Abstract

Article 32 paragraph (1) letter k Election Commission Regulation No. 15 Year 2013 describes implementers, participants, and officials are prohibited from mobilizing campaigns Indonesian citizens who do not meet syarats as Voters. However, Law No. 8 of 2012 on General Election of DPR, DPD and DPRD itself, does not expressly prohibit the mobilization of Indonesian citizens who do not yet qualify as a selector or exploitation of children in political activities, including campaign. So that the Commission regulation violates the hierarchy of legislation that is in of commencement shall contrary to the Law on Election of Members of Legislative as higher regulations. Therefore, it is also not in line with Law No. 35 of 2014 on the Amendment of Act No. 23 of 2002 on Child Protection. Mobilization of children in the activities of the election campaign is the deprivation of the rights of the child. Intentionally or unintentionally, the actual implementers, participants, and campaign officers have done wrong treatment (exploitation) by mobilizing children who do not qualify as voters in political activities in the activities of the election campaign for the DPR, DPD and DPRD held at central and regional levels occur in almost all parts of Indonesia.

Abstract

Drinking khamr (liquor) is an offence under the Criminal Act (Qanun Jinayat) in Aceh and Brunei Darussalam. This paper aims at comparing the law relating to khamr in both jurisdictions. The study was made through content analysis using comparative approach. It is found that both in Aceh and Brunei Darussalam, drinking khamr is subjected to penalty in the form of whipping not exceeding 40 times. The sentence that was adopted from Shariah to be imposed within a trial held by the Shariah Court. Beside similarity, there are some differences especially in relation to the applicability, enforcement and proceedings. The law on khamr in Aceh as stipulated in its Qanun Jinayat is enforced by the Shariah Judge, while the prosecution of drinking khamr in Brunei Darussalam requires the role of prosecutor. Abstract

Berdasarkan Pasal 20 Peraturan Pemerintah Nomor 9 Tahun 1975 yang merupakan Peraturan Pelaksana Undang-Undang Nomor  1 Tahun 1974 Tentang Perkawinan, jika terjadi perceraian wajib digugat melalui Pengadilan wilayah domisili tergugat. Namun pada kenyataannya Mahkamah Syar’iyah Lhokseumawe memeriksa perkara Nomor 302/Pdt.G/2022/MS.Lsm memutuskan perkara tersebut tanpa memperhatikan ketentuan Pasal 20 ayat (1) Peraturan Pemerintah Nomor 9 Tahun 1975. Penelitian ini menggunakan metode penelitian hukum normatif atau penelitian perpustakaan ini merupakan penelitian yang mengkaji studi dokumen, yakni menggunakan berbagai data sekunder seperti peraturan perundang-undangan, keputusan pengadilan, teori hukum, dan dapat berupa pendapat para sarjana. Hasil penelitian menunjukkan bahwa Penerapan Pasal 20 ayat (1) Peraturan Pemerintah Nomor 9 Tahun 1975 tidak dilakukan dalam Perkara Nomor 302/Pdt.G/2022/MS.LSM. Penyebab Tidak dipertimbangkan Ketentuan Pasal 20 ayat (1) Peraturan Pemerintah Nomor 9 Tahun 1975 hakim berpendapat gugatan dapat diterima karena ketentuan Pasal 73 ayat (1) UU No. 7 Tahun 1989.

Abstract

This study aims to analyze the implications of regulating zakat as a source of local own-source revenue and as a factor in reducing income tax payable in Law Number 11 of 2006 concerning the Aceh Government. These two norms complement each other and are implemented simultaneously; thus, state revenue from taxes does not decrease. It means that zakat as a deduction from income tax is covered by zakat as a source of local own-source revenue. However, the regulation for zakat as a deduction from income tax cannot be enforced due to regulatory synchronization reasons. This study is normative legal research using a statutory and regulatory approach. The data described is normative data such as laws, qanuns and other legal regulations.  This study concludes that the regulation of zakat as regional original income incorporates zakat into the state financial governance system managed by Baitul Mal. There are several consequences arising from the issue. Zakat deposited into the Regional Treasury is recorded by the Regional General Treasurer in a separate account whose designation is Sharia-related. Crimes related to Zakat cannot be classified as ordinary embezzlement crimes but as acts of corruption. These discrepancies in norms lead to legal ambiguity, which, in turn, infringes upon the hierarchy of laws and regulations, disrupting the legal order. To address this issue, a vertical harmonization process is necessary, involving the revision of the Aceh Qanun about Baitul Mal.

Abstract

Akibat perkembangan zaman, hukum adat laot telah banyak dikesampingkan keberadaannya. Masyarakat nelayan telah sering melanggar hukum adat laut. Sehingga telah mengabaikan kearifan lokal yang seharusnya dipertahankan. Revitalisasi hukum adat laot terhadap masyarakat nelayan dalam penangkapan ikan di laot Kabupaten Aceh Timur harus dilakukan untuk mencegah hilangnya nilai-nilai sebagai kearifan lokal yang ada pada masyarakat nelayan. Oleh karena itu yang perlu dilakukan adalah meningkatkan peran Panglima Laot, peran Pemerintah Daerah setempat untuk mendukung pelaksanaan hukum adat laut dan pengelolaan perikanan, kesadaran masyarakat nelayan untuk mempertahankan hukum adat laot sebagai ciri khas kearifan lokal. Abstract

