Abstract

Abstract: This article focuses on the role of the National Awakening Party (PKB) in the local parliament. This research concludes that the role of PKB of DPRD in Sumenep is committed by the spirit of fighting poverty and encouraging the grass root people-based APBD. These spirits are appropriate with the principle of maslahah (benefit) and âdl (justice). In line with the above conclusion, it is expected to the readers to be able to do more researches on the role of the National Awakening Party (PKB) in the local parliament. So that the further research will be able to fight the poverty of the grass root people based on the will of Siyasah Jinayah. Abstract

Abstract: This article discusses about Jimli Asshiddiqie thinking about of MPR RI judicial review against the Constitution 1945. According to Jimli Asshiddiqie, eighth of Tap MPR/S is must be considered equivalent position with the law, because in our legal system was no longer recognized the existence of law products above the law, even though the form of law not the Consideration, but materially eighth of Tap MPR RI is Law. And when the Decree of MPR/S assessed has caused the loss of constitutional rights of certain parties, it can be requested testing (judicial review) in the Constitutional Court, as a constitutional test case stipulated in Law No. 24 of 2003 about Constitutional Court. In political jurisprudence perspective, authority of the Constitutional Court in resolving cases of judicial review Tap MPR against the Constitution 1945 as Jimli Asshiddiqie thought, has some similarities with the agency wilayah mazalim, the authorities is investigate and examine cases public beneficiaries are that cant be carried by hisbah officers. Abstract

Abstract: This article discusses the influence of legal political configuration of the New Order against the Compilation of Islamic Law in Indonesia. Legal political configuration of the New Order was based on Pancasila and the Constitution of 1945 as the basis of its policy to enhance and improve national law. The background formation of KHI is the need for technical justicial Religious Courts. KHI can be regarded as Indonesian fiqh sound Pancasila due to the influence of political codification and unification of the law of the New Order. This study efforts to prove that the relationship between the political configuration and character of legal product that produces any legal products is a reflection of the political configuration that gave it birth. The character of the law product is determined by the political vision that developed in the midst of society. Sometimes the character of legal product is responsive/populistic and there is also a legal product was characterized by conservative/orthodox/elitist. Likewise with KHI must have certain characters were born as a result of legal political configuration of the New Order regime. Keywords: Effect, political configuration, the new order, KHI

Abstract

Abstract : The followers of Syiah religious sect in Sampang can get legal protection when they want to do Baiat again to the teachings of Ahlus sunnah wal Jamaah. It is agreed, because they believe Itsna Asyarah Syiah religious sect that its existing banned in Indonesia. Legal protection for them is the right of citizens of Indonesia stipulated in the 1945 constitution. The guarantee of 1945 constitution, written constitution, in the case of citizens protection states itself as the law state that the implementation of its goverment based on law. As a consequence of the law state, recognation, respect, and protection of human rights should get a serious attention without discrimination in any forms. That the violence for whatever reason that may lead to violence action on the protect of religion is not justified forever. This is in accordance with embodiments of article 28 and 29 of 1945 constitution which says that every citizens has the right to run their each religious beliefs and convictions. Abstract

Abstract: This paper addresses the issue of how the implementation of the 30% quota of the women legislative candidates in the electoral district 4 in Gresik in 2014 general election according to Undang-Undang No. 8 tahun 2012 and the political (siyasah) jurisprudence. The data are collected through interview and a study of the texts related to the problem. They are then analyzed using the political (siyasah) jurisprudence approach and accomplished by inductive framework. The study concludes that the implementation of the 30% quota of the women legislative candidates in the electoral district 4 in Gresik has been in conformity with UU No. 8 tahun 2012 and Peraturan KPU No 7 tahun 2013. It is recorded that the women legislative candidates, in the list of the fixed candidates, are 34.61% or 36 people of the 104 candidates in the electoral district 4. However, the final result shows that the 34.61% of the women legislative candidates have not met the 30% quota. In fact, there are only 2 people (20%) of the 10 council members who represent the electoral district 4 in Gresik. In Islam, there is none of the discussion of the application of the 30% quota of the women legislative representation in parliament. Within the perspective of the political (siyasah) jurisprudence, the 30% quota of the womens representation in parliament are not contrary to the principles of Islam as long as they have the capacity and capability as a leader. It is because Islam adheres the principle of equal right between men and women as mentioned in chapter al-Taubah, verse 71. Abstract

