Abstract

Sex selection through assisted reproduction technology can be done by sperm sorting and Pre-Implantation Genetic Diagnosis (PGD) However, there were different regulations in many countries. This study aims to determine the regulation of sex selection with assisted reproductive technology in Indonesia and its comparison with other countries, namely the United Kingdom. This research was a normative study with a comparative and statue approach. Based on research, regulations regarding sex selection with assisted reproduction in Indonesia have been regulated in Government Regulation No. 61 of 2014 concerning Reproductive Health. Indonesia legalizes sex selection by assisting reproduction for second and subsequent children without differentiating the underlying medical and non-medical reasons. The sex selection method regulated in the regulation is the sperm sorting method, whereas, for the PGD method. It has not been regulated further, Indonesia does not yet have further regulations regarding the implementation of sex selection by assisting reproduction along with negative excesses that can occur. Whereas the UK legalizes the selection of sex by assisting reproduction for serious medical reasons and does not allow for non-medical reasons. The sex selection method regulated in the regulation is PGD. Organizing sex selection in the UK will be done after obtaining a license from the Human Fertilization and Embryology Authority (HFEA).

Abstract

Medical action approval or informed consent is a communication process between patients and doctors; starting from giving information to the patients about anything dealing with the disease besides the medical actions that would be performed. If the patients understand they will then decide on their agreement. Therefore, patients with mental disorders need the assistance of their closest family members to understand the medical actions to be performed and to signify the informed consent following the Minister of Health’s Regulation Nr. 290 of 2008 on Approval of Medical Action.Informed consent was also given to the patients of RSJD Dr. Amino Gondohutomo before conducting Premedication ECT following the Director’s Decree Nr. 445/231/2017 on ECT Service Policy at the Regional Mental Hospital Dr. Amino Gondohutomo, Central Java Province. The services included Premedication ECT (under anesthesia) and Non-Premedication ECT (without anesthesia). In accomplishing the rights to informed consent to the mental patients in premedication ECT action some obstacles had encouraged me to make a study on it.This study used a socio-legal approach that would discuss the relevant regulations and see their implementation. The data were gathered by interviewing Deputy Directors, Medical Committees, Nursing Department, Legal Affairs, psychiatric doctors, nurses, and patients’ families besides having a library and related documents studies. The data were then qualitatively analyzed before being described and presented in a narrative form.Based on the results of the study it could be concluded that the rights to informed consent to mental patients in premedication ECT action had not worked well because the patients’ families did not know any information regarding the side effects and complications even though they had signed. The informed consent did not guarantee that the patients’ families understood the information. In carrying out the job the doctors did not provide detailed information and did not re-evaluate the information that had been given before. The inhibiting factor the right to get informed consent was the fact that the doctors only gave informed consent once for several actions. The other inhibiting factors were difficulty to contact the patients’ families, distant access to the patients’ families, and homeless patients.

Abstract

Telemedisin in Indonesia was known a few years ago but unfortunately did not make progress in its implementation. As technology developed during the Industrial Revolution 4.0 era, Indonesia returned to pay attention to the telemedicine system. One manifestation is the enactment of Minister of Health Regulation No. 20 of 2019 concerning the Implementation of Telemedicine Between Health Service Facilities. In the preamble of this Permenkes, it appears that the spirit of doing telemedicine is in order to bring health services closer and improve the quality of health services in health facilities in remote areas that prioritize patient interests and safety. Despite the fact that telemedicine currently available in Indonesia is more personal between doctors and patients. Of course, this can be considered to violate existing regulations, because there are no rules that frame them. In addition to the benefits derived from telemedicine because health services for remote areas are increasingly affordable and faster, there are still many obstacles in terms of ethics and law. In legal matters, the lack of rules that frame the implementation of telemedicine can jeopardize the position of doctors in the event of a medical dispute. In terms of ethics, there are still a number of things that are not in accordance with the principles of bioethics, namely beneficence, non-maleficence, autonomy, and justice. It is feared that the doctor-patient relationship will fade in telemedicine. The doctor's professional standard is also the case, because a doctor may not be able to conduct a direct examination of patients. There are still many obstacles in the implementation of telemedicine that this should be a challenge for the Indonesian government through the Ministry of Health to pay more attention and make clearer rules to frame the implementation of telemedicine in Indonesia.

Abstract

Article 30 paragraph (1) of Law No. 38/2014 letter j explains that nurses are authorized to administer drug administration to clients, but the facts on the field nurses are actually arrested by Police  for providing pharmaceutical preparations for clients. This shows that there has been an imbalance between regulations and facts on the ground.The problem in this study is how the nurse's authority in the service of giving red label medicines in the practice of independent nursing and how the legal protection of nurses in the practice of independent nursingThis research method uses a normative juridical approach, with secondary data collection, to prove whether it is true that nurses are prohibited from giving red label drugs. The data obtained were analyzed qualitatively.Based on the results of the study found that nurses have the authority to administer all drugs including red labeled drugs except drugs that contain narcotics and psychotronics. Nurses can provide these drugs both in terms of limitations and not. In that case, nurses obtain preventive legal protection by carrying out their obligations as nurses and fulfilling the rights of patients and not committing unlawful acts.

