Abstract

Bali as a province with strong customs also has several binding customary laws. The status of ulayat land still lacks legal protection. There are still many villagers who do not take care of the temple land or in the status of their ulayat land which is legal. This study aims to determine the existence of pelaba pura customary land as communal land in the village of Tampaksiring, Gianyar district by law of agrarian law and to analyze the implementation of the legal position of the pelaba pura land in Tampaksiring Village, Gianyar Regency. This study uses empirical legal research with a statutory approach. The source of law is primary legal materials, namely using legal materials that are studied using specifically applicable regulations, while secondary legal materials are based on literature, articles, journals and related to problems. The results showed that the process of resolving the land certification of pelaba pura land in Tampaksiring Village, Gianyar Regency was by using the customary offense sanction, namely by fencing the land according to the results of the customary paruman that had been implemented. Finally, the land was voluntarily handed back to the temple. The legal position of the temple's pelaba land in Tampaksiring Village is an important matter that must be considered because there are still many suspected cases that have occurred in Balinese society, especially in Tampaksiring Village. In land disputes, the temples in Tampaksiring refer to customary law where the sanctions imposed on land certifiers are sanctions that have been agreed upon and regulated in local customary law.

Abstract

Public welfare is an effort made by the government which aims to improve the welfare of the community through social services and has a broad scope. The outbreak of the covid-19 virus in Indonesia resulted in the central government issuing policies on efforts to prevent the spread of the covid-19 virus which must be implemented by local governments. The purpose of this research is to reveal the arrangement of local government assistance funds in order to tackle covid-19 in the Kuta Traditional Village and the implementation of the provision of social assistance funds distributed to the community in the context of the Covid-19 pandemic. The method used is empirical legal research with a sociological approach. Sources of legal materials are primary, secondary and tertiary which are obtained directly through field research. The legal materials obtained then analyzed using qualitative descriptive techniques. The results of this research concluded that Kuta Traditional Village is not qualified in providing assistance considering that what was seen was the aspect of equality of indigenous peoples and agencies and the need for an organization and an implementation system so that the provision of social assistance can proceed well.

Abstract

Tourism that developed in Bali is an important sector for Tabanan Regency in increasing its tourism assets. Formation of Tabanan Regency Regulation No. 11 of 2018 concerning Tourism Villages is a legal umbrella that is expected to be able to increase investment interest in Tabanan Regency. The purpose of this study is to examine the regional regulation of Tabanan regency number 11 of 2018 concerning tourism villages related to increased investment interest in Tabanan regency and to examine the effectiveness of local regulation of Tabanan regency number 11 year 2018 regarding tourism villages related to increased investment interest in Tabanan regency. Furthermore, the method used in this study is empirical legal research method, meanwhile, a sociology approach is an approach used in this study. The results obtained from the study are that the implementation of Tabanan Regency Regulation Number 11 Year 2018 concerning Tourism Villages has been systematic, involving the role of regional apparatus and the community; and Tabanan Regency Regulation Number 11 Year 2018 regarding Tourism Villages related to increased investment interest has not been effective because there are still many obstacles and obstacles found.

Abstract

The legal construction of Articles 187 and 191 of the Minister of Agrarian Affairs Number 3 of 1997 and Article 12 paragraph (4) letter i of the Perka BPN excludes HGU documents as documents that are not accessible to the public and can only be given to government agencies.This study aims to examine regulation of information transparency on the data of the holder of the Right to Cultivate and to examine the legal consequences of not implementing the Supreme Court's Decision Number: 121 K/TUN/2017 by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) which has permanent legal force. This study uses a normative juridical method according to the applicable law. The results of this study revealed that Transparency of information on data on holders of the Right to Cultivate refers to Article 2 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration (hereinafter referred to as PP No. 24 of 1997) which stipulates that public information is open and accessible to every user of public information. The Right to Cultivate Documents are not exempt under Article 17 letters b and h of the KIP Law. Furthermore, the legal consequences of not implementing the Supreme Court's decision Number: 121 K/TUN/2017, namely the cassation respondent may be subject to administrative sanctions in accordance with Article 116 of the Administrative Court Law and criminal sanctions in accordance with Article 52 of the KIP Law.

