Abstract

AbstractContract and pruduct in sharia banking are two matter inseperable because each product in sharia banking must be based on the contract and Islam sharia principles. If looked from aspect product, aspect contract and sharia principles are differentiate between sharia bank product and conventional bank product. Based on purpose of sharia bank, there are to get profit in the world and profit in the hereafter (profit and fallah oriented). So contract in sharia bank has also become two, there are tabarru’ contract (fallah oriented) and tijarah contract (profit oriented). Tabarru’ contract generally used at sharia banking activity in sector social like as service product and give good deeds loan to their costumers. Tijarah contract generally used at financing product are based profit sharing, trade, business of renting things out. Keywords : contract, product, sharia banking Abstrak Kontrak dan produk di perbankan syariah adalah dua hal yang tak terpisahkan karena setiap produk di perbankan syariah harus didasarkan pada kontrak dan prinsip syariah Islam. Jika melihat dari aspek produk, aspek kontrak dan prinsip syariah yang membedakan antara produk perbankan syariah dan produk perbankan konvensional. Berdasarkan tujuan bank syariah, ada untuk mendapatkan keuntungan di dunia dan keuntungan di akhirat (profit dan Fallah oriented). Jadi kontrak di bank syariah juga menjadi dua, ada kontrak tabarru (berorientasi Fallah) dan tijarah kontrak (profit oriented). Kontrak tabarru umumnya digunakan pada kegiatan perbankan syariah di sektor sosial seperti sebagai produk layanan dan memberikan pinjaman perbuatan baik kepada pelanggan mereka. Kontrak tijarah umumnya digunakan pada produk pembiayaan berbasis bagi hasil, perdagangan, bisnis menyewa segala sesuatunya.Kata Kunci: kontrak, produk, perbankan syariah

Abstract

Despair caused by the loss of hope that makes a person stop hoping. Islam forbids it, because God has promised it easy for His servants who did not despair and continue to be patient in the face the tests of life. At the stop words are lexem HENTI which when analyzed morphologically based linguistics will be able to give a detailed understanding about the lexem. The analysis conducted by derivational and inflectional this will result ideosincretics of rules were found. Thus, an understanding of morphological standpoint this will provide benefits in the needs-oriented communication on the positive things. Finally, communication with the use of positive diction will encourage someone to have a mindset and a way of life that is better aligned with the values of Islam

Abstract

Abstract: Education is expected to support the process of the economic life or even it can affect the way of economic process. It happens because the actors of the economic life is human being themselves. Furthermore, economic development in turn will support the realized educational process needed to develop economy. New economy is the economy based on science. For that reason, educational process needs to emphasize the balancing of moral values, ethics, and economic values; due to the reciprocal relation between them. Keywords: economy, islamic education, policies implementation, moral and ethic values. Abstrak: Pendidikan diharapkan dapat menunjang proses kehidupan ekonomi bahkan dapat mempengaruhi arah dari proses pengembangan ekonomi karena pelaku-pelaku kehidupan ekonomi adalah manusia itu sendiri. Selanjutnya, perkembangan ekonomi pada gilirannya akan menunjang terwujudnya proses pendidikan yang dibutuhkan dalam perkembangan ekonomi. Ekonomi baru adalah ekonomi yang berdasarkan ilmu pengetahuan. Oleh karenanya, proses pendidikan yang perlu menekankan keseimbangan antara nilai-nilai moral dan etika dengan nilai-nilai ekonomi, karena antara nilai-nilai moral, etika, dan nilai-nilai ekonomi mempunyai hubungan timbal balik.Kata kunci: ekonomi, pendidikan Islam, implementasi kebijakan,  nilai moral dan nilai etika

Abstract

The Government regulation of Palangkaraya City in the form of Regional Regulation (Perda) Palangkaraya Number 04 Year 2007 on the Management of Modern Market need special attention. This is because the growth of modern markets in Palangkaraya in recent years has increased very high. This is compounded by how modern market participants who dared to operate before the operational permit issued. From the explanation, the purpose of this paper is to analyze how the management of a modern market in Palangkaraya perspective of Islamic law and the impact of regulation (Perda) on the management of the modern market for traditional market players. In order to achieve these objectives maximally, so this study used qualitative descriptive method, with a normative approach. The results indicate that the regulations (Perda) that have been made by the Government City of Palangkaraya is in line with Islamic law based on the concept of the rule on the basis of fiqh with benefit. Nevertheless, it needs to be replicated again in several articles, because it is irrelevant to the economic conditions in the Palangkaraya City particularly. In addition, it also shows the adverse implications for the existence of traditional markets.

