Abstract

Indonesia menjadi salah satu negara yang marak terjadi tindakan korupsi khususnya pada instansi pemerintah maupun swasta, adapun banyak motif yang dilakukan oleh pelaku. Pada perkembangan mengenai korupsi, adanya permakluman yang selama ini dilakukan oleh berbagai pihak yang melakukan pemberantasan. Salah satu korupsi yang terjadi yaitu di LPD Desa Adat Ped Nusa Penida, pelaku melakukan tindakan untuk memperkaya dirinya sendiri. Adapun yang akan dibahas penulis dalam penelitian ini yaitu mengenai sanksi pemidanaan yang diberikan untuk pelaku dan pertimbangan hakim dalam menjatuhkan sanksi tindak pidana korupsi yang telah dilakukan pengurus LPD sesuai Putusan Nomor 37/Pid.Sus-TPK/2021/PN.DPS. Penulis dalam hal ini menggunakan penelitian hukum normatif. Sanksi yang diberikan kepada terdakwa (pelaku) yang diberikan oleh hakim yaitu pidana penjara selama 4 (empat) tahun dan 9 (sembilan) bulan serta pidana denda sebesar Rp.250.000.000,- (dua ratus lima puluh juta rupiah). Hakim dalam pertimbangan nya menghukum terdakwa (pelaku) tidak saja pidana pokok akan tetapi juga terdakwa harus memberikan penggantian uang secara tanggung renteng sebesar Rp.4.345.315.060,- (empat miliar tiga ratus empat puluh lima juta tiga ratus lima belas ribu enam puluh rupiah).

Abstract

The potential for spiritual tourism in Bali, especially in the Gianyar district, is very high, bearing in mind that the traditions and culture of most people in Bali have never been separated from the concept of tri hita karana. Gianyar as one of the regional cultural icons with very thick customs. Spirituality as a community identity is still preserved and passed down from generation to generation from ancestors to the present day. Since the last two decades, the need for spiritual tourism has been increasingly in demand by foreign and domestic tourists. Melukat is a symbol of the Balinese ritual system which is believed to invoke safety, health, welfare and cleanse the body and spirit so that humans can purify themselves to carry out their daily activities peacefully and peacefully. The tourist attraction of melukat has not been specifically regulated in local regulations. Bali Province No. 5 of 2020 concerning Standards for Implementing Balinese Cultural Tourism. If spiritual tourism is not managed properly by local village managers, these destinations can easily be damaged and polluted by tourists who do not understand the sacred meaning of these destinations. Therefore the specific target of this research is to see how the regulation regarding melukat spiritual tourism as a research method used is an empirical research method to find out if there are gaps that occur in the application of these regional regulations in the field. While the problem approach used, namely the statutory approach, conceptual approach, analytic approach. The results of the research show that the development of the spiritual tourism attraction of Melukat has not been optimally implemented in several places because there is no adequate information on the history, functions, program of annual ritual activities at the Melukat DTW, as well as provisions and entry ticket categories for foreign, domestic, and student tourists. and researchers who can be accessed online through a special spiritual DTW website.

Abstract

Community Service as stated in the Higher Education Tri Dharma, is an activity that aims to help the community in several activities without expecting any kind of imbalance. In community service for the 2023 academic year, we from the UNWAR PKM Team provided assistance to young and old group farmers with Bulan Bali/PT Daun Kayu Suji in making a cooperation agreement. We are from UNWAR PKM Team, in carrying out this community service, found problems in business cooperation between farmers and Bulan Bali/ PT Daun Kayu Suji namely: 1. Parties do not understand the existence of a standard agreement as an agreement in business relations in accordance with the provisions of the law. 2. All this time the parties are in a business relationship, loyalty only relies on self-confidence and according to conscience. Based on the problems mentioned this PKM have some objective that are as a form of the Lecturer's dedication to the community, provide opportunities for lecturers to carry out direct service with partners to the target object, improving cooperative relations between universities and the community and/or companies that employ employees. The method that used in this PKM namely, directly meet partners to see directly the workplace situation at the Bali Moon company, discuss with the parties who will make a work agreement, the PKM implementation team can apply the methods used to carry out socialization and legal counseling regarding agreements.

Abstract

In community service for the 2024 academic year, we from the PKM UNWAR Team provided assistance to the community and traditional artists in Pangkung Karung Gede Village, Kerambitan District, Tabanan Regency, in terms of obtaining intellectual works in the form of art and culture owned by communal communities or also known as Traditional Cultural Expressions. One of the Traditional Cultural Expressions is the Sanghyang Memedi Dance of Pangkung Karung Gede Traditional Village, Tabanan Regency. Over time the dance began to be forgotten because it was included in the category of sacred dance in Balinese customs and culture, so it could only be danced at certain times. In this community service, where the community wants legal assistance in recording Copyright for Sanghyang Memedi Dance in Pangkung Karung Gede Traditional Village, Tabanan Regency has not been implemented, this is due to the lack of legal understanding of the community and cultural factors of the community who still consider recording to be of little benefit. We from the PKM UNWAR Team, in carrying out this community service, found that the problem is that the knowledge and ability of human resources in an effort to inventory traditional cultural expressions in the Pangkung Karung Gede Traditional Village is not optimal. Based on the above problems, we, from PKM UNWAR, are determined to provide assistance to the parties in making a cooperation agreement to avoid unwanted things in the future, so that cooperation can be carried out properly.

Abstract

Legal aid for the Indonesian people must be provided equally in accordance with the mandate of the 1945 Constitution of the Republic of Indonesia and the principles of equality before the law and the right to be represented by a lawyer, which are fundamental human rights. This right must be provided fairly, including to those who are less fortunate. For the less fortunate, this right is the responsibility of the state, which provides legal aid free of charge (Prodeo). The issue in society is the lack of awareness about their right to receive free legal aid (Prodeo) from the government. Additionally, the public is also unaware that legal organizations also have the duty to provide legal aid to the community. The legal education program conducted by the Warmadewa University Community Service Team aims to increase legal awareness regarding free legal aid and the procedures for obtaining this right, using methods such as lectures and question-and-answer discussions. This program is expected to enhance public knowledge so that individuals facing legal issues can be assisted by lawyers in resolving the legal problems they encounter.
