Abstract

This paper describes the regulation of Islamic economics and the urgency of its development, the post-reform Islamic economic, regulatory system, and analyzes the orientation of Indonesian Islamic economic regulation from a political economy perspective. This article's method is a descriptive analysis by analyzing political phenomena that occur in the formulation of Islamic economic regulations in post-reform Indonesia. This qualitative research uses literature studies. The development of Islamic financial regulation in Indonesia is relatively late when referring to Islamic finance development in other countries. This is related to the national political conditions, which are generally less responsive to institutions labeled Islamic. The dramatic changes in Indonesian politics since the fall of the Soeharto regime have made room for real democracy. Islamic banking regulation responds to the Islamic banking industry's development, which requires assurance of legal certainty and legal justice in a clear regulation. The increase in the role of the government in dealing with Islamic economic problems has a big role. According to Islam, economic policies must be supported by social responsibility, limited economic freedom by sharia, multi-ownership recognition, namely private ownership, state ownership, and a high work ethic. The interpretation and development of Islamic economic regulations can be richer and more important if it is based on concrete experiences of development in implementing Islamic economic regulations in Indonesia. In seeking economic laws in line with the rububiyah principle, practical experiences are material for validating Islamic economic laws.

Abstract

Indonesia has a variety of microfinance service providers such as Commercial Banks, Rural Banks, Non-Bank Financial Institutions (LKBB), Micro Finance Institutions (MFIs), Savings and Loans Cooperatives (KSP) and other semiformal and informal institutions operating at the local community level. One Non-Bank Financial Institution operating in Indonesia is an institution with a group finance system - commonly referred to as Grameen bank. Its business objectives are to tackle poverty or other problems such as education, health, access to technology, and environmental issues that may threaten people and society. The research method used is field research with a sociological juridical approach. With the establishment of a poverty alleviation program involving many women, Grameen banks became one of the integrated institutions in public health programs by establishing sanitation and water programs as a health support product of its partners. This product is called KOMPAK and aims to develop financing products for the development of water quality and sanitation improvement among low-income people. Women Grameen bank actors are not only a target in the development of the business world, they also provide education on improving the quality of life and raise awareness of the importance of water hygiene and sanitation health. The company offers loans to economically active but low-income women especially those living in urban and rural areas.

Abstract

Economic activity is currently experiencing a very rapid development, starting from the development of the market in such a way, penetrating in the field of capital markets which become the traffic of the world economy, connecting between capital owners (investors) and entrepreneurs. Capital markets are a promising investment, entrepreneurs also began to take part in the world of Islamic capital markets which are currently dominated by Islamic countries in the world. With the development of these economic activities, the legislation is not only a rule, but is able to make the implementation of the law directed, protect and make all stakeholders in the world of capital markets have knowledge of the market and how to run it properly without any violations or criminal act in the Capital Market. Legal reform and regulation on the capital market must continue to be enforced. The development of the Islamic capital market in Indonesia is still relatively slow, as a result of the lack of level of knowledge and understanding of market participants and investors, the limited availability of information on the sharia capital market, lack of human resources (professionals) who are experts in the field of Islamic finance, institutional patterns and institutions in the framework of supervision is still considered a "disincentive" by the perpetrators, Lack of "incentives" so that actors tend to issue conventional products, Limited sharia products that can be used as mutual fund portfolios (special constraints for Islamic mutual funds). In accordance with the MUI fatwa, the stock transaction is legalized as long as the company does not conduct a prohibited transaction, the issuer conducts business in accordance with sharia criteria and transactions are conducted at fair market prices. The fair market price of Islamic stocks must reflect the value of the actual conditions of the assets that are the basis for issuing securities in accordance with the regular, fair and efficient market mechanism and not engineered. Sharia capital market activities are some important institutions that are directly involved in supervision and trade activities, namely BAPEPAM, National Sariah Board (DSN), stock exchanges, securities companies, issuers, professions and capital market supporting institutions and other related parties. Especially for surveillance activities will be carried out jointly by BAPEPAM and DSN.

