Abstract

Islamic law prohibits monopoly. The issue had arose since the advent of Islam, whereby it’s used as a strategy to maximize profit, has experienced rapid developments. This article assess the extent of Islamic law in prohibiting monopoly using law and economics approach. The result is that the exercise of caution shall apply in prohibiting monopoly. There are three steps needed in exercising the rule of caution: (1) defining monopoly as the absence of competition and lack of pricing options; (2) providing criteria of what causes monopoly in form of agreements between business competitors who can go against allocative efficiency effectively; and (3) direct the prohibition on monopoly towards agreement on explicit horizontal mergers and very large horizontal mergers which disregards quick mergers. Hukum Islam melarang monopoli. Isunya adalah sejak kedatangan Islam strategi pelaku usaha untuk memaksimalkan keuntungan telah berkembang pesat. Tulisan ini menentukan jangkauan hukum Islam untuk melarang monopoli dengan pendekatan hukum dan ekonomi. Hasilnya kehati-hatian dalam melarang monopoli. Tulisan menguraikan tiga langkah yang dibutuhkan: (1) memaknai monopoli sebagai ketidakhadiran persaingan dan ketiadaan pilihan harga; (2) memberikan kriteria monopoli berupa kesepakatan antar pelaku usaha pesaing yang mampu melawan efisiensi alokasi secara efektif; dan (3) mengarahkan larangan monopoli pada perjanjian horisontal eksplisit dan penggabungan berukuran besar.

Abstract

AbstractThis research is based on the case of airport development in Kulonprogo Regency. The findings in this study are: First, contradictions RTRW Kulonprogo District with RTRWN, RTRW DIY Province, and RZWP3K DIY Province not in accordance with Article 7 paragraph (1) and (2) of Law No. 12 of 2011 on the Establishment of Laws and Regulations. Second, contradictions RTRW Kulonprogo District with RTRWN, RTRW DIY Province, and RZWP3K DIY Province is not in accordance with Article 14 paragraph (2) of Law No. 26 of 2007 on Spatial Planning. Here are some mitigating actions over the contradiction between Article 18 of Regional Regulation of Kulonprogo Regency RTRW: through examination in the Constitutional Court; with the cancellation of Regional Act by the Governor; and, with the amendment the norms of Article 91 Paragraph (2) of the Regional Government Law.IntisariPenelitian ini dilaksanakan terhadap kasus pembangunan bandar udara di Kabupaten Kulonprogo. Temuan dalam penelitian ini diantaranya: Pertama, RTRW Kabupaten Kulonprogo bertentangan dengan RTRWN, RTRW Provinsi DIY, RZWP3K Provinsi DIY, dan Pasal 7 ayat (1) dan (2) UU No. 12 Tahun 2011. Kedua, RTRW Kabupaten Kulonprogo bertentangan dengan Pasal 14 ayat (2) UU No. 26 Tahun 2007. Untuk memitigasi ketentuan dalam Pasal 18 RTRW Kabupaten Kulonprogo, yang harus dilakukan adalah: Pertama, melalui uji material di MA. Kedua, dengan pembatalan Peraturan Daerah oleh Gubernur. Ketiga, dengan perubahan Pasal 91 ayat (2) UU No. 23 Tahun 2014.

Abstract

This study examines the preventive measures that can be taken by the Indonesian Stock Exchange (IDX) in their capacity as an SRO in response to capital market infractions. The main role of IDX is as a provider of facilities and infrastructure in capital market activities. Nonetheless, as a self- regulatory organization (SRO) IDX has additional role as regulator of the capital markets with limited authority. This study found that IDX was quite consistent in upholding the legislation in the field of capital markets. However, compliance level of the exchange members is still quite low. Penelitian ini meneliti langkah-langkah pencegahan pelanggaran dan kejahatan pasar modal yang dapat diambil oleh BEI dalam kapasitasnya sebagai SRO. Peran utama BEI adalah sebagai penyedia sarana dan prasarana dalam kegiatan kepasarmodalan. Meskipun demikian, sebagai self-regulatory organization(SRO) BEI mempunyai peran tambahan sebagai regulator pasar modal dengan kewenangan terbatas dalam menetapkan peraturan. Penelitian ini menemukan bahwa BEI telah cukup konsisten dalam menegakkan peraturan perundang-undangan di bidang pasar modal. Akan tetapi tingkat kepatuhan anggota bursa dapat dikatakan masih cukup rendah.

