Abstract

The Attorney General can discontinue the investigation to the default tax obligor together with the imposition of four times of outstanding fines. That are raises the issues concerning the nature of the crimes of the tax obligor. This happens because with the payment of the tax debt, the loss suffered by the state as the element of crime, the crimes seemed to be inexistence. This research was an empirical-juridical one. The aim of the research was to find a model of legal enforcement in tax matters without the court involvement. Jaksa Agung dapat menghentikan penyidikan terhadap wajib pajak apabila wajib pajak tersebut membayar pajak yang terutang beserta denda 4 (empat) kali jumlah pajak yang tidak/kurang dibayar. Hal tersebut menimbulkan persoalan mengenai akibat hukumnya terhadap sifat perbuatan pidana yang dilakukan wajib pajak mengingat dengan pelunasan pajak tersebut, kerugian negara sebagai unsur tindak pidana tidak terjadi. Penelitian ini merupakan penelitian yuridis empiris dengan tujuan menemukan model penegakan hukum di bidang pajak tanpa melalui proses pengadilan.

Abstract

This paper examines the effectiveness of law enforcement on Domestic Violence in Indonesia from a sociological perspective. Soerjono Soekanto believes that the effectiveness of law enforcement is determined by a number of factor, i.e. law enforcers, facilities, legal awareness, legal norms, and legal culture. Sociological perspectives was chosen because law enforcement is an effort to implement the law in a society that necessitates the interaction between the law as a normative provisions with elements in society, such as values and morals. In Indonesia, the law on domestic violence, which has been crystallised by the enactment of Act Nr. 20 of 2003, has not been able to be effectively enforced to ensure protection for victims of domestic violence. Tulisan ini bertujuan untuk mengkaji efektivitas penegakan hukum tentang kekerasan dalam rumah tangga di Indonesia dari perspektif sosiologis. Soerjono Soekanto mengatakan bahwa efektif atau tidaknya penegakan hukum dalam masyarakat ditentukan oleh beberapa faktor, yaitu aparat hukum, fasilitas hukum, kesadaran hukum, kaidah hukum, dan budaya hukum. Perspektif sosiologis dipilih dalam kajian karena penegakan hukum tidak lain adalah upaya melaksanakan hukum dalam masyarakat yang meniscayakan terjadinya interaksi antara hukum sebagai ketentuan normatif dengan unsur-unsur dalam masyarakat, seperti nilai, institusi, norma dan lain-lain. Hukum tentang kekerasan dalam rumah tangga yang diberlakukan melalui Undang-Undang No. 20 Tahun 2003 hingga saat ini belum sepenuhnya

Abstract

The aim of this research is to describe the regulation of Baluwarti land. As agreement between Surakarta government, Baluwarti society and keraton Surakarta relatives about the meaning of keraton Surakarta and the property of Baluwarti land. This research uses quality method with socio-legal study approach. The data consist if primary and secondary sort. The sources of the first data are keraton Surakarta relatives, the apparatus of Surakarta government and Baluwarti society, while the second are public and personeal data and the legally data. There were two ways to teke the primary data, namely observation and interview. Secondary had been gathered through library study, analysis of document, archives, primary and secondary legal data. Trianggulation method had been used to check the validity of data. The analysist consist of three ways used in the same moment, namely data reduction, data serve and verification. The interpretation had been used to understand the meaning of the information and the relation among it. The composition of the meaning relation depents on the thougt frame of the informant. As result of the discussion of this research is the harmonious opinion between Surakarta gavernment, Baluwarti society and keraton Surakarta reltives thet keraton Surakarta is the adat institution. It is also the guardian of Javanese culture and the tourism destinatiun. Each of them uses legal culture of Javanese as their frame of opinion. The opinion of part of keraton Surakarta relatives that keraton Surakarta is the governance center can’t be received. Such opinion isn’t compatable with the aspiration of Surakarta government and Baluwarti society. It is also able to cause the social violetry. There is a different opinion between keraton Surakarta relatives, government of Surakarta and Baluwarti society about the meaning of property of Baluwarti land. According to Baluwarti society and Surakarta government, Baluwarti land is the state property. On the other side, as for keraton Surakarta relatives, Baluwarti land is Sinuhun property delegated to Parentah Keraton Surakarta. But actually the three sides have the same interest. All of them hope that the existention of keraton Surakarta can give them economic constribution. The same interest is the foudation of the regulation of Baluwarti society as the cultural guardian. The source of Baluwarti land is the nation property, while Surakarta government regulates the relation between Sri Susuhunan and keraton relatives, person and corporation with Baluwarti land. The owner of Baluwarti property is Sri Susuhunan as the chief of keraton Surakarta relatives.

