demikian persoalan utama terkait adalah tidak jelas batas tanggungjawab sehingga sulit menentukan ruang lingkup tanggung jawab negara sebagaimana yang ditegaskan dalam UUD 1945, sedangkan masyarakat yang hidup di daerah eksploitasi khusus di Aceh tetap hidup dalam kemiskinan. Tujuan penelitian ini adalah untuk mengetahui bentuk keadilan sosial dalam pengelolaan lingkungan hidup dan untuk mengetahui perwujudan keadilaan sosial dalam pengelolaan lingkungan hidup di Aceh. Ruang lingkup tanggung jawab kurang jelas sedangkan masyarakat yang hidup di daerah eksploitasi khusus di Aceh tetap hidup dalam kemiskinan, kesehatan kurang terjamin, sarana kesehatan kurang memadai. Pengembangan ekonomi masyarakat setempat melalui CSR dengan melibatkan masyarakat adat yang lebih faham tentang struktur perkembangan, potensi, SDM masyarakat setempat, sedangkan pengembangan lingkungan yang baik dan sehat dikelola langsung oleh perusahaan dengan memperhatikan kondisi masyarakat.

Abstract

Green Procurement constitutes a strategic policy to support sustainable development; however, in practice, its implementation in Indonesia remains largely confined to the tendering stage. In fact, procurement contracts serve as a legal instrument that ensures sustainability is genuinely realized. This article examines the integration of green principles into contracts through performance clauses, life-cycle costing, incentive mechanisms, and enforceable sanctions. The study identifies existing regulatory gaps and weak implementation, while at the same time proposing a contractual framework that is more operational, measurable, and capable of generating tangible impacts on the environment, the economy, and society.