Abstract

This study aims to find out the potential conflicts on Land Deeds made by Notaries and to find out Notary efforts in making Land Deeds to minimize potential land conflicts. The method used in this study is the normative legal research method. In addition, the statute approach, conceptual approach, and analytical approach are the approach used in this study. The results of this study showed that (1) potential conflicts on Land Deeds made by Notaries are due to Notaries in carrying out their positions tend to be in a dilemma which on the one hand must comply with legal provisions with a normative nature, and on the other hand, empirical facts are so complex and often cannot be handled and accommodated by regulations that tend to be rigid. This is because when carrying out its positions, the Notary must serve the client, while the client needs service without being too concerned with the regulations that bind the Notary. (2) Notary efforts in issuing Land Deeds to minimize the potential for Land Conflicts are required to examine the completeness of documents by applying the precautionary principle to protect the real owner and reduce conflicts in the land sector. The application of the precautionary principle of the Notary in producing the PPJB deed and the Lease Agreement deed to registered land rights to be registered at the Land Office must start from the stage before the deed, the stage at which the deed is made and the reading of the deed.

Abstract

This research was conducted to determine the effect of bimtek on legislative performance of DPRD of Bangli regency after bimtek. Bimtek which is one form of common perception for the entire DPRD members consisting of various backgrounds in order to carry out their duties and functions well, especially in terms of performance legislation. This research is conducted so that bimtek which is held by using APBD has an optimal impact on DPRD performance. This study uses the analysis tool PLS (Partial Least Square) with a sample of 30 people who are all members of the DPRD of Bangli Regency. The method used in this analysis is a quantitative method reinforced by qualitative analysis to determine the effect or also the relationship between two or more variables. Technique of collecting data using observation, questionnaire, interview, and also data field. The hypothesis of this research is the significant influence between bimtek and legislative performance of Bangli Regency DPRD. The results of this study indicate that bimtek significantly influence the performance of legislative DPRD Bangli regency.

Abstract

Dinamika pariwisata global mengharuskan Bali mengambil dua pilihan kebijakan sekaligus. Disamping turut dalam pusaran budaya modernisasi global, sekaligus dituntut adanya penguatan terhadap adat dan tradisi sebagai ciri identitas kebudayaan Bali. Kecendrungan ini melanda Tuban sebagai salah satu destinasi wisata Bali. Akibat perkembangan pariwisata telah merubah tatanan masyarakat Tuban dari desa tradisional menjadi desa global. Desa Adat Tuban dihadapkan oleh sejumlah persoalan yang kompleks seperti masalah perceraian, penduduk pendatang (krama tamyu), pengangkatan anak (memeras sentana), pelaksanaan upacara agama, dan pengelolaan asset desa adat. Untuk menanggulangi permasalahan tersebut Desa Adat Tuban membentuk Kerta Desa, yakni semacam lembaga peradilan di tingkat desa adat. Akan tetapi, lembaga ini belum bisa berperan optimal karena tidak didukung oleh sarana prasarana yang memadai, dan ketentuan tertulis yang mengatur wewenang, fungsi serta tugasnya. Selain itu, krama desa belum mengerti dan memahami keberadaan lembaga peradilan desa ini. Memperhatikan fenomena tersebut, dipandang perlu dilakukan action research. Program ini bertujuan memberdayakan Kerta Desa dengan target khusus mengoptimalkan peran Kerta Desa melalui penyusunan draf perarem, fasilitasi pengadaan sarana prasarana, dan sosialisasi Kerta Desa kepada krama adat Tuban. Objek Sasaran atau yang menjadi mitra kerja sama difokuskan kepada pengurus Kerta Desa dan tokoh masyarakat Desa Adat Tuban. Metode pendekatan yang diterapkan adalah legal drafting, FGD, dan ceramah. Pelaksanaan kaji tindak menghasilkan tiga hal, yaitu: (1) tersusunnya draf perarem yang mengatur tugas pokok dan fungsi Kerta Desa, (2) tersedianya kantor/ruangan kerja Kerta Desa yang dilengkapi dengan ATK, (3) tersosialilasinya kerta Desa melalui ceramah kepada tokoh masyarakat dan pemasangan papan nama. Abstract

