Abstract

Islam adalah agama perdamaian. Menyandingkan Islam dengan militerisme sudah tentu membutuhkan suatu penjelasan yang memadai. Walaupun sejak awal keha­dirannya Islam telah mengalami beragam konflik fisik dan peperangan bukan berarti Islam memberikan perhatian berlebihan kepada pembentukan kekuatan militer sebagai bagian inherent dari kehidupan. Pembentukan militer dalam Islam lebih dikarenakan merespon banyaknya gangguan, tantangan dan serangan lawan. Orga­nisasi militer Islam ini tidak sepenuhnya tertata rapi. Perlahan tapi pasti organisasi militer menjadi lebih terorganisir, ramping dan efektif. Demikian juga, ketentuan Islam yang mengatur hal-hal yang berkaitan dengan perang adalah bentuk kongkrit respon hukum Islam terhadap perkembangan sosial kemasyarakatan. Tradisi militerisme yang berkembang merupakan respon kongkrit terhadap ancaman fisik yang menimpa kaum Muslimin. Oleh sebab itu, Islam secara sengaja telah membatasi peperangan dalam tiga bentuk konkrit, yaitu waktu dan lokasi peperangan yang terbatas serta adanya distingsi tegas perlakuan sipil militer dalam peperangan.***Islam is a religion of peace. Slowly but sure, military organizations become more organized, slim and effective. Likewise, Islamic provisions that regulate matters relating to war is a form of Islamic law which is a real response to the social development. In addition military tradition that developed is a real response to physical threats that affecting Muslims. Therefore, Islam intentionally have limited warfare just in the three concrete forms: the time and location of a limited war as well as strict distinction in the treatment of military civil war.***Keywords: jihad, militer, perang, siyāsah

Abstract

Hubungan suami istri, atau yang lazim disebut dengan perkawinan, merupakan titik strategis dalam pembangunan masyarakat. Beragam ayat yang terdapat dalam al-Quran menunjukkan betapa kuatnya perhatian Islam terhadap permasalahan ini. Kitab suci yang biasanya diklaim oleh banyak kalangan berisi ayat yang global dan masih mengandung beragam makna yang multi tafsir, membahas hubungan keluarga  dengan bahasa yang jelas, tegas dan ringkas. Problem dualisme makna hampir tidak kita temukan dalam pembahasan ayat keluarga. Walaupun kejelasan makna ayat dapat ditemukan secara langsung dalam al-Qur’an, tidak demikian dengan perkembangan pemikiran yang ada dalam masyarakat. Pelan tapi pasti, dimensi misoginis nampak dalam sikap dan perilaku masyarakat. Seorang suami, dengan menggunakan ayat-ayat tertentu dianggap memiliki keistimewaan mutlak terhadap istrinya. Oleh sebab itu, seorang istri wajib taat, tunduk dan patuh kepada suaminya dengan alasan bahwa tiga sikap itu adalah perintah agama. Penelitian ini dengan menggunakan analisis tafsir ahkam akan berusaha mengkaji ulang doktrin dengan menganalisis ayat yang selama ini digunakan sebagai klaim keistimewaan mutlak seorang suami.

Abstract

Abstract: This article focuses on presenting problem of religious minority right in Indonesia. Based on its constitution, Indonesia has equal protection for all citizens. There are some basic religion right clearly protected and presented in constitutional and criminal law. Unfortunately, violation of minority rights still continues in Indonesian life. According to research data, there are a big gap perception between government and the people. Government choose to float the norms of religious minority right protection in abstract level and most of religious minority group asked more detail and concrete norm.Keywords: Religious minority protection, human rights, religious minority.

Abstract

This research belongs to qualitative research, which explored the tawadhu' (humility) in the Lirboyo Islamic Boarding School, Kediri. Tawadhu' in Islamic boarding school is traditional, rooted, and has become a positive character. Thus, it deserves to be explored and later can be used as a "role model" for other educational institutions to implement, develop and produce individuals with this character. The method used was field research with an ethnomethodological approach, a cluster of qualitative research that focused on reality with practical interpretation. Research results showed that the notion of tawadhu', according to the kyai's perspective at the Lirboyo Islamic Boarding School, Kediri, was an effort to transfer values and morality to the santri. Thus, they would possess polite behavior, obey goodness and virtue, will be kind to others. Second, tawadhu' had several foundational factors at the Salafiyyah Lirboyo Islamic Boarding School, East Java, including (a) spiritual foundations, (b) struggling mental foundations, (c) prosocial foundations. The objectives of tawadhu' for the santri at the Salafiyyah Lirboyo Islamic Boarding School, East Java, were: (a) growing value education in the students, (b) Preventing self-deception and misdirection to others, (c) building and instilling muhsin's personality to the students. Creating the teachings of tawadhu' at the Lirboyo Islamic Boarding School, Kediri was influenced by several factors: (a) the kyai's charisma, (b) the continuous book learning, and kaffah internalization to students. Many teachings have educated students in the books studied to be humble, obedient, and glorify others.

Abstract

Academic findings show that there is a clear distinction between Muslims and Orientalists when they learn al-Qur'an on social conflict and integration. Muslims employ legal and theological perspective that results in normative doctrines. As an internal study, it claims superiority and excellence over non-Muslims studies. According to Muslim scholars, conflict and peace is inseparable. Conflict is a price to uplift peaceful agendas. On the contrary, orientalists who make use socio-historic approach expose the dominance of conflict doctrines in Al-Qur'an over its instruction about peace. Islam is a religion that legalizes violence in its spread. This article is an attempt to make a bridge between the two perspectives to uncover socio-theological facts which trigger the doctrine of war in Islam.

Abstract

The desire to accommodate marital cheating as a despicable act and against the law has not been properly accommodated in the law enforcement process, even though this has long been developing and has many victims in society. Offenders are often only considered despicable acts specific to the parties involved with the victim, limited to the scope of the household. In fact, according to the results of the study conducted in the writing of this paper, various legal responsibilities of actors have been well accommodated in Indonesian social norms, and possible to arrest actors from the perspective of legislation. Therefore, the study of actors cannot be reduced to only those that limit themselves to written legal provisions by using the paradigm of the legality aspect of legal sources in determining crimes and acts against the law alone. This paper proves that marital cheating is not just a despicable act prohibited by social norms but also shows the various court judgments that have been made in resolving the marital cheating dispute.
