AbstractThis research, which has a title “Legal Aspect Of Community Participation In Preservation Of Cultural Heritage (Study on Cultural Heritage School by Cultural Heritage Preservation Office Special Province of Yogyakarta)”, is to examine the implementation of Cultural Heritage School by Cultural Heritage Preservation Office Special Province of Yogyakarta as a form of community participation in preservation for cultural heritage, and to study the setting of School of Cultural Heritage in the future in order to instill public awareness of the preservation of cultural heritage.This research is an empirical law study. The research material was obtained by field research to obtain primary data and library research to obtain secondary data. Data analysis method used is descriptive qualitative.The results of this research are: First, the School of Cultural Heritage is a new program launched in 2017. The implementation of the activities is intended as an effort of socialization for the community, especially the younger generation, which is packed in the form of cultural heritage learning at school or in the office of Cultural Heritage Preservation Office Special Province of Yogyakarta and the cultural heritage site. Second, the setting of School of Cultural Heritage based on community participation and sustainable is to make the School of Cultural Heritage as a local content in the primary and secondary school curriculum. The need for this activity is set forth in the form of Governor Regulation on Local Content of Cultural Heritage and Governor Regulation concerning School of Cultural Heritage.IntisariPenelitian dengan judul “Aspek Hukum Peran Serta Masyarakat Dalam Pelestarian Cagar Budaya (Studi Terhadap Sekolah Cagar Budaya Balai Pelestarian Cagar Budaya Provinsi Daerah Istimewa Yogyakarta” ini bertujuan untuk mengkaji pelaksanaan Sekolah Cagar Budaya oleh BPCB DIY sebagai salah satu bentuk peran serta masyarakat dalam pelestarian cagar budaya dan untuk mengkaji pengaturan Sekolah Cagar Budaya oleh BPCB DIY di masa yang akan datang dalam tujuannya untuk menanamkan kepedulian masyarakat terhadap pelestarian cagar budaya.Penelitian ini merupakan penelitian hukum empiris. Bahan penelitian didapat dengan penelitian lapangan untuk memperoleh data primer dan penelitian kepustakaan untuk memperoleh data sekunder. Metode analisis data yang digunakan adalah deskriptif kualitatif.Hasil penelitian ini adalah: Pertama, Sekolah Cagar Budaya merupakan program baru yang diluncurkan pada tahun 2017. Pelaksanaan kegiatan dimaksudkan sebagai upaya sosialisasi bagi masyarakat terutama generasi muda, yang dikemas dalam bentuk pembelajaran cagar budaya di sekolah atau di kantor BPCB DIY dan di situs cagar budaya. Kedua, pengaturan Sekolah Cagar Budaya berbasis partisipasi masyarakat dan berkelanjutan adalah menjadikan Sekolah Cagar Budaya sebagai muatan lokal dalam kurikulum sekolah dasar dan menengah. Perlunya kegiatan ini dituangkan dalam bentuk Peraturan Gubernur tentang Muatan Lokal Cagar Budaya dan Peraturan Gubernur tentang Sekolah Cagar Budaya.

Constitutional Court Decision 27/PUU-XI/2011 followed up by the Minister of Manpower and Transmigration No. 19 of 2012 is still causing problems. Therefore, this article discussed the outsourcing arrangement after the enactment of the Minister of Manpower and Transmigration No. 19 of 2012. The result of this paper was outsourcing arrangement according to the Minister of Manpower and Transmigration No.19 of 2012 was not yet right. Putusan Mahkamah Konstitusi No. 27/PUU-XI/2011 yang ditindaklanjuti oleh Peraturan Menteri Tenaga Kerja dan Transmigrasi No. 19 Tahun 2012 masih menimbulkan permasalahan. Oleh karena itu, tulisan ini membahas mengenai pengaturan outsourcingsetelah ditetapkannya Peraturan Menteri Tenaga Kerja dan Transmigrasi No. 19 Tahun 2012. Hasil dari tulisan ini adalah pengaturan outsourcingmenurut peraturan Menteri Ketenagakerjaan dan Transmigrasi No. 19 Tahun 2012 masih belumlah tepat.