Abstract

Political parties have the authority to recall the members of parliament, even make his party membership revoked if a member violates the party’s policy. This is because the nomination of members of parliament nominated by political parties. However, the Constitutional Court decision has changed the mechanism of the serial number be a majority vote in determining who sits in parliament. Partai politik memiliki wewenang untuk me-recall anggotanya dari parlemen, bahkan mencabut keanggotaan seseorang dari partainya apabila anggota tersebut melanggar kebijakan partai. Hal ini dikarenakan pencalonan anggota parlemen diusulkan oleh partai politik. Namun, putusan Mahkamah Konstitusi telah mengubah mekanisme nomor urut menjadi suara terbanyak dalam menentukan siapa yang duduk di parlemen.

Abstract

Most Islamic scholars agree that underage marriage is permissible under certain conditions. Furthermore, supported by the fact that our legal system does not incriminate such marriage and there is still controversy in the society regarding this issue, underage marriage should not be criminalized in the future laws. Kebanyakan ulama Muslim sepakat bahwa pernikahan di bawah umur halal dengan beberapa syarat. Dengan demikian, didukung dengan fakta bahwa sistem hukum kita tidak mengkriminalisasi pernikahan seperti itu dan bahwa isu ini masih menjadi perdebatan di masyarakat, pernikahan dini tidak boleh dikriminalisasi dalam hukum yang akan datang.

Abstract

With both national and international dimensions influencing the utilization of marine fisheries resources in Indonesia’s Exclusive Economic Zone, a comprehensive regulation is needed. Hence the importance of making sure that National Regulations are in accordance with International Regulations, while still maintaining the best of interests for the people and accommodating for the people’s welfare. In reality, international community depends heavily on natural marine fisheries resources for their people’s nutrients need.

Abstract

This paper discusses the Constitutional Court Decision Number 36/PUU-X/2012 concerning judicial review of Law Number 22 Year 2001 on Oil and Gas, which contains the dissolution judgment Oil and Gas Executive Agency (BP Migas). This study focuses on meaning of the State Control over Oil and Natural as resources which is considered to be degraded by the presence of BP Migas and the legal consequences after the dissolution of BP Migas, the impact of the dissolution to institution of the above mentioned, BP Migas, the contract of cooperation and the status of their employees. Tulisan ini membahas tentang Putusan Mahkamah Konstitusi Nomor 36/PUU-X/2012 perihal Pengujian Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi, putusan yang berisi pembubaran Badan Pelaksana Minyak dan Gas Bumi (BP Migas), kajian ini menitikberatkan pada makna Penguasaan Negara atas Sumber Daya Alam Migas yang dianggap telah terdegradasi oleh keberadaan BP Migas dan apa akibat hukum pasca pembubaran BP Migas terhadap kelembagaan, kontrak kerja sama, status pengawas BP Migas.

Abstract

In this study, will be assessed the implementation of corporate social responsibility by coal corporate to look for an alternative model of corporate social responsibility and environtment protection in the context of protecting and managing of natural resources with environmentally concept. Juridical with conceptual approach, the source analysis data technique derived from literature studies and documents. Dalam penelitian ini akan dikaji pelaksanaan tanggung jawab sosial perusahaan dan lingkungan oleh perusahaan batubara untuk kemudian mencari model alternatif tanggung jawab sosial perusahaan dan lingkungan dalam konteks perlindungan dan pengelolaan sumberdaya alam yang berwawasan lingkungan. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan undangundang dan pendekatan konseptual, sumber data yang digukana diperoleh dari studi kepustakaan, teknik analisa data diperoleh dari studi literatur dan dokumen.

Abstract

The increasing number of the use of arbitration in Asia has highlighted the significant influence of the recognition and enforcement of arbitral awards. The New York Convention currently becomes the most widely accepted convention to which the courts would refer when recognizing and enforcing foreign arbitral awards. This article would firstly provide a comparative study of the court’s interpretation towards public policy as mentioned under Article V (2) b of the New York Convention between non-arbitration-friendly-law Indonesia and arbitration-friendly-law China. Subsequently, it will discuss whether uniformity in interpreting and reserving public policy is required or not. Peningkatan jumlah penggunaan lembaga arbitrasi di Asia mendorong peningkatan signifikansi pengakuan dan pelaksanaan putusan arbitrasi asing. Konvensi New York saat ini menjadi konvensi yang diterima secara luas dimana dijadikan referensi oleh pengadilan dalam hal pengakuan dan pelaksanaan putusan arbitrasi asing. Artikel ini akan pertama-tama membahas studi perbandingan atas interpretasi pengadilan mengenai penggunaan kebijakan publik sebagaimana tertera pada Pasal V (2) b Konvensi New York antara Indonesia yang hukumnya tidak mendukung dan China dengan hukum yang mendukung pengakuan dan pelaksanaan putusan arbitrasi asing. Apakah keseragaman antar negara dalam menginterpretasi dan menggunakan kebijakan publik diperlukan atau tidak dibahas pada diskusi selanjutnya.
