Applicability of limited liability in corporate groups with pyramid construction creates a legal loophole in the form of a limited liability within a limited liability. To prevent moral hazard, it is necessary to stipulate new law that limits the number of levels in a corporate group. Berlakunya limited liability pada perusahaan kelompok dengan konstruksi piramida menciptakan celah hukum berupa limited liability dalam limited liability. Untuk mencegah munculnya moral hazard dari pemegang akhir atau induk perbuatan, perlu dilakukan terobosan hukum pembatasan jumlah lapisan anak perusahaan dalam konstruksi perusahaan kelompok.

In principle every legal subject has legal competence, although not all legal subjects have capacity to act. Capacity to act is ability to do legal acts which have perfect legal consequences. In the districts of Sleman Regency there also persons who are categorized as unable to do legal acts, because they are not adult persons or having such conditions that they are unable to do legal acts which have perfect legal consequences by themselves. This research was focused on the implementation of civil rights and obligations of those who are legally unable in the district of Sleman Regency. The research result indicated that persons who are unable to do legal acts in the district of Sleman Regency carried out their rights and obligations dealing with administrative and economic problems through their guardians, although these guardians were not always appointed by the court decision but were only based on factors of blood relationship, psychological and sociological propinquities between those unable persons and their candidates of guardians.

Ratification of treaties in Indonesia can be regarded as mere political acts, as ratification itself does not yet rule for its enforcement in Indonesia’s jurisdiction. As stipulated in Article 11 of the 1945Indonesian Constitution, these ratifications are still subject to consent from the Indonesian House of Representatives (DPR) as they are the appointed institution in Indonesia with treaty-making powers. The act of ratification by the Indonesian Government is regarded as a ratification only in the international sense, where such action would only make the treaty enter into force internationally, but not internally within Indonesia. This paper seeks to analyze the legal implications which signatureand ratification of international treaties may hold in the Indonesian government. Such is done by studying the class action lawsuit for Indonesia being signatories the Convention on the Protection of the Rights of All Migrant Workers and Member of Their Families and its failure continue to further ratify the Convention. Ratifikasi perjanjian internasional merupakan tindakan politik yang memerlukan persetujuan dari Dewan Perwakilan Rakyat (DPR) sebagai lembaga dengan treaty-making power sebagaimana yangdiatur oleh Pasal 11 UUD 1945. Tindakan ratifikasi oleh Pemerintah Indonesia hanya bermakna sebagairatification hanya dalam the international sense, yakni membuat perjanjian tersebut berlaku di levelinternasional, bukan berlaku di wilayah hukum Republik Indonesia. Artikel ini menganalisis proses andimplikasi hukum diratifikasinya dan ditandatanganinya suatu perjanjian internasional oleh PemerintahIndonesia dengan menelaah gugatan class action yang dilakukan terhadap Pemerintah Indonesia mengenaibelum diratifikasinya Konvensi Buruh Migran.

Local direct election is an attempt to realise an integral system of democracy and to encourage concept of popular sovereignty. The numerous obstacles on the way are challenges that eventually will help shaping the prevailing system to a more democratic one.Pemilihan umum kepala daerah secara langsung adalah merupakan sarana sekaligus upaya mewujudkan sistem demokrasi secara utuh serta sebagai langkah merealisasikan kedaulatan rakyat. Kendati dalam perjalanannya muncul sejumlah persoalan yang mengiringinya, namun hal itu haruslah dipandang sebagai tantangan sekaligus bagian dari proses pematangan dalam rangka mewujudkan pemerintahan daerah yang lebih demokratis.

AbstractIn DIY the environmental permit is recognized as an istrument for preventing the environmental problems. Local Government policies related to environmental permits are: the harmonization of economic interests with local wisdom and the environment; the interconnection between environmental permits and spatialplanning; the environmental permit as a requirement for the nuisance permit and building permit; the application of SPPL (statement letter to manage the environment) for small lactivities. According to local governments, the policies are appropriate to protect the environment.IntisariDi DIY perizinan lingkungan diakui sebagai instrumen untuk mencegah timbulnya masalah lingkungan hidup. Kebijakan Pemerintah Daerah terkait perizinan lingkungan dilakukan dengan: harmonisasi kepentingan ekonomi, muatan lokal dan lingkungan; mengaitkan perizinan lingkungan dan RTRW; menjadikan Izin Lingkungan sebagai syarat bagi Izin Gangguan dan IMB; dan penerapan SPPL bagi kegiatan mikro dan kecil. Kebijakan-kebijakan tesebut dianggap oleh Pemerintah Daerah sebagai cukup tepat bagi pelestarian fungsi lingkungan hidup di daerah.

