ABSTRACTThe dualism of national land law appears before the formation of the agrarian law through the Basic Agrarian Law (BAL), has not been fully terminated. Various opportunities or legal vacuum still encountered, especially in relation to the provision of rights to land based on adat law. Pekulen land derived from adat law with communal characteristics/ joint ownership and land tenure in rotation, in fact is still exist in rural Java. Its posision became an important element in the village agrarian structure has the potential to make agrarian justice through policies at the local level.INTISARIDualisme hukum tanah nasional yang muncul sebelum terbentuknya hukum agraria melalui UUPA, belum sepenuhnya dapat diakhiri. Berbagai peluang atau kekosongan hukum masih ditemui terutama dalam kaitannya pengaturan hak atas tanah yang berdasar pada hukum adat. Tanah pekulen yang bersumber dari hukum adat dengan karakteristik komunal/ pemilikan bersama serta penguasaannya secara bergilir, pada kenyataannya masih ada di wilayah pedesaan di Jawa. Kedudukannya menjadi unsur penting dalam struktur agraria desa karena berpotensi menjadi sarana pencipta keadilan agraria melalui kebijakan di tingkat lokal.

The main objective of an aircraft accident investigation is to find out the most probable causes of such accident. This represents a technical investigation in nature. At the practical level, however, this report is often used as legal evidence before the court. This paper argues that the main purpose of an aircraft acccident investigation is technical in nature and judicial investigation is carried out when the technical investigation found elements of crime that has been alleged as the most probable cause of the accident. Menurut Konvensi Chicago 1944, tujuan utama suatu investigasi kecelakaan pesawat udara adalah untuk menemukan penyebab terjadinya kecelakaan tersebut. Jadi, investigasi ini bersifat teknis. Namun, laporan investigasi ini seringkali dijadikan alat bukti di pengadilan khususnya apabila faktor kesalahan manusia dianggap sebagai penyebab utama terjadinya kecelakaan tersebut. Investigasi teknis berubah menjadi investigasi yuridis. Tulisan ini berpendapat bahwa hakikat investigasi kecelakaan pesawat udara adalah bersifat teknis dan investigasi yuridis hanya akan dilakukan apabila laporan investigasi teknis menunjukkan adanya elemen kriminal.

This research analyzes Law No. 30 of 1999 of Indonesia to ascertain whether this Indonesian law constitutes modern arbitration legislation in the context of international commercial arbitration. Law No. 30 of 1999 will be compared with the International Arbitration Act 1974 (Cth) and the International Arbitration Amendment Act 2010 (Cth) of Australia. In this research, the author finds the Model Law should be adopted by Indonesia to modernize the country’s arbitration law in order for it to more acceptable in the practices of international commersial arbitration to day. Furthermore, the adaption of the Model Law also assists to clarity the Indonesian approach to the appircation of public policy principle which can be used to resest arbitral awards in Indonesia. Penelitian ini mempelajari Undang-undang Nomor 30 Tahun 1999 untuk mengetahui apakah hukum di Indonesia tergolong ke dalam aturan arbitrase modern dalam arbitrase komersial internasional. Penulis membandingkan Undang-undang Nomor 30 Tahun 1999 dengan International Arbitration Act 1974 (Cth) dan International Arbitration Amendment Act 2010 (Cth) di Australia. Dalam penelitian ini, penulis menemukan bahwa Model Law dapat diadopsi oleh Indonesia untuk memodernisasikan hukum arbitrasenya agar dapat lebih diterima dalam praktek arbitrase niaga internasional. Diadopsinya Model Law dapat juga membantu mengklarifikasi pendekatan Indonesia terhadap aplikasi kebijakan publik yang dapat dipergunakan untuk menentang putusan arbitrase di Indonesia.

Pollution has become one of the most significant problems in the environmental issues. Aside the effect of the pollution, another substantial factor of pollution is the character of the pollutant. Among several pollutant substances in the world, there are twelve main persistent organic pollutants, which are still in large and freely mobilized in our environment. On November 2001, the United Nations Environmental Program has issued a convention about persistent organic pollutants. So many enthusiasms from the states about this progress, as well as Indonesia did. However, after more than seven years, Indonesia has not submitted the ratification paper of this convention. This paper aims to analyze and elaborate the issues behind this convention and the urgency of submitting the ratification of Indonesian government.

The issue of the sales of Indonesian Islands to non-Indonesian Citizen has seized the attention of Indonesian people nationally. It is thought that such sales will affects the sovereignty of Indonesia’s territory. This article will focus on two main issues, namely how the rule of law regulates acquisition and management of areas that go to the sovereignty of a country and how or what the main problems faced by Indonesia in maintaining the territorial integrity of the Republic of Indonesia, especially the business of selling some islands to non-Indonesian citizens. Isu penjualan beberapa pulau di Indonesia kepada warga Negara asing telah menyita perhatian masyarakat Indonesia secara nasional. Diperkirakan bahwa penjualan tersebut akan mempengaruhi kedaulatan wilayah Indonesia. Artikel ini akan fokus pada dua isu utama, yaitu bagaimana aturan hukum mengatur dalam hal perolehan dan pengelolaan kawasan yang masuk dalam kedaulatan suatu negara dan bagaimana atau apa masalah utama yang dihadapi oleh Indonesia dalam menjaga keutuhan wilayah Republik Indonesia, khususnya bisnis penjualan beberapa pulau kepada pihak asing.