Abstract

AbstractArt and the ability to speak (rhetoric) in front of audiences is needed in various dimensions of life, especially regarding the profession as a da'i. For a preacher (da’i), rhetoric is very vital and urgent to be mastered, because its significance to the  way of  dakwah islamiyah. Rhetoric intended to convey the truth of the Quran and Hadith, to change the audience to run a of the commanding of Allah to the amar ma’ruf nahi munkar. Practically, rhetoric becomes a necessity for the preacher to be able to carry out the mission of preaching in an orderly, well-planned, structured, conceptualized, and systematic.Many verses of the Qur’an lead preachers to use good rhetoric (fannul khitabah) for doing the activity of dakwah. In surah An-Nahl verse 125, Allah explains that, dakwah activity must be done with hikmah,  mau'izhah and Mujadalah.  Mujadalah (dialogue in a good way) in this case is understood as a form of rhetoric. Furthermore, the surah Fushilat verse 33 Allah states that the best word (rhetoric) is to call people when carried into the path of Allah (da'wah). It means that calls to the path of Allah is an activity that is best therefore these efforts should also be done in the best way anyway, having 'stance, continuous and without knowing despair coupled with the nature of genuine (sincere) solely because of GodKeyword: Urgency, Rhetoric, Activity, Da'wah  AbstrakSeni dan kemampuan berbicara (retorika) di depan khalayak yang dibutuhkan dalam berbagai dimensi kehidupan, terutama mengenai profesi sebagai da'i a. Untuk seorang pengkhotbah (da'i), retorika sangat penting dan segera untuk dikuasai, karena maknanya dengan cara dakwah islamiyah. Retorika dimaksudkan untuk menyampaikan kebenaran Al-Quran dan Hadis, untuk mengubah penonton untuk menjalankan dari perintah Allah dengan amar ma'ruf nahi munkar. Bisa dibilang, retorika menjadi suatu keharusan bagi pendeta untuk dapat melaksanakan misi dakwah secara tertib, terencana, terstruktur, dikonsep, dan systematic.Many ayat-ayat Al-Qur'an menyebabkan pengkhotbah untuk menggunakan retorika yang baik (khitbah fannul ) untuk melakukan aktivitas dakwah. Dalam surah An-Nahl ayat 125, Allah menjelaskan bahwa, kegiatan dakwah harus dilakukan dengan hikmah, mauizah dan Mujadilah. Mujadilah (dialog dalam cara yang baik) dalam hal ini dipahami sebagai bentuk retorika. Selain itu, surah Fussilat ayat 33 Allah menyatakan bahwa yang terbaik kata (retorika) adalah untuk memanggil orang-orang ketika dibawa ke jalan Allah (dakwah). Ini berarti bahwa panggilan ke jalan Allah adalah kegiatan yang terbaik karena itu upaya ini juga harus dilakukan dengan cara yang terbaik pula, memiliki 'sikap, terus menerus dan tanpa mengetahui putus asa ditambah dengan sifat asli (tulus) semata-mata karena Allah.Kata Kunci: Urgensi, Rhetorika, Kegiatan, Dakwah

Abstract

The aims of this research are to give the understanding about comparation of System Capital Mudharabah Costing in practice of Shariah Banking with Fiqh, to give understanding about the suitable of the Mudharabah practice in Shariah Banking with the rale of law Shariah Banking, and to give the understanding of the appropriate of Mudharabah practice  in the rale of law Shariah Banking with Fiqh. To give the explanation above through a research with used normative and sociology method and instrument for collecting data are document data given from Mualamah Bangking in Medan. It is showed the practice of the Capital Mudharabah Collecting in Shariah Banking is still not suitable to Shariah principle in Fiqh

Abstract

Abstrak: The majority of ulama maintain that fi sabilillah who is doing war in the name of Allah. However, the rest says that fi sabilillah has boarder meaning that is who good deeds in the name Allah for human being. Interestingly, Yusuf Qardhawi maintains the meaning of fisabilillah of the majority and adds that this meaning includes other activities that bring us closed to Allah and human falah. By this, it is also said that zakah for fisabilillah could be put into public needs and social interest in the name of Allah Keywords: Zakat, Zakat fi Sabilillah, Yusuf Qaradawi, public interest Abstract: Banyak ulama mengatakan bahwa fisabililillah adalah orang yang berperang untuk mempertahankan agama Allah. Namun, sebagian lagi mengatakan bahwa fisabilillah memiliki makna yang lebih umum yang mencakup makna siapa saja yang berjuang dijalan Allah. Oleh karena itu, mayoritas mengatakan bahwa zakat fisabilillah hanya diberikan kepada mereka yang berjuang dan berperang di jalan Allah. Menariknya, Yusuf Qardhawi mempertahankan pandangan mayoritas ulama ini dan menambahkan makna fisabilillah memiliki makna yang lebih umum dalam rangka mendekatkan diri kepada Allah dan kemasalahan umat. Abstract