Abstract

Abstract. Background of this article is, although it was first emerged in Common Law system countries, the practice of class action has been growing in Indonesia. This mechanism brings an opportunity to simplified the court’ process and to reduce the risk of disparity judgements. This article found similarities and differences scope and procedure of certification in Indonesia and the USA. Before examining the case, a presiding judges, accordingly to Supreme Court Regulation Number 1 Year 2002 concerning Procedure of Class Action, have to determine whether the case is eligible to be examine as class action case. This procedure is universally well-known as certification mainly focuses on the fulfilment of class action’s substantive requirements: numerosity, commonality, typicality and adequacy of representation and formal requirements. The similar requirements are also implemented in the USA accordingly to Federal Rule of Civil Procedure, Rule 23 Class Action. However, in those countries have different procedure when it comes to legal remedy to the certification order, mechanism to opt-out in case of settlement or withdrawal, the role of judge in assisting poor litigants and determining counsel’s fee. This article recommends Indonesia has to amend the Supreme Court regulation to add provisions on legal remedy, and mechanism to opt-out in case of settlement or withdrawal.

Abstract

AbstractThe term Four Pillar became a public debate. The main problem is the use of the Four Pillars term consisting of Pancasila, the 1945 Constitution, NKRI, and Bhinneka Tunggal Ika has raised questions from the community. This research is a qualitative research that examines the existing norms and legislation through the normative laws approach. The purpose of this research is to analyze the normative laws and the impact of the Constitutional Court’s decision on the use of the Four Pillars term. The Constitutional Court’s decision is in accordance with the logic of legal language and the prevailing rules related to the concept and the nature of Pancasila, the 1945 Constitution, the Unitary State of the Republic of Indonesia, and Unity in Diversity can not be categorized into one of the same variants is true. In this case the MPR RI has made a mistake in the language logic using the term 4 Pilar MPR RI. IntisariIstilah Empat Pilar menjadi perdebatan publik. Pokok persoalannya yaitu penggunaan istilah Empat Pilar yang terdiri atas Pancasila, UUD 1945, NKRI, dan Bhinneka Tunggal Ika telah menimbulkan pertanyaan dari masyarakat. Penelitian ini merupakan penelitian kualitatif yang mengkaji norma dan peraturan perundang-undangan yang ada melalui pendekatan penelitian hukum normatif. Tujuan penelitian ini adalah menganalisis dasar normatif dampak putusan MK terhadap penggunaan istilah Empat Pilar. Putusan MK telah sesuai dengan kaidah logika bahasa hukum dan kaidah yang berlaku terkait dengan konsep dan hakikat Pancasila, UUD 1945, NKRI, dan Bhinneka Tunggal Ika tidak dapat dikategorikan menjadi satu varian yang sama. Dalam hal ini MPR RI telah melakukan kesalahan logika bahasa dalam menggunakan istilah 4 Pilar MPR RI.

Abstract

Children are part of the younger generation as one of the human resources as potential successors inthe future. Violation of law that occurs in the community not only done by adults but also by children,the implementation of the sentence would have been very different from adults. In children should morebe rehabilitation rather than punitive. The results showed that judge who examine and rule on cases ofchildren in conflict with the law in District Court Lhokseumawe still think positivistic/legalistic wheredecisions are decided by the judges commonly used approach based on the criminal justice system.