A total of 1,151 secular judges were hired 2002-2009 from 138 law schools. Approximately 70% of Indonesia’s secular judges were recruited 2002-09 from 19 law schools. Beyond law faculty quality, a bias toward “geographic diversity” is also evident. Comments are also made on changing educational demographics of religious judges and further research goals.Sepanjang 2002-2009, 1.151 orang hakim non-pengadilan agama direkrut dari 138 fakultas hukum di Indonesia dengan hampir 70% berasal dari 19 fakultas hukum. Tulisan ini menemukan bahwa kualitas fakultas hukum dan sebaran wilayah geografis mempengaruhi pola rekrutmen hakim. Wacana perubahan demografi pendidikan hakim-hakim pengadilan agama juga dibahas dalam tulisan ini.

Law of naval warfare did not develop since Den Haag Convention in 1907. In 1994, international community was succeeding in making a regulation on naval warfare, which could be used by countries, which did naval warfare. That regulation called San Remo Manual. This Manual was prepared by famous international law scholars and members of navy around the world, in their individual capacity. The making of this Manual can be done with fully supported from International Institute of International Humanitarian Law and International Committee of the Red Cross. However, in international law, San Remo Manual does not have law enforcement and can not be the source of international law if there are armed conflicts between states in naval warfare. In order to be categorized as the source of international law, this manual should be in the form of an international convention or until all of the regulation in this Manual becomes an international customary law.

AbstractThe Ramsar Convention have been transformed and implemented into Indonesian law. In practice, still found non-synchronized regulations that have not been able to implement the sustainable and wise use of wetlands. The prevention of peatland degradation must be holistic by involving the community and make intens socialization in order to create a sense of belonging and ownership. It is the purpose of this article to analyze the implementation of the Ramsar Convention 1971 on the peatland ecosystem protection and management at Tanjung Puting National Park, Central Kalimantan, and related to how Government efforts and policy to prevent the degradation of peatland since it was established as Ramsar Site in Indonesia.IntisariKetentuan-ketentuan dalam Konvensi Ramsar telah dilaksanakan dan ditransformasikan ke dalam peraturan perundang-undangan di Indonesia. Dalam praktiknya, masih ditemukan peraturan-peraturan yang tidak sinkron, sehingga belum dapat melaksanakan komitmen pemanfaatan lahan basah secara bijaksana dan berkelanjutan. Upaya pencegahan degradasi gambut harus dilaksanakan secara holistik dengan mengikutsertakan masyarakat dan mengintensifkan sosialisasi agar tercipta sense of belonging, dan ownership. Penelitian ini bertujuan untuk menganalisis implementasi Konvensi Ramsar 1971 terkait perlindungan dan pengelolaan ekosistem gambut di Taman Nasional Tanjung Puting, Kalimantan Tengah. Sekaligus untuk melihat sejauh mana upaya Pemerintah dalam mencegah degradasi ekosistem gambut, sejak Tanjung Puting ditetapkan sebagai Situs Ramsar di Indonesia.

This article talks about dispute between costumer and the bank. Settlement of disputes should be resolved by the principle of fast, accurate and cheap. Issues raised in this paper is how an ideal dispute resolution process to resolve dispute banking. This paper describes the advantages and disadvantages in any dispute resolution process both through litigation and non litigation. Based in the principles of fast, accurate and cheap it is explained that banks in Indonesia must resolve their disputes through non litigation or ADR. Tulisan ini membicarakan mengenai penyelesaian sengketa antara nasabah dengan bank. Penyelesaian sengketa harusnya diselesaikan dengan prinsip cepat, tepat dan murah. Permasalahan yang diangkat dalam tulisan ini yaitu bagaimana proses penyelesaian sengketa yang ideal dalam menyelesaikan sengketa perbankan. Tulisan ini menggambarkan mengenai kelebihan dan kekurangan dalam setiap proses penyelesaian sengketa baik melalui jalur litigasi maupun non litigasi. Berdasarkan prinsip cepat, tepat dan murah maka dipaparkan bahwa perbankan di Indonesia harus menyelesaikan sengketanya melalui jalur non litigasi atau ADR.