Abstract

Nurses as professionals whose existence is recognized by the State have rights that should be fulfilled and protected as professionals and general citizens. The rights that have been guaranteed by various laws and regulations are supposed to remain insufficient to comprehensively accommodate voluntary health worker nurses spreading over the country.Various Indonesian laws and regulations on human rights have guaranteed the rights to work and decent life as well as the rights to recognition, legal certainty, and legal protection. This study aimed to know about the rights to obtain work and decent life viewed from the human rights perspective besides knowing about the guarantee of recognition, legal certainty, and legal protection to voluntary health worker nurses at Bima City, West Nusa Tenggara Province.This study was conducted at Bima City’s General Hospital and Paruga Health Center (Puskesmas). It applied a socio-legal approach and explicative-analytical specification. The data-gathering technique was carried out through interviews with informants, namely the Head of General and Personnel Affairs of Health Office of Bima City, the Head of General and Personnel Affairs of Personnel and Human Resources Office of Bima City, the Head of General and Personnel Affairs of Bima City’s General Hospital and Puskesmas Paruga beside twenty voluntary health worker nurses.The results of this study showed that there was no written legal regulation regarding the procedure of recruiting voluntary health worker nurses in the form of regional regulation nor the Mayor’s Decree that could be used as a legal basis for recruiting voluntary health worker nurses. This led to implications of the fulfillment of the rights to the voluntary health worker nurses, especially in the matters of work and decent life beside guaranteed legal recognition, certainty, and protection.

Abstract

Background: Nutrition plays an important role in health maintenance, rehabilitation, and prevention and control of disease for the elderly. If undetected, nutritional problems among the elderly may result in more rapid deterioration of health and early death.  Methods: In this study, the researcher conducted descriptive correlational design to describe the perspectives of trained health workers and significant others on the nutritional condition of the elderly in terms of nutritional screening, nutritional assessment, and nutritional indication score. Results: The population of this study is the trained health workers in Bambanglipuro and the significant others of the elderly who met the inclusion criteria. There are 50 of trained health worker respondents and 112 significant other respondents. Their assessment was assessed by themselves and tested significant differences using the T-test. All the computed t values were less than T values of 1.96. This result shows that the null hypothesis is accepted, meaning there is no significant difference between the assessment of the trained health worker respondents and the significant other respondents on the nutritional condition of the elderly. It proved that the significant others completely knew about the nutritional condition of the elderly.Conclusions: Proposed action plan can be applied for enhancement of the nutritional condition of the elderly, such as to conduct a lecture related to the importance of assessing the physical problems of the patient, conduct a lecture related to the importance of assessing the patient’s mode feeding, conduct a training workshop related how to measure Calf Circumference and Mid-arm Circumference (MAC).

Abstract

Abstract: In medical dispute resolution through mediation, a mediator with the medical qualification will be easier to facilitate the mediation process because of their expertise related to substance, but health workers which have high solidity towards the profession which will make it difficult for them to be impartial.The principal aim of this thesis was to study the doctor’s capability and doctor’s impartiality as a mediator in medical disputes. The issue will be discussed normatively juridically through the statute approach, conceptual approach, and comparative approach with Malaysia, Australia, and Netherland as the comparative country.From this research, it can be concluded that the capability of doctors as mediators of medical disputes lies in the gravity levels of doctors who are commensurate with the context of the dispute. Malaysia, Australia, and the Netherlands have required that mediators need to have an understanding of the substance and have technical knowledge of the problem at hand. A doctor’s impartiality as a mediator in medical disputes will have a tendency of partisanship and conflicts of interest.Keywords: Capability, Impartiality, Doctor, Mediator, Medical Dispute