Abstract: This article is a field research on implementation of childs rights who conducts crime according to Undang-Undang No. 3 Tahun 1997 in Pengadilan Negeri of Sidoarjo on the Islamic criminal law perspective. This study aims to answer the questions about the implementation of the childs rights who commits offense under Undang-Undang No. 3, tahun 1997 in Pengadilan Negeri of Sidoarjo and the view of the Islamic criminal law on the childs rights who commits crime. To answer the two main questions, the author uses descriptive analysis method. The research shows that the implementation of the childs rights who commits offense under Undang-Undang No. 3 tahun 1997 in Pengadilan Negeri of Sidoarjo during the process of examination in court are; entitling to an explanation of the procedure of the trial and the case, obtainning a legal counseling during the trial and a right to choose his own legal counsellor, communicating to his legal supervisor, getting an adequate facility in the trial, gaining protection against adverse actions, obtaining a right to express and defend his own opinion, getting a treatment as set out in the criminal code. In Islamic law, the judicial process of child who commits criminal acts is entitled to defense himself whether conducted by the child himself or his own legal counsellor and he also has right to ask a compensation for a wrong decision. Abstract

Abstract: This article highlights about adultery as one of the strong reasons of divorce. The reason is however quite difficult to be legally proved. As mentioned in the Quran, verification of adultery is by presenting the four male witnesses. And it has been mentioned in the Qurâan chapter al-Nisa, verse 15, 16, 25 and in chapter al-Nur, verse 2, 4, 13 that the four male witnesses should be Muslim. In addition, Another way to prove adultery is lian as written in the Quran, chapter al-Nur, verse 6-9 that a husband who accuses his wife committing adultery while he does not have adequate evidence other than he himself, so he can prove it with a lian oath. It is also clearly stipulated in article 88 of Undang-Undang No.7 tahun 1989. While the proofs of adultery under the civil law of Religious Court other than the testimony of the four male witnesses are also by letter, oath, recognition, and conjecture. Abstract

Abstract: This article discusses about the concept of justice in the perspective of the philosophy of Islamic law. Philosophically, there are two formulations of justice: first, the view that what is meant by justice is a harmony between the use of right and obligation are in line with the implementation of the proposition of the balance of law or the dose of right and obligation; second, the view of the lawyers who formulate that justice is a harmony between legal certainty and proportionality of law. Justice, in Islamic law, is derived from the Most Just. It is because Allah SWT is the upholder of justice, then He must be believed not to apply unjust to His servants. The concept of justice, based on al-Shatibis maqasid al-shariah theory, is determined by the benefits which are divided into three, namely daruriyyat (necessities), hajiyyat (needs), and tahsiniyyat (luxuries). This indicates that Islam is concerned with the issue of justice. The conception of justice will continue to evolve in line with the social development. Construction of law and justice in Islam cannot be separated from morality and transcendental beliefs since these aspects are intertwined. Keywords: Justice, philosophy, law, Islam.

Abstract

Abstract: This article discusses M. Natsirs and Abdurrahman Wahids thought about the relationship between Islam and state. Both of M. Natsir and Abdurrahman Wahid agree that the most realistic system to be applied in Indonesia is a democratic system. They also agree that there is no a rigid political system in Islam as it has existed today. In addition, Islam provides the basic principles of the nation and state namely deliberation, justice, equality, freedom, and togetherness. The fundamental difference between M. Natsirs and Gus Durs thought in viewing the relationship between Islam and state is about the two things: first, their respond to secularism, which tries to separate between religion and state; and second, their political thought in addressing democracy and the Pancasila ideology as the fundamental principles of Indonesia. Abstract

Abstract: This article focuses on presenting problem of religious minority right in Indonesia. Based on its constitution, Indonesia has equal protection for all citizens. There are some basic religion right clearly protected and presented in constitutional and criminal law. Unfortunately, violation of minority rights still continues in Indonesian life. According to research data, there are a big gap perception between government and the people. Government choose to float the norms of religious minority right protection in abstract level and most of religious minority group asked more detail and concrete norm.
