Abstract

This research attempts to reconstruct the law enforcement issues related to the case of human organs trade in Indonesia. As we know, the rules of law related to the prohibition of the sale and purchase or illegal transplantation of organs has been issued by the government. But the fact does not make organized crime vanished. Therefore, it is necessary to have the latest reformulation that can realize to the root of the problem. One of them is by integrating between Islamic law in the form of the products fiqh and the Health Act (Act No. 36 of 2009). This research is normative juridical research. Its focus is directed on the study of theorem, principle, conception, legal doctrine and content rules of positive law. It is analyzed descriptively and qualitatively by reducing the data, presenting the data and draw conclusions. Both Islamic law and health law equally prohibits the practice of buying and selling of organs strictly in principle. It is because of the high risk of illegal actions against a persons health, due to the lack of health standards in the black market organ sales. Organs will no longer work when it is transplants for living donor. Interestingly, both Islamic law and the laws of health go hand in hand in an effort to prevent the practice of buying and selling of organs, especially the highly dynamic Islamic law to follow the development of humanity. This is evident from the birth of some of the Fatwa (a binding ruling in religious matters) issued by the Indonesian Mufti Council (MUI) that related to the issue of human organs. Similarly, Health Act is very appropriately referred to as human rights laws because many provide humanitarian protection in the field of health.

Abstract

Zakat is source of revenues of state that biggest than ghanimah, jizyah, fai dan kharaf at the beginning of history of Islam.  Therefore not so surprising if there is opinion says in this modern era, zakat be created as Islamic economic back bone.  Zakat considered as a school of thought in Islam and also as a microcosm of the entire Islamic fiscal system.  Limited standpoint understanding from both are same namely give something likes money, goods or things to government or institution that be trusted to handle it. The problem that arises is if both of them are same whether people must carry out all.  Discourse it presented comparation form between zakat and tax.  Evidently there are similarities and differences both of them. So, zakat and tax must be set out in legislation not just at Al-Quran and Hadits also at Ijma and Qiyas.  Therefore all elements at society must concern on it to reach prosperity of all people.

Abstract

Indonesia is a pluralistic nation (plural). Multiculturalism beckons the existence of plurality and difference. Understanding and management of pluralism and multiculturalism will generate a positive force for the development of the nation. Conversely, if it is not understood and managed properly, diversity and multiculturalism could be a destructive factor and  a disaster trigger. Conflict and social violence that often occurs between groups of people are part of plurality and multiculturalism are not managed properly. Religious conflict as happened in Maumere (1995), Surabaya, Situbondo and Tasikmalaya (1996), Rengasdengklok (1997), Jakarta, Solo and Kupang (1998), Poso, Ambon (1999-2002), are not bit fatalities, but also has destroyed hundreds of places of worship (both churches and mosques) burned and destroyed. Similarly, notes of ethnics violence, such as certain ethnic violence in West Kalimantan (1933), Central Kalimantan (2000), it is needed a preventive measures as early prevention, so that such events do not recur in the future. To achieve this goal, inclusive-instrinsic understanding of religion.. Borrowing a term of Malinowski’s thinking wishfull; their beliefs are considered nil even though the truth of religion, but religion is still positive that was able to help the frustration and still has the potential to realize the social unity.

Abstract

The objective of this research is to describe the concept of Ibnu Jarir al-Tabari about al-Qur’an, tafsir and ta’wil. Ibn Jarir al-Tabari is an outstanding expert in the classic Islamic tradition. His knowledge in hadits, fiqh, lughah, history, and tafseer is unquestionable. This study uses an analytical descriptive design. The findings show that: Firstly, in defining al-Qur’an, al-Tabari focused on the al-Qur’an as an Arabic language text, not in other language. Secondly, al-Qur’an is written in sab’ah ahruf. It means that there are 7 different kinds of language with the same meaning. Thirdly, al-Qur’an comes from seven heaven’s door. Fourthly, there is no different word between tafseer and ta’wil. They have same meaning. These concepts are different to other concepts proposed by other ulama.

Abstract

A quality of education can be achieved by implementing a quality learning. To improve its quality, STAIN Samarinda plans and evaluate its educational programs periodically to become an excellent distinguished higher institution in Kalimantan Timur. It is important to encourage the candidate of college students to choose STAIN Samarinda as their options to continue the study. This motivation deals with the prosperity of work, recommendation or suggestions of family and friends, perception of Arabic language program, appropriateness of interest and talents, ambitions, willingness, teachers’ qualifications, and sufficient information about the study program. This is a descriptive qualitative research design. The data were collected by using interview and documentation. The result of findings shows the students’ motivation in choosing the Arabic study program of STAIN Samarinda is to learn Arabic entuastically, fit to their ambitions, and linier to their former educational background.