The existence of kenduri laot in fishing communities in East Aceh Regency as an implementation of laot customs and customary law. Kenduri laot is a traditional ceremony with the concept of friendship based on Islamic law. Kenduri laot is held every year. Kenduri laot is a ceremony before the east or west season ends. However, the current implementation of the kenduri laot in East Aceh Regency is uncertain and has been neglected. So it is carried out every year or every three years or the time is uncertain. The Lhok Panglima Laot who is in charge of implementing, maintaining and supervising the implementation of Laot customs and customary law only provides customary sanctions of warning and advice regarding the laot kenduri to be implemented every year. The obstacle to implementing the kenduri laot is that the fishing community deliberately ignores and puts aside the kenduri laot. Efforts made are to hold deliberations between the District/Lhok Panglima Laot and the fishing community to discuss and preserve the local wisdom of implementing the kenduri laot every year. Then determine sanctions for those who violate the prohibition from going to sea for several days and/or confiscation of fishing catches

Abstract

Green economy atau ekonomi hijau menekankan pembangunan yang berkelanjutan secara ekologis, inklusif secara sosial, dan berkeadilan secara ekonomi. Dalam konteks masyarakat pesisir Aceh, nilai budaya dan hukum adat memiliki kontribusi penting terhadap pengelolaan sumber daya alam secara berkelanjutan. Namun, transformasi sosial dan tekanan eksternal mengancam keberlanjutan praktik-praktik lokal tersebut. Penelitian ini menggunakan pendekatan normatif-kualitatif dengan analisis literatur, studi regulasi, dan dokumentasi praktik hukum adat laut masyarakat Aceh. Fokus utama diarahkan pada identifikasi nilai-nilai budaya dan norma hukum adat yang sejalan dengan prinsip-prinsip green economy. Data dianalisis secara deskriptif-kritis untuk menggambarkan peran, tantangan, dan potensi integrasi hukum adat dalam sistem ekonomi hijau. Temuan menunjukkan bahwa hukum adat laut, khususnya melalui peran Panglima Laot, telah mengatur pelestarian sumber daya laut melalui larangan alat tangkap destruktif, pengaturan musim tangkap, dan distribusi hasil laut yang adil. Nilai-nilai budaya seperti kolektivitas, tanggung jawab ekologis, dan kesederhanaan mendukung praktik ekonomi rendah emisi dan berbasis komunitas. Namun demikian, belum adanya pengakuan formal secara menyeluruh dan lemahnya regenerasi kelembagaan menjadi tantangan serius. Nilai budaya dan hukum adat terbukti memberikan kontribusi signifikan terhadap praktik green economy, terutama dalam dimensi ekologis, ekonomi komunitas, dan penguatan kelembagaan lokal. Pengakuan formal, revitalisasi nilai lokal, dan integrasi kelembagaan menjadi kunci memperkuat hukum adat sebagai fondasi pembangunan pesisir yang berkelanjutan.

Abstract

The aim of this study is to build legally and socially independent Panglima laot and fisher community groups to resolve adat laot issues through adat laot courts, and to increase community empowerment in the area of services in social conflicts in fishing communities. Panglima laot lhok Idi Rayeuk in Alue Dua Muka O village in resolving disputes between fishermen and violations of customary maritime law, where there is still confusion in its application. The existing guidelines for customary courts in Aceh are considered to be very general and only discuss gampong customary courts. Meanwhile, the laot customary court has not yet specified its implementation mechanism. The Laot Customary Court and the Gampong Customary Court have different resolutions, and the customary institutions that resolve them are also different. So that it has the potential to conflict with positive law and tends to be neglected and protracted in handling. This is due to the lack of understanding of the Panglima Laot Lhok of the laot customary judicial process. The activity methods used were (1) observation, advice and discussion; (2) training and mentoring; and (3) activity evaluation. The results of the activities showed that the education and training provided in relation to Laot customary justice resulted in changes in the attitudes and knowledge of the target audience (partner group) of Panglima Laot Lhok and fishing communities towards the implementation and structuring of Laot customary justice as a means of seeking justice in resolving Laot customary disputes. This training has also provided an understanding of the rule of law as a foundation, the benefits as an alternative to solving problems with the aim of peace (win-win solution), the implementation process to achieve common goals of justice and order

Abstract

Pengabdian kepada masyarakat ini dilaksanakan di Desa Matang Seping, dilatarbelakangi karena masyarakat dalam melakukan sewa menyewa, gadai, utang-piutang atau kerja sama lainnya terkait dengan pengarapan lahan pertanian dilakukan secara lisan, dan tidak adanya saksi. Masyarakat tidak paham bahwa aktifitas yang ditulis dan adanya saksi dapat memperjelas masalah yang terjadi dan sebagai bukti yang meyakinkan untuk menyelesaikan masalah tersebut, baik melalui prosedur peradilan adat maupun pengadilan negeri. Tujuan pengabdian kepada masyarakat untuk membangun kelompok masyarakat petani agar mampu secara mandiri membuat perjanjian tertulis sebagai alat bukti untuk mencegah dan penyelesaian sengketa perdata yang terjadi di masyarakat. Metode kegiatan pengabdian kepada masyarakat yaitu  penyuluhan dan pelatihan, melakukan demonstrasi atau percontohan untuk menghasilkan keterampilan membuat perjanjian. Hasil pengabdian kepada masyarakat,  telah menambah wawasan tentang hukum perjanjian dan telah mampu secara mandiri membuat perjanjian tertulis. Selain itu telah memberikan solusi dengan harapan dapat merubah kebiasaan masyarakat desa Matang Seping, melakukan perjanjian lisan tanpa disertai saksi dalam penggarapan lahan pertanian. Menjadi kebiasaan perjanjian lisan atau tulisan disertai disertai alat bukti yang sah lainnya sesuai hokum yang berlaku yang memiliki kekuatan hokum yang kuat.