Children’s rights are well-established through various international conventions. But, international conventions do not wellimplemented in Indonesian law. Besides that, international convention is often interpreted differently in Indonesian law. To guarantee children’s rights, the government and society of Indonesia must be effort to implement international conventions already ratified correctly. Hak-hak anak sudah diatur dengan baik melalui berbagai konvensi internasional. Tetapi, konvensi internasional tidak diimplementasikan dengan baik dalam hukum Indonesia. Selain itu, hukum Indonesia sering menginterpretasikan hukum internasional secara berbeda. Untuk menjamin hak anak, pemerintah dan masyarakat Indonesia harus berusaha untuk mengimplementasikan konvensi internasional dengan tepat.

Sunset policy is a policy which decreases the amount of administrative sanction in the form of interest. This policy is governed by Article 37A Act Number 28 of 2007. The target of sunset policy is the taxpayer who has good faith either to admit having insufficient payment of income tax or to have willed to register a tax file number (NPWP). However, the time of sunset policy is limited; it takes only 1 (one) year to apply the policy from 1 January to 31 December 2008. The research found that first, in tax law side sunset policy has the same legal meaning as kwijtschelding. The same legal meaning refers to the same characteristics found both in sunset policy and in kwijtschelding. Second, the internal target was not achieved until November 2008 as a result there was less contribution to the increasing amount of income tax revenue in DIY.

AbstractIn the publishing of certificates of land rights, the government should be able to provide legal certainty. Legal certainty can be achieved if the government’s actions performed accountable. Transparency in land registration is the most important thing in the case of registration of land in order that the maintenance and services procedures run as expected by the public. The effect of the principle of transparency sustainably, it is expected that the information relating to the publishing of a certificate to be accessible to all parties so that if there is information that is considered wrong to do immediate repair. IntisariDalam penerbitan sertifikat hak atas tanah, maka pemerintah harus dapat memberikan kepastian hukum. Kepastian hukum dapat terwujud apabila tindakan pemerintah dilakukan secara akuntabel. Transparansi dalam pendaftaran tanah merupakan hal terpenting dalam hal pendaftaran tanah agar prosedur pengurusan dan pelayanan berjalan seperti yang diharapkan oleh masyarakat. Dengan dilakukannya prinsip transparansi secara berkesinambungan, maka diharapkan informasi yang berkaitan dengan proses hingga penerbitan sertifikat dapat diakses oleh semua pihak sehingga apabila ada informasi yang dianggap keliru segera dapat dilakukan perbaikan.

Limited Liability Companies have completeness instrument called organ corporation which consists of General Meeting of Shareholders (GMS), the board of directors, and the board of commissioners. According to Commercial Law (KUHD), Act No. 1 of 1995 jo. Act No. 40 of 2007 on Limited Liability Companies, the principle liability of General Meeting of Shareholders (GMS) is limited on their share. But, if it is proven that, among others, there has been a mixing of the shareholder’s personal assets and the Company’s assets, so the limited liability turns into unlimited liability or personal liability. Perseroan Terbatas (PT) memiliki alat kelengkapan yang disebut organ perseroan terdiri dari Rapat Umum Pemegang Saham (RUPS), Direksi dan Dewan Komisaris. Menurut Kitab Undang-Undang Hukum Dagang (KUHD), UU PT No. 1 Tahun 1995 jo. UU PT No. 40 Tahun 2007, tanggung jawab Pemegang Saham (RUPS) pada prinsipnya adalah bersifat terbatas pada saham yang dimiliki. Akan tetapi, apabila dapat dibuktikan bahwa telah terjadi pembauran harta kekayaan pribadi Pemegang Saham dengan harta kekayaan perseroan, maka tanggung jawab terbatas tersebut akan berubah menjadi tanggung jawab tidak terbatas atau tanggung jawab pribadi.

This article attempts to analyse Indonesia’s legal system. We will discuss how the dynamics of constitutional arrangement affect regional authorities. The correlation between regional autonomy and legal pluralism, for instance the unique implementation of sharia law in Aceh province, will also be discussed. Tulisan ini membahas sistem hukum Indonesia. Dalam tulisan ini akan dianalisis bagaimana dinamika aturan konstitusi mempengaruhi kewenangan daerah. Hubungan antara otonomi daerah dengan pluralisme sistem hukum, misalnya penerapan hukum syariah di provinsi Aceh, juga akan dibahas di sini.
