Abstract

This article examines the legal issues regarding the regulation of peer-to-peer lending in Indonesia. This research is a prescriptibe normative legal research with statutory approach. The data used were primary, secondary, and tertiary legal materials. Data collection techniques carried out by literature study or document study with deductive syllogism legal material analysis techniques. The results of the research and discussion show that the regulation of P2P Lending in Indonesia is not comprehensive enough to regulate the P2P Lending industry, which leads to the emergence of several legal issues as follows: a) There is no mechanism for registering a lending platform before it can be accessed by the public; b) breach of security and privacy of personal data; c) the rise of illegal P2P Lending platforms; d) there are no clear dispute resolution steps; e) there is no proper billing mechanism.

Abstract

This article aims to describe the relevance of the protection of intellectual property rights (IPR) in the perspective of the theory of economic analysis of law. The approach used is a historical approach (historical approach) using primary legal materials and secondary legal materials. The data collection technique used is the literature study technique. Based on the research results, it can be concluded that so far the focus of traditional economic analysts has only highlighted that inventors or holders of exclusive IPR are entitled to incentives or rewards for their findings. Apart from that, giving incentives is also to encourage people to make discoveries that are beneficial to human life. However, they did not highlight the high cost of accessing or using their findings. Even the cost of accessing IP exceeds the cost of the production margin of IP itself. In the perspective of the theory of economic analysis of law, the condition of unbalanced margins can cause injustice.

Abstract

Artikel ini bertujuan untuk mengkaji tindak kejehatan yang dilakukan oleh mafia tanah, hal ini disebebkan karena kurangnya pengawasan, kemanan serta pemberian sanksi oleh penegak hukum berdasarkan peraturan yang ada. Artikel ini juga memberikan perbandingan  antara sistem pertanahan di Amerika Serikat yang mewajibkan penggunaan asuransi dalam hal jual beli tanah dan properti. Metode penelitian menggunakan metode normatif bersifat perspektif. pengecualian yang tidak dapat di klaim oleh nasabah sesuai dengan perjanjian polis. Berdasarkan hasil penelitian, penggunaan asuransi kepemilikan memberikan keamanan baik dari sisi penjual maupun pembeli, asuransi tersebut dibayarkan satu kali saat membeli tanah, dari sisi ekonomi  adanya asuransi kepemilikan dapat memberikan pinjaman yang lebih besar dan berdampak kestabilan harga pada pasar penggunaan asuransi kepemilikan yang tidak seperti asuransi pada umumnya dinilai cukup mahal, karena premi tersebut dihitung dari harga tanah tersebut.