Abstract

The policy of human rights protection for prisoners in penitentiary DIY using combination method which are elite policy and rational policy. The application of elite policy is having correlation with prisoner’s human rights protection, where as the type of rights, just followed what has been set in the legislation of policy. More over the policy changes as outlined in the legislation just a patchwork. As for rational policy method can be seen in the implementation of human rights compliance for prisoners, which is in real life required the creativity of penitentiary’s officers considering humanity aspect. Kebijakan perlindungan hak asasi manusia terhadap narapidana di lingkungan lembaga pemasyarakatan se-DIY cenderung menggunakan model kebijakan elite. Hal ini bisa dilihat dari pemberian perlindungan hak narapidana yang hanya mengikuti apa yang telah diatur dalam kebijakan-kebijakan pusat. Selain itu, perubahan kebijakan yang dituangkan dalam peraturan perundangan hanya sekedar tambal sulam. Namun demikian, dalam pelaksanaan teknis pada kenyataannya mengharuskan kreativitas petugas lembaga pemasyarakatan sesuai dengan kebutuhan lapangan mengingat aspek kemanusiaan. Namun aspek kreativitas ini tetap mendasarkan pada peraturan yang ada. Dengan demikian terdapat juga sedikit unsur model kebijakan rasional dalam tahap pelaksanaan pemenuhan HAM narapidana.

Abstract

Any legal development shall be coming along with the development of civilization. Building the whole society to be more civilized–to live by the standardized customs, religions and in accordance with any cultural values to be well-institutionalized normatively in the life of people. The standardization of law in normative form is to adopt legal policy of law transplantation deriving from foreign tradition and culture to be transplanted into model of law in home country. Quite often, such legal transplantation is not effective to be implemented. In the case of Indonesian copyright, the law which was before standardized eventually becomes coagulated. Pembangunan hukum sebenarnya adalah pembangunan peradaban. Membangun masyarakat agar bisa hidup beradab. Hidup dengan standar adat istiadat, kebiasaan, moral, religius dan nilai-nilai kultur yang dibakukan secara normatif. Pembakuan hukum dalam bentuk normatif dengan memilih politik hukum transplantasi adalah memilih model hukum yang berasal dari kultur atau budaya asing untuk dicangkokkan menjadi model hukum di negeri sendiri. Kerap kali hukum hasil pencangkokkan itu tak cukup efektif untuk diterapkan. Dalam kasus transplantasi undang-undang hak cipta Indonesia, hukum yang semula dibakukan akhirnya menjadi hukum yang dibekukan.

Abstract

AbstractThe issue to be discussed in this article is the internalisation process of international human rights standards into domestic forum through the judicial review mechanism of the constitutionality of legislation by the MKRI. This article argues that MKRI should consider international human rights standards in reviewing the constitutionality of legislation based on Ch. XA of the UUD NRI 1945. The argument based on the prescription that the international human rights standard are binding on States and requiring them to conform their laws and their offcial behavior to the international norm.IntisariTulisan ini membahas isu proses internalisasi standar HAM internasional dalam forum domestik melalui mekanisme pengujian konstitusionalitas undang-undang oleh MKRI. Tulisan ini berargumen bahwa MKRI seyogianya mempertimbangkan standar HAM internasional dalam menguji konstitusionalitas undangundang berdasarkan Bab XA UUD NRI 1945. Argumen itu didasarkan pada preskripsi bahwa standar HAM internasional berlaku/mengikat kepada negara dan mensyaratkannya untuk menyesuaikan undangundang beserta tindakan pejabatnya dengan kaidah HAM internasional tersebut

Abstract

Many Indonesians have committed themselves into a mixed marriage, both in Indonesia and outside the country. Mixed marriage would mean that there are differing nationalities who abide under two different state laws and as consequence of this, issues of private international law in joint property would emerge. On the status of ownership on immovable assets such as land, the nationality principle must be paid attention to, because according to Indonesian law, only Indonesian citizens may have access to Land Ownership Rights. Thus, in mixed marriages, foreign spouses (husband or wife) may not have land ownership rights. Masyarakat Indonesia banyak yang melakukan perkawinan campuran, baik yang dilakukan di Indonesia maupun di luar negeri. Pelaksanaan perkawinan campuran menyebabkan adanya perbedaan kewarganegaraan dimana mereka tunduk pada sistem hukum yang berlainan sehingga melahirkan masalah hukum perdata internasional dalam pengaturan harta bersama. Mengenai status kepemilikan atas benda tidak bergerak seperti tanah, terdapat asas nasionalitas yang harus diperhatikan, yaitu hanya WNI saja yang boleh mempunyai Hak Milik Atas Tanah. Oleh karena itu, dalam perkawinan campuran, suami atau istri yang berkewarganegaraan asing tidak boleh mempunyai hak milik atas tanah.
