Abstract

The phenomenon of inter-religious marriage is problematic, controversial, and resulted debate among Muslim and non-Muslim relationship in Indonesia. It also not only becomes the social conflict among Muslim and non-Muslim couples, but also pro and contra among the others such as family and society. In the classical Islamic marriage law discourse (fiqh al-munakahat), there are two kinds of inter-religious marriage, namely marriage between Muslim men with non-Muslim women and marriage between non-Muslim men with Muslim women. Some Muslim scholars said that Muslim men allowed marrying non-Muslim women and non-Muslim men prohibited marrying Muslim women, which the reason is based on the concept of polytheists and the group of experts (Kitabiyyah). In contrast, some Muslim scholars in Indonesia rejected inter-religious marriage based on the reason that it has been changed and regulated under Marriage Law Number 1 of 1974 and President Regulation Number 1 of 1991 on Islamic Law Compilation. One the one hand, the phenomenon of inter-religious marriage is an interesting phenomenon in the society and on the other hand it will become the legal implication to the inheritance and children care rights in Islamic and Indonesian law perspective. Therefore, the aim of this paper is to examine comprehensively about the legal status of inter-religious marriage in Islamic and Indonesian law perspective, including its legal implication to the inheritance and children care rights.

Abstract

This research was carried out in the Pondok Pesantren Al-Hidayah. This pesantren is located in Deli Serdang District, North Sumatra Province, Indonesia. It is a boarding school that educates children of terrorists and low-income families. This study aimed to analyze the differences between children of terrorists in comparison to children from low-income families, from the perspective of Indonesian nationalism. The subject is Pancasila: the official, foundational philosophical theory of the Indonesian state. The findings of this study indicated that children from low-income families had a better understanding of Pancasila than children of terrorists. However, this does not mean that all children of terrorists did not understand Pancasila, as there were still those who did comprehend a small amount. Regarding the tendency for violence, this study had found that both children of terrorists and children from low-income families both had a desire to hit if bullied or ridiculed. One prominent difference is that children of terrorists seemed to have different imaginations. They might have visions of heaven as well as sharp objects. The percentage of this occurrence was minuscule, which means this trend did not occur in all children of terrorists. However, this finding indicated that children of terrorists needed special attention.

Abstract

The paper investigated and explored experts’ opinions regarding the post-pandemic control strategies within the South Asian perspective to make the Nepalese economy robust. The study was based on qualitative methods of analysis and the method of the study had been classified into two parts: Primary & Secondary. For secondary, data were collected through published reports, journal articles, the daily national newspaper, media, and Television coverage & personal observation, and experience. Whereas, for primary data, the study was carried out considering the way to control the post-pandemic effects on developing economies particularly in Nepal. The result of the study depicted that the post control of covid-19 effects on economic revival policies should prioritize sectorial concerns on the agriculture and industry sector of the economy over service sector and remittance. Therefore, for the pandemic recovery issue, the government and private sector’s role is to jointly solicit a model Public, Private, Partnership for the firm relief of economic stability. Thus, the paper concluded that there is an urgent need to prepare the post control strategy to minimize economic vulnerability. In this situation, Nepal needs strategies for good governance rather than a complex and mysterious plan.