Abstract

This study explores the urgent of STAIN Samarinda Boarding College Program (PESKAM) to redesign both its policy and its instructional framework for the irregular Islamic studies system, academic year 2014/2015, viewed from various aspects. The first aspect is about the effectiveness of irregular Islamic studies instructional achievement run in (academic year) 2103/2014. The second aspect is the leaders of STAIN Samarinda political interests concerning with PESKAM empowerment including institutional, instructional design, financial suffort, and the staffs. The third aspect is the regular Islamic studies lecturers’ academic sensitivity. And the last aspect is concerning with the design reliability of irregular Islamic studies program. The research shows that redesign is a must. It is imperative for STAIN Samarinda to redesign both PESKAM policy and its instructional framework for the irregular Islamic studies system. First, the system run during academic year 2013/2014 could not be considered effective. It did not use any general academic standards and could not be approached in terms of modern instructional management and design, such as the evaluation system designed to know periodically both the competence that a learner (a student in PESKAM) must be about to master and the process run to do such instruction as well.  However, all staffs and those who were in charge of managing the program worked hard and did all their best. Second, irregular Islamic studies instruction is viewed as the spirit for PESKAM in general. Its valuable benefit meets the stakeholders’ need. Finally, it is the cornerstone which can be accredited as the prime aspect distinguishing STAIN Samarinda from any general university (PTN/PTS)

Abstract

Since the era of STAIN Samarinda to IAIN Samarinda, the characteristics of Islamic studies at IAIN Samarinda has not been crystalized yet. It is an important issue, since the characteristics of Islamic studies in Islamic higher education forms the identity of its image. This study aims to describe the characteristics of Islamic studies at IAIN Samarinda and to formulate the epistemology of Islamic studies at IAIN Samarinda. This is a philosophical qualitative research. The sources of data were from the dean of faculties, the vice-dean of faculties, and the lecturers of IAIN Samarinda. The data were collected by using interviews, documentation, and the study of literature. To validate the data, the researcher used data triangulation. The data, then, analyzed through three stages, namely: data reduction, data display, and data conclusion. The data findings show that the characteristics of Islamic studies at IAIN Samarinda, particulary in the Islamic education study program, tends to implement the multiculturalism-based content. Otherwise, the epistemology of Islamic studies at IAIN Samarinda tends to use ASASI Model (Akademik Sains Islam Malaysia). The implication of this study are: 1) IAIN Samarinda should determine the identity of the characteristics of Islamic studies at IAIN Samarinda, 2) IAIN Samarinda should facilitate the formulation of the epistemology of Islamic studies at IAIN Samarinda, 3) IAIN Samarinda might formulate the concept and the implementaion of science integration both of the aspect of methodology using reflective-conceptual-tentative-problematic and the aspect of its science epistemology using the model of structure of Islamic science.

Abstract

This research was to measure the level of satisfaction users of Management Education Islam alumnus at public and privat sectors. Furthermore, the research is to mapping the types of professions and distribution of alumnus in East Kalimantan. The aims of this research are to know key position and to measure level of satisfaction of the carrier institutions that use alumnus of Management Education Islam at East Kalimantan. This research is qualitative descriptive with study case approach. Writer used observation, questionnaire and documentation to collect data. Analysis of data using percentage formula and mean test. The conclusions are: (1) Alumnus of Management Education Islam has key position at carrier world with professions: Administration Staff at College, Bank Teller, Customer Service at Bank, Administration at Finance and at Telkomsel, Imam KUA, and Board on Religius Organizations; (2) Distribution of alumnus: Samarinda, Balikpapan, Nunukan, Tarakan, Bulungan and Paser; (3) 59% alumnus has key position appropriate with their academic background and 41% not appropriate; and (4) Level of measurement of the user of the alumnus at 2,318. It is at range 1,668-2,334 that means satisfy.  So we can say that alumnus of Management Education Islam in order to do their job is good enough.

Abstract

Development of the local culture as Islamic religious learning model approach is very necessary at this time. Because religion is very in touch with cultural values. Islamic culture such as Habsyian, Manaqiban, reciting sholawat to Prophet Muhammad (solawat Diba ), celebrating Prophets birthday, and Isro miroj, tahlilan, reciting barzanji are becoming increasingly committed by the Muslim community in Ssamarinda. Development of the local culture is not only done among society, but it has touched a post-secondary education institutions, high school and others. It is very interesting because morally is very effective of religious instruction taught religious teachers in their schools. The way how they follow through Manaqib Habsyian and recitation would bring a positive trend among the students. With the performance of the all-white dressed adds spirit to Islam among students. Development of local culture as stated above should be preserved and supported among educators and related agencies. Keep in mind the development of Islam and its spread in Indonesia in conjunction with the local culture as a means of delivery. It almost happened in regions throughout Indonesia as an archipelago country.
