Abstract

Children are an inseparable part of a nation's sustainability, and thus, their rights must be legally and morally guaranteed. This research aims to examine the forms and implementation of child rights protection in Medan City from the perspectives of Islamic Law and the Convention on the Rights of the Child (CRC). Islamic Law emphasizes child protection through the teachings of the Qur’an and Hadith, which highlight the responsibilities of parents, families, and society in fulfilling children's basic needs and rights. Meanwhile, the 1989 Convention on the Rights of the Child, ratified by Indonesia through Presidential Decree No. 36 of 1990, provides an international framework for ensuring comprehensive and non-discriminatory child rights. This research uses a normative legal method with legislative and conceptual approaches, supported by literature review. The findings reveal that both Islamic Law and the CRC share fundamental principles of child protection, such as the best interests of the child, the right to life and development, and protection from violence. In Medan City, child protection efforts still face challenges; however, integrative measures combining religious values and positive law have been implemented to support children's rights fulfillment. This study recommends strengthening collaboration among the government, religious leaders, and communities to establish a more effective and sustainable child protection system.

Abstract

Land issues in North Sumatra, especially in Medan City, still occur frequently, one of which is land acquisition for the construction of toll road infrastructure to accelerate development, facilitate access to production, distribution, and tourism areas, and create new jobs. Although this development accelerates the economic growth of the country and society, disputes related to land acquisition for public interest are inevitable. One of the cases that is the focus of this research is located in Sumatra Province, specifically the jurisdiction of the Medan District Court. The problem of this research is how legal protection for land rights owners due to land acquisition for toll roads and how the consignment process of compensation for land affected by toll road project acquisition. The research method used is normative juridical with an analytical descriptive approach, using the Legislation Approach. This research uses the Law Approach by collecting and analyzing statutory provisions related to the environment and corporations. The legal material collection technique used is library research, then analyzed qualitatively. The results showed that there is legal protection for the owner of the toll road acquisition through consignment settlement.

Abstract

In particular, handling children's problems is included in the social rehabilitation sector which is under the Social Rehabilitation Section for Children and the Elderly Outside of Homes and/or Institutions, although it is also related to other sections within the Medan City Social Service. The importance of this study is to carry out integration between the concept of human rights in the global context and human rights in Islam. It still needs to be reduced to an integrated child protection concept, so that it can be implemented in the form of policies in the local context, especially in the field of social welfare. To derive these two concepts, a systems approach is needed that can explain the position and role of the CRC and Islamic law in child protection and the role of the Medan City Government, especially within the Medan City Social Service, in implementing existing policies. This research uses a qualitative approach to describe and analyze how Islamic law and the Convention on the Rights of the Child (CRC) view child protection from their respective perspectives and will then be analyzed as a whole. The role of the Medan City Social Service relating to the field of child protection is carried out through the duties of the Social Rehabilitation Sector, in point (g) that "Guidance, development and control of social service efforts in the field of social rehabilitation services for street children, abandoned children, delinquent children and service provision for neglected elderly people and social rehabilitation of delinquent children.