Abstract

Abstract: Bullying has become a concerning phenomenon in any part of the world. Bullying of children has a serious impact, victims can experience psychosomatic when going to school, feel worthless, feel alienated, depressed, even commit suicide. This study discusses how the legal protection for children victim of bullying which causing mental health disorder is reviewed based on Law Number 35 the Year 2014 Regarding Child Protection and Law Number 18 the Year 2014 Regarding Mental Health and is associated with the implementation of child protection in the Social Service for Women's Empowerment and Child Protection in Cirebon City and prevention of mental health disorders in one of the hospitals in West Java. Based on the results of the study it can be concluded that children victim of bullying who had mental health disorders receive special protection as victims of psychological and physical violence (bullying) and special protection for children with disabilities who are also included in the term of People With Mental Disorder in the terminology of mental health. Legal protection also includes promotive and preventive efforts to prevent bullying children from falling into mental health disorders as well as curative and rehabilitative conditions for children who had experienced mental health disorders. All the efforts are carried out by the Government, Regional Government, Community, Family, and Parents. Integration of all components of this legal protection is expected to reduce the incidence of bullying against children and also be able to suppress mental health disorders as an outcome.Keywords: Legal protection of children, Bullying, Mental Health Disorder Abstrak: Bullying menjadi fenomena yang sangat memprihatinkan di belahan dunia manapun Bullying terhadap anak membawa dampak yang serius, korban dapat mengalami psikosomatis ketika akan berangkat sekolah, merasa tidak berharga, merasa terasingkan, depresi hingga melakukan bunuh diri. Penelitian ini membahas bagaimana Perlindungan Hukum bagi Anak Korban Bullying yang Mengakibatkan Gangguan Kesehatan Jiwa dikaji berdasarkan Undang-Undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak dan Undang-Undang Nomor 18 Tahun 2014 Tentang Kesehatan Jiwa serta dikaitkan dengan pelaksanaan perlindungan anak di Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak (DSPPPA) Kota Cirebon dan penanggulangan gangguan kesehatan jiwa di salah satu Rumah Sakit di Jawa Barat. Berdasarkan hasil penelitian dapat disimpulkan bahwa Anak Korban Bullying yang Mengalami Gangguan Kesehatan Jiwa mendapat perlindungan khusus sebagai korban kekerasan psikis dan fisik (bullying) serta perlindungan khusus anak penyandang disabilitas yang juga termasuk dalam istilah ODGJ (Orang Dengan Gangguan Jiwa) dalam terminologi Kesehatan Jiwa. Perlindungan hukum tersebut mencakup upaya promotif dan preventif untuk menghindari anak korban bullying jatuh kepada kondisi gangguan kesehatan jiwa serta kuratif dan rehabilitatif bagi anak korban bullying yang sudah mengalami gangguan kesehatan jiwa. Semua upaya di atas dilaksanakan secara simultan oleh Pemerintah, Pemerintah Daerah, Masyarakat, Keluarga, dan Orang Tua. Integrasi semua komponen perlindungan hukum di atas diharapkan dapat menekan angka kejadian bullying terhadap anak dan akhirnya juga dapat menekan luarannya yaitu gangguan kesehatan jiwa.Kata kunci: Perlindungan hukum anak, Bullying, Gangguan Kesehatan Jiwa

Abstract

Abstract: Maternal and perinatal health problems are national problems that need to be given top priority. The health status of a community is assessed through several indicators, including the Maternal Mortality Rate and the Infant Mortality Rate. To accelerate the achievement of the Millennium Development Goals (MDGs) in 2015, especially in reducing maternal and infant mortality rates, this year the Ministry of Health launched the Maternity Insurance (Jampersal) program. In reducing the Maternal Mortality Rate and Infant Mortality Rate (IMR), all sectors are required to cooperate. There are problems, including the existence of jampersal health service fees, midwives in Banyumas district have complained about the existing fees, in this case making delamatis as quality health service workers not matched with proper services. Jampersal's satisfaction is still a sign of whether Jampersal gives satisfaction to patients or even Jampersal officers themselves. This research aims to review the service quality of the Maternity Guarantee Program (Jampersal) as the Application of Local Regulations on Health Services in the Bayumas Regency. The research method is qualitative. The research subjects were private practice midwives and health centers in Banyumas Regency. As a triangulation is the Semarang City Health Office Maternity Insurance Manager and the coordinator of the IBI (Indonesian Midwives Association) midwife. Data collection was carried out through in-depth interviews. State output plays a role in health services for its people. Especially for the weak by the mandate of the 1945 Constitution Articles 28H and 34. The quality of service for the birth insurance program (Jampersal) as the application of regional regulations on health services, does not affect the quality of quality services for patient safety and their duties. The highest service satisfaction assessment is the assessment of the work aspect of a midwife who is in charge of serving and caring for patients as a noble job. Keywords: Quality, Jampersal, Regional Regulation Abstrak: Masalah kesehatan ibu dan perinatal merupakan masalah nasional yang perlu mendapatkan prioritas utama. Derajat kesehatan suatu masyarakat dinilai melalui beberapa indikator diantaranya dengan Angka Kematian Ibu dan Angka Kematian Bayi. Untuk mempercepat pencapaian Millenium Development Goals (MDGs) tahun 2015 khususnya menurunkan angka kematian ibu dan bayi, tahun ini Kementerian Kesehatan meluncurkan program Jaminan Persalinan (Jampersal). Dalam menurunkan Angka Kematian Ibu dan Angka Kematian Bayi (AKB) perlulah kerjasama semua sektor. Adanya permasalahan yang diantaranya adanya retribusi jasa pelayanan kesehatan jampersal,bidan di kabupaten Banyumas banyak mengeluhkan retribusi yang ada, dalam hal ini menjadikan delamatis sebagai tenaga kesehatan pelayanan berkualitas tidak diimbangi dengan jasa yang semestinya. Kepuasan Jampersal yang masih menjadi tanda atanya, apakah Jampersal memberikan kepuasan kepada pasien atau bahkan petugas Jampersalnya itu sendiri.Tujuan penelitian untuk meninjau kualitas layanan Program Jaminan Persalinan (Jampersal) Sebagai Penerapan Peraturan Daerah Tentang Jasa Pelayanan Kesehatan di Kabupaten Bayumas. Metode penelitian adalah kualitatif. Subjek penelitian adalah bidan praktek swasta dan di puskemas di wilayah Kabupaten Banyumas. Sebagai Triangulasi adalah Pengelola Jaminan Persalinan Dinas Kesehatan Kota Semarang dan koordinator bidan IBI (Ikatan Bidan Indonesia). Pengumpulan data dilakukan melalui wawancara mendalam. Hasil negara berperan dalam pelayanan kesehatan bagi rakyatnya. Terutama bagi kaum lemah sesuai amanat UUD 1945 Pasal 28H dan 34. Kualitas layanan program jaminan persalinan (Jampersal) sebagai penerapan peraturan daerah tentang jasa pelayanan kesehatan, tidak mempengaruhi kualitas pelayanan yang bermutu bagi keselamatan pasien dan tugasnya. Penilaian kepuasan pelayanan yang tertinggi yaitu penilaian aspek pekerjaaan seorang bidan yang bertugas melayani dan merawat pasien sebagai suatu pekerjaan yang mulia.Kata kunci: Kualitas, Jampersal, Pearaturan Daerah