Abstract

Perlindungan hukum terhadap konsumen merupakan hal yang sangat urgent bagi masyarakat di kalangan manapun, sehingga hal tersebut tentu akan diatur oleh negara sebagai pelindung masyarakat. Perlindungan konsumen diatur dalam UU No. 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Perbankan merupakan lembaga yang saat ini melakukan kegiatan usahanya dalam bidang ekonomi, yang menjadi roda perputaran uang dan juga merupakan lembaga tempat bertemunya antara pihak berkelebihan dana dan pihak yang kekurangan dana dalam menjalankan roda ekonominya. Metode Penelitian yang digunakan adalah field research dengan pendekatan yuridis sosiologis. Menurut kajian ekonomi syariah melindungi hak hak manusia sebagai masyarakat merupakan kewajiban negara, salah satunya memberikan perlindungan kepada konsumen dan juga memperhatikan setiap produk yang dikelola oleh pelaku usaha. Perlindungan konsumen tidak terbatas dari usaha barang namun juga usaha jasa yang dilakukan oleh perbankan baik konvensional maupun syariah.Kegiatan perbankan syariah dalam penyaluran dana tidak terlepas dari kaidah fikih dan juga perkembangan perekonomian yang terjadi di Indonesia pada khususnya.Perlindungan secara khusus diberikan kepada nasabah apabila masih memiliki itikad baik dalam pembayaran, dan masih memiliki batasan karena jaminan yang diserahkan oleh nasabah kepada bank, itulah yang mutlak menjadi milik bank setelah prosedur dan proses sudah dijalankan oleh pihak bank.

Abstract

Dalam Perkembangan Hukum di Indonesia, berbagai pemikiran terkait dengan pemikiran yang mengatur tata kehidupan manusia dalam kehidupan bergerak dinamis sesuai dengan perkembangan sosial kemasyarakatan. Keberadaan hukum Islam pun selain terdapat unsur wahyu didalamnya juga mempengaruhi kehidupan sosiologis dan antropologis dalam kehidupan masyarakat Indonesia. Artikel ini membahas perkembangan hukum Islam yang menawarkan konsep teori hukum baru yang lebih relevan menurut pemikiran Munawir Sjadzali dan Abdurrahman Wahid. Dengan menggunakan penelitian kualitatif metode penelitian Library research ini berusaha untuk mengungkapkan konsep reaktualisasi Hukum Munawir Sjadzali dan Konsep Kontekstualisasi Doktrin Islam Pribumi Abdurrahman Wahid dengan pendekatan sosiologis. Konsep hukum Islam yang ditawarkan oleh Munawir Sjadzali dalam hukum Waris Islam menjadi alternatif dalam penemuan hukum di masa Modern saat ini dan tampak lebih dapat diterima oleh masyarakat Indonesia. Sedangkan Konsep Kontekstualisasi Doktrin Islam pribumi atau bisa disebut sebagai pribumisasi islam yang digagas Oleh Abdurrahman Wahid menawarkan agar karakter pribumi tetap harus survive dengan perkambangan kehidupan dan karakter Pribumisasi islam harus tetap ditonjolkan dalam setiap kehidupan berbangsa dan bernegara.

Abstract

This study intends to explore strategies for inculcating maqasid shariah values ​​in family functions in the midst of the Covid 19 pandemic. This qualitative research is in the form of a literature study. This type of research is a conceptual research with a philosophical normative approach. The analytical theory used is the contemporary maqasid shariah theory which was coined by Jasser Auda. The results of the study show that efforts to instill maqasid shariah values ​​in responding to the Covid-19 pandemic can be manifested in various family functions. First, objectification of the value of hifz din and hifz 'aql in religious functions in the form of inculcating the values ​​of faith and tawakkal accompanied by a rationality basis of reason based on science (science). Second, the objectification of the value of the hifz nafs in socio-cultural and loving functions in the form of habituation of a clean lifestyle and upholding mutual love. Third, the objectification of the value of the hifz nasl in reproductive function is in the form of an emphasis on maintaining the immune system by consuming various types of food that are full of nutrition, nutrition, and also do not forget to exercise regularly. Fourth, the objectification of the value of hifz maal in the economic function is the cultivation of an iqtisad (frugal) lifestyle.