Penelitian ini bertujuan menggali dan menginventarisasi potensi desa untuk dikembangkan sebagai Daerah Tujuan Wisata (DTW) baru berbasis masyarakat dalam kemasan Desa Wisata dan dikelola secara melembaga dalam konsep koeksistensi. Melalui pola koeksistensi terhadap potensi spiritual dengan potensi sekuler akan diciptakan spirit keseimbangan dalam program pembangunan baik jangka pendek, menengah maupun jangka panjang. Penelitian ini menganalisis hak pengelolaan potensi desa terintegrasi dengan pemberdayaan masyarakat sebagai desa wisata untuk meningkatkan kesejahteraan masyarakat. Metode penelitian yang digunakan, yaitu penelitian hukum empirik dengan pendekatan perundang-undangan, analitik, kasus, dan pendekatan antropologi hukum. Inovasi pengembangan DTW berbasis potensi desa seperti Pura Amertajati yang dikemas dalam desa wisata dapat berimplikasi pada pemeliharaan dan pelestarian sumber daya alam yang akan memberi manfaat ekonomi bagi masyarakat secara berkelanjutan. Oleh karena itu sejak awal perlu dilakukan penguatan hubungan antar kelembagaan yang ada untuk menghindari persaingan seperti pengempon Pura, warung kuliner, parkir, home stay.

Abstract

Anturan Village, which is still included in the tourist area of North Bali, has enormous potential to be developed into an adat village-based tourist destination. This village, has a unique culture, religion and customs. The potential of the Anturan traditional village in particular has Kerta Desa a kind of traditional court that can reconcile civil disputes, in the indigenous Anturan community, especially those who are Hindu. This means that prior to the enactment of Indigenous Village Law No. 4 of 2019 concerning Indigenous Villages which obliged to form a Kerta Desa, the Anturan traditional village already had a Kerta Desa. The problem arises that, even though the Kerta Desa has authority in peace in adat villages based on adat law by making decisions in accordance with awig-awig and / perarem. In the Empowerment of Anturan Indigenous Village Empowerment there are problems namely: (1) legal issues related to tourism activities in Anturan Village cannot be comprehensively solved. (2) The form of Kerta Desa's relationship with Bendesa adat and community leaders in resolving tourism cases has not been synergistic so that the law can mean coexistence. (3) There is no Kerta Desa Empowerment model, in the context of state law enforcement and Balinese customary law. (4) The absence of kerta desa in tourism law enforcement is in accordance with the interests of the local community. Solution offered: (1) Existence of Policy Study on Empowerment of Village-based Tourism Village that involves the kerta desa in handling cases of traditional village land and land in the form of investment; (2) Increased knowledge and the existence of legal awareness in the management of traditional village-based Tourism Villages concerning land for investment purposes; (3) Able to develop the implementation of state law and customary law of Bali and tourism law to resolve the case of tourism investment in the traditional village of Anturan; (4) Can have a positive impact on society and can improve human resources, and the Kerta Desa in handling investment cases in tourism can apply the law in coexistence. The method used in the form of empowerment Kerta Desa with the pattern of assistance, FGD and find the real core of the problem. Legal issues are very complex, can find hidden problems in travel cases, and inventory problems and solve problems that arise with village officials, custom officers and indigenous community leaders in Anturan. Target outcomes to be achieved are publication of national journals / or proseding ISBN National publications, mass media publications, videos on broadcast activities. Activities in Empowering Anturan Indigenous Village Empowerment in resolving land issues in tourism investment by providing assistance and counseling to Kerta Desa, Prajuru Desa adat and community leaders who are relevant to Land Cases and investments in Anturan village.

Abstract

This study aims to examine the implementation and constraints of implementing the authority of a Notary to certify transactions electronically. The type of research used is empirical legal research. This study is analysed by using the theory of authority and the theory of utilitarianism (legal expediency) so as to obtain the conclusion of the discussion study in the form of implementation of electronically certifying transactions by a Notary in the form of legal actions or actions by a Notary in providing ratification of an electronic transaction that has similarities with legalization or waarmerking owned by a Notary conventionally. Based on analysis, it was obtained the results that the authority is attributive because it is obtained directly based on the provisions of Article 15 Paragraph (3) of the UUJN-P so that juridically the Notary has this authority only in its implementation because there is no one guideline due to the absence of further arrangements regarding procedures, procedures and types of notary legal actions that are qualified as certifying transactions electronically. The obstacles faced, namely the implementation of certifying transactions electronically in perspective as evidence, it can be conveyed that electronic documents as evidence of legal actions certifying transactions electronically by Notaries are not yet clear the strength of proof as evidence whether it is qualified as an authentic deed product or is it limited to registering, knowing the existence of documents that are certified as legal actions Notary as legalizing or megewaarmeken.