The conception of Non-Imposing of a Penalty/Rechterlijk Pardon/dispensa de pena was unregulated in KUHP (Indonesia penal code). Conceptually, Rechterlijk Pardon is a modified form of “rigid legal certainty” to “flexible legal certainty”. This paradigm of Rechterlijk Pardon is based on from several cases that’s case have proven to commited crime, but his crimes are not feasible imposed a penalty. To respond the problem, RKUHP have created a new regulation (Judicial pardon), that’s judge may determine in the judgement no punishment, where he deems this case not proper to imposed a penalty. Konsepsi Non-Imposing of a Penalty/Rechterlijk Pardon/dispensa de pena merupakan suatu lembaga baru yang belum dikenal pada KUHP saat ini. Secara konseptual Rechterlijk Pardon merupakan bentuk dari modifikasi atas kepastian hukum yang bersifat kaku, menuju kepastian hukum yang bersifat fleksibel. Hal ini berangkat dari beberapa perkara yang sebenarnya telah memenuhi rumusan delik tindak pidana, namun perbuatannya tidak layak untuk dijatuhkan pemidanaan. Merespon masalah tersebut, RKUHP membuat suatu rumusan baru dengan mengatur dimungkinkannya pemaafan hakim terhadap beberapa perkara yang tidak layak dijatuhkan pemidanaan.

This research identifies several regulations related to public-private partnership (PPP) agreements such as acts, government regulations, presidential regulations, and local byelaws. We find that in addition to having some legal lacunae, the existing norms are either conflicting or obscure. In practice, this condition opens chance for many interpretation which eventually result in a cornucopia of different variety of inferior regulations. We will show that provisions pertaining to the designation of the contracting parties in a PPP and its dispute settlement are conflicting. Penelitian ini berhasil menunjukkan beberapa peraturan hukum yang menjadi payung hukum perjanjian kerjasama antara pemerintah dan swasta, antara lain dalam bentuk undang-undang, peraturan pemerintah, peraturan presiden, dan peraturan daerah. Ternyata masih terdapat kekosongan norma, konflik norma, dan kekaburan norma dalam berbagai peraturan hukum tersebut sehingga menimbulkan berbagai penafsiran dalam praktik, dan pada akhirnya berdampak pada berbagai ragam peraturan. Konflik norma berkisar tentang siapa yang menjadi para pihak dalam perjanjian kerjasama antara pemerintah dan swasta serta bagaimana penyelesaian sengketa atas sengketa hukum tersebut.

As an implementation of the Indonesian Banking Architecture policy, the government issues Bank Indonesia Regulation No. 9/16/ PBI/2007 on Minimum Tier One Capital that increases the minimum capital to 100 billion rupiah. This writing discusses the legal complication that a bank will face should it fail to fulfil the minimum ratio. Sebagai tindak lanjut dari kebijakan Arsitektur Perbankan Indonesia, pemerintah mengeluarkan Peraturan Bank Indonesia 9/16/PBI/2007 tentang Kewajiban Modal Inti Minimum Bank yang menaikkan modal inti minimum bank umum menjadi 100 miliar rupiah. Tulisan ini membahas akibat hukum yang akan dialami bank bila kewajiban modal minimum tersebut gagal dipenuhi.

AbstractThe Development of property business investment is entering new era. This can be seen with the new investment, Real Estate Investment Trust (REIT), which can be offered to investor in capital market. The emergence of new investment cause capital needs closely inter-link between property industry and capital market, whereby traditionally, banking industry dominated before. Property market will be more efficient, fair, accountable. It is not only dominated by only some participants/exclusives but also opened investment opportunities for middle or small investor. A part from that, the tendency of banking industries is very selective to lend fund and high interest, open to grow up this investment opportunity. Also, Indonesia is judged as one of high potential countries to grow up this property trust because of high property grow up. Regard that condition, this paper demonstrates law relation between parties in REIT and how rules of Law of Republic Indonesia Number 8 Year 1995 concerning Capital Market can accomodate the REIT implementation all at once as ‘Law Umbrella’ in Indonesia Law.