Abstract

Abstract: Medical record is a file that contains records and documents about the patient's identity, examination, treatment, actions, and other services that have been provided to patients. This study aims to determine the legal arrangements regarding the medical record, to find out law enforcement against the Public Relations of Langsa Public Hospital publish patient medical records in online media and to find out the obstacles and efforts made in law enforcement against the Public Relations of Langsa Public Hospital that open patient medical records. The method used in this study is normative and empirical juridical. 1) In medicine, it is not permissible for a doctor or employee of a public hospital to open a medical record through the Public Relations media of Langsa Regional Hospital according to Law Number 29 of 2004 Article 51. 2) Law enforcement against someone who opens a medical record at Langsa Regional Hospital is considered ineffective because law enforcement officials, in this case, are not serious in handling cases that should be prosecuted. 3) Obstacles in law enforcement in Langsa Regional Hospital, namely that there are still overlapping laws by the police so that law enforcement cannot be carried out fairly and the efforts made in law enforcement against Langsa Regional Hospital that open medical records by means of supervision and coordination between leadership and staff in hospitals Langsa.Keywords: Law Enforcement, Medical Records, Media Abstrak: Rekam medis merupakan berkas yang berisi catatan dan dokumen tentang identitas pasien, pemeriksaan, pengobatan, tindakan dan pelayanan lain yang telah diberikan kepada pasien. Penelitian ini bertujuan untuk mengetahui pengaturan hukum tentang rekam medis, untuk mengetahui penegakan hukum terhadap pihak Humas RSUD Langsa mempublikasikan rekam medis pasien di media online dan untuk mengetahui hambatan dan upaya yang dilakukan dalam penegakan hukum terhadap pihak Humas RSUD Langsa yang membuka rekam medis pasien. Metode yang digunakan penelitian ini adalah yuridis normatif dan empiris. 1) Dalam medis, tidak di bolehkan bagi seorang dokter maupun pegawai rumah sakit umum untuk membuka rekam medis melalui media Humas RSUD Langsa yang atas Undang-Undang Nomor 29 Tahun 2004 Pasal 51. 2) Penegakan hukum terhadap seseorang yang membuka rekam medis di RSUD Langsa dinilai tidak efektif dikarenakan aparat penegak hukum dalam hal ini tidak serius dalam menangani kasus yang seharusnya dapat di pidanakan. 3) Hambatan dalam penegakan hukum di RSUD Langsa yaitu masih adanya timpang tindih hukum yang dilakukan oleh aparat kepolisian sehingga penegakan hukum tidak dapat dilaksanakan secara adil dan adapun upaya yang dilakukan dalam penegakan hukum terhadap pihak RSUD Langsa yang membuka rekam medis dengan cara adanya pengawasan dan koordinasi antara pimpinan dan staf di RSUD Langsa.Kata Kunci: Penegakan Hukum, Rekam Medis, Media