This essay will analyse the main problems of protecting Geograhical Indication (GI) under trademark law. The problems includes improper definition, inclusion of craft, the treat becomes generic, the the registration conflict and its obstacles. Furthermore, this essay assumes that trademark law seems insufficient and incompatible to protect GI. Then essay advises an alternative protection under sui generis law by firstly describing legal basis for sui generis system for GI and minimum elements in sui generis law. Finally the essay conclude whether GI in Indonesia be more appropriately protected under sui generis law or not. Saat ini, perlindungan Indikasi Geografis (IG) di Indonesia diatur di bawah rezim Hukum Merek yang menimbulkan beberapa problematika yuridis. Problematika yuridis antara lain definisi IG yang tidak pas,muatan substansi IG, benturan pendaftaran IG dan Merek serta kendala lainnya. Berdasarkan kendalakendala tersebut, makalah ini mensintesakan bahwa perlindungan IG di dalam undang-undang Merek sepertinya tidak tepat sehingga perlu dikeluarkan dari undang-undang Merek. Selanjutnya makalah ini menganalisa alternatif perlindungan IG secara sui generis system sebagai pilihan yang lebih baik, dengan terlebih dahulu memaparkan landasaan hukum sui generis system dan unsur-unsur minimal yang harus ada pada sui generis system.

This study aims to determine whether copyright can be encumbered by fiduciary security under Act Number 42 of 1999 on Fiduciary Transfer. We employed legal normative approach, with specification to descriptive analysis. The study was conducted as a literature study and the data were analysed using normative-qualitative method. Our study finds that copyright may be encumbered by fiduciary guarantee provided that the encumbrance be put not over the copyrighted work, but on its economic value. In order to be secured under fiduciary claim, copyright must be registered with the Directorate General of Intellectual Property Rights. The registration is imperative as a proof that the fiduciary grantor is the holder of the copyright. However, several provisions in the 2009 Fiduciary Transfer Act seem to be not readily imposable to copyright. Kajian ini dilaksanakan untuk menentukan hak cipta sebagai jaminan fidusia sebagaimana diatur dalam Undang-undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Penelitian ini menggunakan metode pendekatan yuridis normatif, dengan spesifikasi penelitian deskriptif analisis. Penelitian dilaksanakan dengan melalui tahap studi kepustakaan, dan analisis data dilakukan secara normatif kualitatif. Hasil kajian menunjukan bahwa hak cipta dapat dibebani fidusia selama pembebanan fidusia bukan dilakukan kepada bendanya, tetapi kepada nilai ekonominya. Hak cipta harus didaftarkan ke Direktorat Jenderal Hak Kekayaan Intelektual agar dapat dijaminkan. Pendaftaran ini penting sebagai bukti bahwa pemberi fidusia adalah pemegang hak. Namun, terdapat beberapa ketentuan di dalam Undang-undang Jaminan Fidusia yang tidak dapat diberlakukan terhadap hak cipta.

The Disaster Management Act was set forth to reduce the risk of looming disaster and to relieve the aftermath of an already-happened one. Since this Act relates with the other laws that govern natural resources, overlap and disharmony often arise. Therefore, synchronisation of this Act with sectoral laws is needed. Undang-undang Penanggulangan Bencana disahkan untuk mengurangi risiko terjadinya bencana serta memitigasi dampak bencana yang telah terjadi. Karena undangundang ini berkaitan erat dengan peraturan perundang-undangan lain yang mengatur sumber daya alam, tumpang tindih dan ketidakselarasan terjadi. Oleh karena itu, harmonisasi antara Undang-undang Penanggulangan Bencana dengan undangundang sektoral diperlukan.

This research is empirical juridical research, using primary and secondary data. The collecting data were analyzed qualitatively. Results of the analysis are presented in the form of the description. Basic formation of the Society of the community in the Tourism Village is common values. Its development, the formation of the association has been shifted into patembayan. However patembayan which is formed still reflects the mutual values of the local community. Penelitian ini bersifat penelitian yuridis empiris, yang menggunakan data primer dan sekunder. Data yang diperoleh selanjutnya dianalisis secara kualitatif. Hasil analisis disajikan dalam bentuk uraian bersifat deskriptif. Dasar pembentukan Paguyuban pada masyarakat di Desa Wisata adalah nilai kebersamaan. Perkembangannya, pembentukan paguyuban telah bergeser menjadi patembayan. Namun patembayan yang terbentuk masih mencerminkan nilai-nilai kebersamaan dari masyarakat setempat.