Abstract

The purpose of this writing is to explore and reveal government empowerment programs that are not on target. This paper is a non-doctrinal research with qualitative analysis.Gender inequality limits the role of women to access various resources. These limitations make women more vulnerable to poverty. Women's participation as a driver of the family economy is important to get support from the government. In accordance with the mandate of Permendagri Number 1 of 2013 concerning Community Empowerment through the Family Empowerment and Welfare Movement. The result of this study is that the Empowerment and Poverty Alleviation Program in the former Banyumas Resident area has been carried out, but the absorption of funds in the program is still not optimal. This paper is a non-doctrinal research with qualitative analysis. The result of this study is that the Empowerment and Poverty Alleviation Program in the former Banyumas Resident area has been carried out, but the absorption of funds in the program is still not optimal. One of the main factors is the lack of knowledge of the local apparatus in preparing the budget draft, lack of digging Asset Based Communities from the village so that women's empowerment programs experience banality, the target funds that should be used optimally are very slow, not on target. The findings of this study, with the empowerment of women through a productive economy through groups in villages more benefits for families, members can obtain and meet their living needs quickly with the management of funds in their community groups such as KUB (joint business group) Berkah Jaya and also the Inyong Garbage Bank, The government needs to reactualize the empowerment program to the community not only through the top down system but what is needed is bottom up so that the needs of local wisdom from each group in the village can be achieved properly. Abstract

This article explores the critical role of Islamic family law in supporting the development of a just and sustainable Sharia economic ecosystem. It argues that revitalizing core principles of Islamic family law particularly those related to inheritance, marriage, and economic roles within families can significantly influence socio-economic empowerment and gender equity. Through a normative and socio-legal approach, this study examines how legal frameworks can better integrate family institutions into economic empowerment strategies, particularly in Muslim-majority societies. By addressing structural injustices and enhancing legal access for women and marginalized groups, Islamic family law can serve as a catalyst for inclusive economic justice within the broader Islamic economic system.

Abstract

This study aims to analyze the dynamics of disorderly conduct by legal counsel during court proceedings and examine the ethical and professional responses of judges to such non-procedural behavior. Disruptions caused by legal counsel in the courtroom not only hinder the judicial process but also pose significant challenges for judges in maintaining the dignity and order of the proceedings. Using a qualitative approach through case studies within the religious court system, this research explores various forms of misconduct, judicial responses, and the extent to which the principles outlined in the Code of Ethics and Judicial Conduct (KEPPH) are practically implemented. Furthermore, a theoretical analysis of judicial professionalism and ethics is conducted to assess the alignment between normative ideals and actual courtroom practices. The findings indicate that misconduct by legal counsel manifests in various forms, ranging from breaches of decorum to non-procedural interruptions. Judicial responses vary depending on the severity of the misconduct and the individual character of each judge. This study concludes that the synergy between professionalism and judicial ethics is fundamental to maintaining the credibility of the judicial system. Therefore, the development of guidelines for handling non-procedural behavior, along with the enhancement of ethical and character-based training for legal practitioners, is strongly recommended.

Abstract

This study aims to analyze the implementation of the principle of equal rights for persons with disabilities in the litigation process at the Purbalingga Religious Court, as well as to formulate recommendations and concrete solutions to strengthen inclusive legal services. The research uses a qualitative approach with data collection techniques including interviews, observation, and documentation. The results show that the Purbalingga Religious Court has provided special services for persons with disabilities, reflecting the fulfillment of equal rights in legal proceedings. Recommendations include providing adequate physical access, enhancing the capacity of human resources to be more responsive to the needs of persons with disabilities, and drafting specific Standard Operating Procedures (SOP) for disability-friendly legal services. Concrete solutions that can be implemented include support services such as transportation for persons with disabilities, training court officers on inclusive services, and providing accessible infrastructure and facilities. Therefore, the implementation of the principle of equal rights in the judiciary can be realized in a tangible and comprehensive manner for all members of society, including persons with disabilities