AbstractModernism in Western society presupposes mind, flow, movement and efforts to revamp understanding, customs, and so long institutions to suit the new environment brought by advances in science and modern technology. This idea emerges in the Western with the aim of adjusting the teachings found in Catholicism and Protestantism with modern science. The flow of ideas and eventually lead to the emergence of secularism in Western societies. Islamic modernists are as people who commit a conscious effort to formulate the values and principles of Islam (Islamic values) in accordance with modern thinking or integrate the ideas and institutions into modern Islam. It is regarded as an attempt to make Islam flexible and people can play a role in the current flowing modernity tightly. This effort is to create latitude for Muslims and can get out of a claim, stagnant, not grounded and conservative.Meanwhile, Islamic traditionalism, sometimes called traditional Islam, is covering a broad sense. Traditional Islam is believed to be authentic. It contains the sanctity of tradition, eternity, truth is certain; perennial wisdom, and also the application of sustainable principles of eternal on diverse conditions of space and time. A traditionalist can be defined as a person who has committed the sharia is the source of all religious teachings and morality. Rashid Rida (1865-1935) is known as a traditionalist thinkers because of his ideas and his desire to establish a caliphate institutions. It lived during the Islamic world is facing the rise of Western imperialism and colonialism while traditional Islamic political order is disintegrating. After the defeat of the Ottoman dynasty in World War I and the advent of Kemalism in Turkey, the Turkish Grand National Assembly decided in 1924 to dissolve the caliphate. These events led to a crisis of identity and give political meaning for Muslims, and encourage the rise of Islamic movements such as the movement Salafiah and the Caliphate. Keywords: Muhammad Rashid Rida, Modernism, Traditionalism AbstrakModernisme dalam masyarakat Barat mengasumsikan pikiran, aliran, gerakan dan usaha untuk merubah pemahaman, kebiasaan, dan lembaga begitu lama untuk menyesuaikan dengan lingkungan baru yang dibawa oleh kemajuan ilmu pengetahuan dan teknologi modern. Ide ini muncul di Barat dengan tujuan menyesuaikan ajaran ditemukan di Katolik dan Protestan dengan ilmu pengetahuan modern. Aliran ide dan akhirnya menyebabkan munculnya sekularisme dalam masyarakat Barat.Modernis Islam adalah sebagai orang yang melakukan upaya sadar untuk merumuskan nilai-nilai dan prinsip-prinsip Islam (nilai-nilai Islam) sesuai dengan pemikiran modern atau mengintegrasikan ide-ide dan institusi dalam Islam modern. Hal ini dianggap sebagai upaya untuk membuat Islam fleksibel dan orang dapat berperan dalam arus yang mengalir modernitas erat. Upaya ini adalah untuk menciptakan lintang bagi umat Islam dan bisa keluar dari klaim, stagnan, tidak beralasan dan konservatif.Sementara itu, tradisionalisme Islam, kadang-kadang disebut Islam tradisional, meliputi arti luas. Islam tradisional diyakini otentik. Ini berisi kesucian tradisi, keabadian, kebenaran yang pasti; kebijaksanaan abadi, dan juga penerapan prinsip-prinsip berkelanjutan abadi pada kondisi yang beragam ruang dan waktu. Sebuah tradisionalis dapat didefinisikan sebagai orang yang telah melakukan syariah adalah sumber dari semua ajaran agama dan moralitas.Rasyid Ridha (1865-1935) dikenal sebagai pemikir tradisionalis karena ide-idenya dan keinginannya untuk mendirikan sebuah lembaga kekhalifahan. Ini hidup pada dunia Islam menghadapi munculnya imperialisme Barat dan kolonialisme sementara pesanan politik Islam tradisional hancur. Setelah kekalahan dari dinasti Ottoman dalam Perang Dunia I dan munculnya Kemalisme di Turki, Turki Grand Majelis Nasional memutuskan pada tahun 1924 untuk membubarkan kekhalifahan.
